BACKGROUND: Located in the General Retail "GR " zoning district, the applicant is propo sing to redevelop the entire irregular shaped site located at 6144 S. Di xie Highway which currently has an exist i ng one-story building that is occupied by a furniture store . As part of the revitali zation , the applicant is proposing to demolish the existing one -story building and construct two (2) new separate one-story structures. One structure is for retail space and the other structure is for restaurant space . The applicant has requested a variance to waive four (4) off-street parking spaces for the site, reducing the required amount of off-street parking spaces from 27 to 23 . Dixie Highway AprilS, 2016 Page 2 af 5 REQUEST: After reviewing the variance request for compliance with the Land Development Code (LDC), Comprehensive Plan and Future Land Use Map, the applicant is requesting the following: 1. Variance of off-street parking space requirements to permit 23 off-street par~ing spaces where 27 are required via Section 20-s.9{H), LDC 2. Improvement of the right-of-way adjacent to the subject property for credit as on-street parking spaces via Section 20-4.4{A)(2), LDC 3. Payment into the City of South Miami Parking Fund via Section 20-4.4{A)(3)' LDC ANALYSIS: Pursuant to the Variance approvals, Section 20-5.9 of the LDC, a variance for off-street parking can be reviewed and permitted by the city commission at a public hearing, after a recommendation by the planning board. When reviewing the project, the following items are noted about the project: • The space is currently occupied by a furniture store. • Once redeveloped, the proposed redevelopment will consist of the following square footages: o Retail Use: 3,510 square feet o Restaurant Use: 1,500 square feet • Pursuant to Section 20-4.4{B)(11) of the LDC, the parking condition for retail use is generally one (1) parking space per three hundred (300) square feet of gross floor area • Pursuant to Section 20-4.4{B)(7) of the LDC, the parking condition for general restaurant use is one (1) parking space per one hundred (100) square feet of gross floor area PARKING ANALYSIS As shown on the attached revised site plan, the applicant is proposing a complete redevelopment of the site. Pursuant to the information listed above, the retail component of the redevelopment will require a total of twelve (12) parking spaces, whereas the general restaurant component will require fifteen (ls) for a total of twenty-seven (27) parking spaces required for the project. After review of the attached revised site plan, it is shown that the applicant will be providing a total of twenty-one (21) parking spaces on the site and one (1) turn around space. It is important to note that as shown on the attached Revised plat for Larkin Pines as well as the Sketch of Boundary Survey, the area to the south of the subject property has been reserved for parking and beautification which is considered public right-of-way. The applicant is proposing to redevelop this area as well, adding both landscaping and two (2) additional parking spaces. If approved, the applicant would have to comply with the regulations listed in Section 20- 4.4{A)(2) of the LDC which is as follows: Variance -6144 S. The City Manager upon the advice of the Parking Board, will determine if the installation of parking meters is warranted and appropriate for the area. Furthermore, pursuant to Section 20-4.4(A)(3) ofthe Land Development Code, An annual fee of one thousand dollars ($1,000.00), per space, which shall increase five (5) percent annually, shall be paid into the Parking Fund for all on- street parking spaces which are credited or counted toward required parking for new structures, or a change in use that increases the minimum number of off- street spoces required after the date of January 2, 2008. Once redeveloped, the applicant will be providing a total of twenty-three (23) off-street parking spaces for the project. In order to meet the minimum requirement of twenty-seven (27) off- street parking spaces for the project, the applicant is requesting a variance to waive four (4) off- street parking spaces. Because the applicant's project will affect the public right-of-way, the proposed commercial redevelopment was reviewed by the Public Works Department. As referenced in the attached emails, Public Works is in agreement with the proposed configuration of the alley in that it will be safer for the users. Furthermore, Public Works has requested that a tree covenant be put in place that will cover all of the landscape improvements that are proposed within the right-of- way. Last the Public Works department is requiring that the applicant make sure that the locations of the proposed plantings do not conflict with any existing utilities. VARIANCE ApPROVAL Pursuant to Section 20-S.9(H) of the Land Development Code, all variance decisions shall be based on an affirmative finding as to each of the following criterion: 1. The variance is necessary to relieve particular extraordinary conditions relating to a specific property; Due to the size and configuration of the subject property, a variance would be necessary to accommodate the minimum amount of off-street parking spaces required to redevelop commercial square footage that is comparable to the amount currently developed on the property (approximately 6,434 S.F.). 2. Denial of the variance would result in hardship to the owner. Hardship results if the restriction of the zoning ordinance, when applied to a particular property, becomes Variance -6144 S. Dixie Highway April 5,2016 Page 4 of 5 arbitrary, confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; Due to the irregular shape of the subject property, denial of the variance would limit the redevelopment capability of the site and make it more restrictive than other properties in the GR district. 3. The extraordinary conditions and circumstances do not result from the actions of the applicant; The shape or size of the lot has not been reduced or modified by the applicant. The current shape of the lot is how it was originally platted. 4. The requested variance is the minimum variance necessary ta make possible the reasonable use of the land, building or structure; While there isn't a maximum requirement for building coverage for the "GR" zoning district, the district does have a maximum impervious coverage which is 85% of the lot. Based on the size of the subject lot, the maximum amount of impervious coverage allowed for the site would be approximately 13,136 square feet. Because the applicant is proposing to pave 13,136 square feet (85%), there would be no additional area available to add the parking spaces that are deficient. Furthermore, the applicant is proposing the best use of the irregularly shaped lot. 5. That the appraval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Because the area surrounding the subject property is populated with commercial type uses followed by residential districts further to the east, a buffer between the subject property and the residential properties has been created. Because of this, a variance for four (4) parking spaces would not be injurious to the neighborhood or detrimental to the public welfare of the community. PLANNING BOARD ACTION: At the November 10, 2015 public hearing the Planning Board recommended approval of the Variance with a vote of 5 to O. STAFF RECOMMENDATION: Staff recommends approval for the Variance application to reduce the minimum off-street parking requirement from 27 to 23 parking spaces for the proposed commercial redevelopment located at 6144 S. Dixie Highway. This approval is subject to the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations: Variance -6144 S. Pursuant to Section 20-4.4(A)(2) of the Land Development Code, the applicant shall enter into a parking space agreement with the City for the two (2) proposed parking spaces that will be located in the public right-of-way. 2. Any and all exterior renovations or modifications for the proposed commercial redevelopment are subject to approval by the ERPB. 3. A tree covenant be put in place that covers all landscape improvements that are proposed within the right-of-way 4. The proposed plantings in the right-of-way do not conflict with any existing utilities. Dixie Highway. 5 6 WHEREAS, Manaca South Miami Center submitted an application PB-15-030 for a 7 variance to reduce the required number of off-street parking spaces from 27 to 23 fot a proposed 8 commercial redevelopment that includes a combination of general restaurant and retail use that 9 will be located at 6144 South Dixie Highway in the General Retail (GR) zoning district; and 10 11 WHEREAS, subject to Section 20-4.4(B)(11) of the Land Development Code which 12 states that the parking condition for retail use is generally one (1) parking space per three 13 hundred (300) square feet of gross floor area, a total of twelve (12) off-street parking spaces are 14 required; and 15 16 WHEREAS, subject to Section 20-4.4(B)(7) of the Land Development Code which 1 7 states that the parking condition for general restaurant use is one (1) parking space per one 18 hundred (100) square feet of gross floor area, a total of fifteen (15) off-street parking spaces are 19 required; and 20 21 WHEREAS, the applicant is proposing a total of twenty-one (21) off-street parking 22 spaces for the proposed commercial redevelopment; and 23 24 WHEREAS, the applicant is proposing to redevelop the public right-of-way by adding 25 both landscaping and two (2) additional parking spaces requiring that the applicant comply with 26 the regulations listed in Section 20-4.4(A)(2) of the Land Development Code; and 27 28 WHEREAS, Section 20-4.4(A)(2) of the Land Development Code provides that 29 "unimproved rights-of-way adjacent to business property in commercial zoning districts may be 30 improved by the abutting property owner for credit as on-street parking spaces by written 31 agreement approved by the application to the City Manager provided that the property owner 32 complies with subsection 20-4.4(A)(3)"; and 33 34 WHEREAS, Section 20-4.4(A)(3) of the Land Development Code provides that "An 35 annual fee of one thousand dollars ($1,000.00), per space, which shall increase five (5) percent 36 annually, shall be paid into the Parking Fund for all on-street parking spaces which are credited 37 or counted toward required parking for new structures, or a change in use that increases the 38 minimum number of off-street spaces required after the date of January 2,2008"; and 39 40 WHEREAS, Pursuant to Section 20-5.9(H) of the Land Development Code, The City's 41 Planning and Zoning Department has made the following findings: 42 43 44 1. Based on the size of the subject lot, the requested variance is the minimum variance necessary to make possible the reasonable use of the land. 5. Because the area surrounding the subject property is within the GR zoning district, the variance would not be injurious to the neighborhood or detrimental to the public welfare of the community. 11 WHEREAS, the approval of a variance requires a recommendation from the Planning 12 Board and the approval of the City Commission after a public hearing; and 13 14 WHEREAS, at the November 10,2015 Planning Board meeting, and following a public 15 hearing, the Board reviewed application PB-15-030 and voted 5 ayes, 0 nays to recommend 16 approval of the request for a variance to reduce the required number of parking spaces from 27 to 17 24 for the proposed commercial redevelopment; and 18 19 WHEREAS, the City Commission desires to accept the recommendation of the Planning 20 Board and approve the Variance. 21 22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 23 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 24 25 Section 1: The recitals set forth in this resolution are true, they are supported by 26 competent substantial evidence and they are incorporated into this resolution by 27 reference. 28 29 Section 2: Variance Application (PB-15-030) submitted by applicant Manaca South 30 Miami Center LLC, requesting a variance of Section 20-4.4(B)(1l) of the Land 31 Development Code to reduce the required number of required parking spaces from 27 to 32 23 for a proposed commercial redevelopment located at 6144 South Dixie Highway in 33 the General Retail (GR) zoning district is hereby approved. For the Term of this Agreement, Owner agrees that off-street parking on the Property as shown on the site plan approved by the City Commission shall be available at all times to visitors to the Property. No spaces shall be reserved for certain users of the Property, except for spaces limited to vehicle turnaround and spaces limited to handicapped persons. 5. The provisions of this Covenant shall become effective upon its recordation in the Public Records of Miami-Dade County, Florida. In the event it is necessary or desirable to re- record, then at the option of the City and if allowed by law, the Covenant may be re-recorded when necessary or required to maintain, uninterrupted, the effectiveness of the covenant running with the land during the entire term of this Covenant. 6. This Covenant may be modified, amended, or released as to any portion of the Property by a written instrument executed on behalf of the Owners and approved by the City Commission. Should this instrument be modified, amended or released (other than as provided in Section 5 above), the City Manager shall execute a written instrument in recordable form to be delivered to the Owner and recorded in the Public Records of Miami-Dade County, Florida, effectuating and acknowledging such modification, amendment, or release, in a form approved by the City Attorney. 7. Invalidation of any of these covenants by judgment of court shall not affect any of the other provisions, which shall remain in full force and effect. 8. Mr. Jerry Proctor introduced himself as the representative for the item. Mr. Proctor asked if item PB-1S-029 and PB-1S-030 could be heard at the same time, of which the Board agreed. Mr. Proctor invited the architect for the project, Jim Smith, to the podium to speak on the architecture and landscaping for the project. Mr. Smith gave a presentation on the architecture and landscaping for the project to the board. Dr. Philips asked how the rear parking spaces would be accessed, if there is no entrance, only an exit. Mr. Proctor responded that the spaces would be accessed through the alleyway. Dr. Dr. Philips asked how employee parking would be managed. Mr. Proctor explained how the parking space ratio for restaurant uses in the GR zoning district work and how it will manage parking spaces for workers of the restaurant. Mr. Basu stated that the correct parking space ratio for restaurant uses for the record. He then stated that the city's parking is an issue because the city uses suburban parking requirements in an urban setting. The issue needs to be addressed. Mr. Greiner stated that he was in agreement with Mr. Basu in that the parking issue should be addressed. 3 Ms. Fischer asked the applicant if there were available on-street parking spaces. Mr. Smith responded yes but there wasn't a large amount available. Mr. Held asked when the special use extension for the item would be discussed. Mr. Proctor responded that he has every intention of raising the issue with the City Commission because they are the only body that can rule on that request. Mr. Held stated that the extension should be made a part of the request so that the Planning Board can hear it and make a recommendation to the City Commission. Mr. Proctor added that he doesn't anticipate the project commencing until at least a year from commission approval. Mr. Greiner responded that when the City Commission looks at an extension request, they are considering other factors that could affect the project such as progress of the project. We discussed the option of utilizing the existing alley as the neighbor is doing to accommodate some parking spaces and the location for the dumpster for garbage pickup. PW believes that to improve the safety of the alley it should be reconfigured so traffic will only enter from the east and west sides and exit to the south. We presented this alternative as an idea. The applicant shall be responsible in gather all the required information and if needed the consent from the neighbors. Redevelopment with enhanced off-street parking and landscaping will bring the Property into greater compliance with modern City regulations. Special Use Approval for a general restaurant, including beer/wine service and outdoor dining; and 2. Variance of parking requirements to permit 24 off-street parking spaces (27 spaces required). The request for a restaurant complies with the standards in the "GR" zoning district, which allows a broad range of retail uses, including restaurants. The development of a restaurant on the Property will comply with City's prescribed standards for "special use" approval in that a restaurant will not adversely affect the health and safety of persons residing or working in the area and will not be detrimental to the public welfare. The variances of off-street parking requirements IS substantiated by the following facts: 1. The variance is necessary to relive particular extraordinary conditions relating to a specific property. The size and configuration of the Property result in variances to redevelop commercial square footage that is comparable to the amount currently developed on the Property. The shape of the Property, with a narrow width of about 6S feet in the center of the Property, distinguish the Property and limit the Property's redevelopment capability in a manner that is more restrictive than other properties in the GR District. 3. Extraordinary conditions and circumstances do not resolve from the actions of the Applicant. The Applicant has not reduced or otherwise altered the size or shape of the Property since purchasing the Property in 2013. 4. The requested variance is the minimum variances necessary to make possible the reasonable use of the land, building or structure. The Land Development Gode offers unreasonable restrictions on restaurants by (1) requiring more parking in the GR District for restaurants than required in the Hometown District. 5. Approval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or .otherwise detrimental to the public welfare. The area surrounding the Property is non-residential, and the right-of-way areas include additional parking spaces available to visitors to the Property. The application complies with Future Land Use Objective 1.1 by bringing the Property into compliance with the purposes of the current Land Development Code in the following ways: (a) The development is a Mixed-Use development that complies with modern goals and objectives; and (b) The development dramatically expands the amount of landscaping and open space on the Property. Section 20.S.B(c) of the Land Development Code provides that an approved special use shall lapse after 6 months if no master building permit has been issued. By virtue of this application and .the ability of the City Commission vested in the Land Development Code to extend the approval period, please accept this request to extend this time frame to one (1) year after City Commission approval. There are existing leases governing use of the Property that will delay re-development. In addition, the building permit process, particularly at certain Miami-Dade County agencies, is lengthy and cumbersome.
