Dixie Highway. BACKGROUNO: Located in the General Retail (GR) zoning district, the applicant is proposing to redevelop the site located at 6144 S. Dixie Highway which currently has a one-story building that is occupied by a furniture store. As part of the revitalization, the applicant is proposing to demolish the existing one-story building and construct two (2) new separate one-story buildings on the site . One structure will support retail while the other structure will support restaurant space . Subject Building located 6144 S. Dixie Highway REQUEST : After reviewing the proposed general restaurant use for compliance with the Land Development Code (LDe), Comprehensive Plan and Future Land Use Map, the applicant is ) requesting the following: 1 . Special Use approval via Section 20-3.4{A) and Section 20 -3.4{B)(4)(b), LDC City Comm ission Item : Speclol Use -General Restaurant March 1 5, 201 6 Po ge 2 0/3 2. Special Use extension for 1 year via Section 20 -5.8(C), LDC ANALYSIS : Pursuant to the Special Use Conditions, Section 20-3 .4 of the LDC , a special use may be approved and perm itted by the city commission at a public hearing, after a recommendation by the.nning board and that such use complies with the general requirements, special requi r ements, and any other conditions that the city commission may consider appropriate and necessary. When reviewing the project, the following items are noted about the project: • The building is currently occupied by a furniture store. • The proposed project is near similar restaurant uses to the south (Kyojin Japanese Buffet, McDonalds, and Cafe Bonjour). • Once redeveloped , the proposed general restaurant space will be comprised of 1,500 square feet. PARKING ANALYSIS As shown on the attached site plan , the applicant is proposing a complete redevelopment of the site . Pursuant to both the Permitted Use Schedule, Section 20-3.3(0} and Section 20 - 4.4(B}(7} of the LDC, the parking condition for a general restaurant use is one (1) parking space per one hundred (100) square feet of gross floor area . Therefore, the 1,500 square foot general restaurant will be required to provi de a minimum of fifteen (15) parking spaces where twenty- two off-street parking spaces are being proposed . SPECIAL USE ApPROVAL After review of the project, the proposed general restaurant use complies with both the general and special requirements listed in both Section 20-3.4(A} and Section 20-3.4(B}(4}(b} and of the LDC, respectively, in that the use : • Is in compliance with the General Retail (GR) zoning district; • Is compatible and complementary to the existing uses within the surrounding areas; • Is providing only inside or patio service on private property only; and • Is not providing serv i ces of a drive-in or of a fast food . Pursuant to Section 20-5 .8(C) of the LDC, an approved special use shall lapse after six (6) months if no master building permit which implements the special use or certificate of occupancy has been issued for such use and if the city commission has not specified a longer approval period for good cause . The applicant is requesting a one year expiration extension of the Special Use approval to allow for coordination and proper planning of the project. Section 20-5 .8(0} of the LOC allows for the City Commission to extend Special Use Approvals . Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, • • b. Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c. Complies with all other applicable Code provisions. Last, if the special use is, in the future, determined by the Director of Planning, to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental to the public welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the special use approval may be modified or revoked by the City Commission upon notification and public hearing. PLANNING BOARD ACTION: At the November 10, 2015 public meeting and following a public hearing, the Board voted 5-0 to recommend approval of Special Use Permit application PB-15-029. The Board also recommended that the developer address an extension of the 6 month Special Use approval with the City Commission in order to provide the time needed to construct the new structures. RECOMMENDATION: Staff recommends approval for the Special Use application to operate a general restaurant with a one (1) year extension for a total of one and one half (111) years at 6144 S. Dixie Highway subject to the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations: 1. Adhere to the SpeCial Conditions applicable in Section 20-3.4{B}{4}{b) General Restaurant and Section 20-5.8 SpeCial Use Approval of the Land Development Code, listed. 2. The request for an extension of time to allow for coordination and proper planning of the project is approved for a period of 360 days following the initial six (6) month Special Use time period. 3. WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC), the applicant, Manaca South Miami Center, LLC submitted Application No. PB-1S-029 to the Planning Board requesting a Special Use Approval to operate a general restaurant located at 6144 South Dixie Highway, within the General Retail "GR" zoning district; and 11 WHEREAS, the applicant proposes to demolish and construct a new general restaurant in 12 the existing vacant space that will front on South Dixie Highway; and 13 14 WHEREAS, restaurants are permitted as a special use within the General Retail "GR" 15 zoning district and is subject to meeting general conditions specified in LDC Section 20-S.8 and 16 subject to meeting special use requirements set forth in LDC Section 20-3.4(B)(4)(b); and 17 18 WHEREAS, the applicant's general restaurant special use meets the special use 19 requirements set forth in LDC Section 20-3.4(B)(4)(b) which are: 20 21 22 23 24 25 26 27 28 29 i. Mr. Proctor invited the architect for the project, Jim Smith, to the podium to speak on the architecture and landscaping for the project. Mr. Smith gave a presentation on the architecture and landscaping for the project to the board. Dr. Philips asked how the rear parking spaces would be accessed, if there is no entrance, only an exit. Mr. Proctor responded that the spaces would be accessed through the alleyway. Dr. Dr. Philips asked how employee parking would be managed. Mr. Proctor explained how the parking space ratio for restaurant uses in the GR zoning district work and how it will manage parking spaces for workers of the restaurant. Mr. Basu stated that the correct parking space ratio for restaurant uses for the record. He then stated that the city's parking is an issue because the city uses suburban parking requirements in an urban setting. The issue needs to be addressed. Mr. Greiner stated that he was in agreement with Mr. Basu in that the parking issue should be addressed. 3 Ms. Fischer asked the applicant if there were available on-street parking spaces. Mr. Smith responded yes but there wasn't a large amount available. Mr. Held asked when the special use extension for the item would be discussed. Mr. Proctor responded that he has every intention of raising the issue with the City Commission because they are the only body that can rule on that request. Mr. Held stated that the extension should be made a part of the request so that the Planning Board can hear it and make a recommendation to the City Commission. Mr. Proctor added that he doesn't anticipate the project commencing until at least a year from commission approval. Mr. Greiner responded that when the City Commission looks at an extension request, they are considering other factors that could affect the project such as progress of the project. Dixie Highway (the "Property"). The undersigned represents Manaca South Miami Center, LLC (the "Applicant"), the property owner of land at 6144 South Dixie Highway of approximately 15,399 square feet in size (the "Property"). The Property is zoned GR ("General Retail") and is designated on the City Land Use Map for "Commercial Retail and Office (Two-Story)" development. The Property has been zoned and designated for commercial development for many years and is currently developed with a one story commercial building with approximately 4,625 square feet of floor area. Access to the Property is from South Dixie Highway and also from S.W.61st Avenue to the southwest. The Property is located directly adjacent to a "McDonalds" restaurant with drive-thru capabilities. The Applicant proposes to redevelop the Property with two one-story buildings totaling approximately 5,000 square feet of floor area. As part of the proposal, on attached site plans prepared by JAS Group Architects/Planners, the Applicant proposes a significant upgrade in the quality and appearance of the development on MIAMI 4774639.6 81983/4738. Redevelopment, as designed on the attached plans, will consist of a one-story restaurant building of approximately 1,500 square feet in size, with patron area of approximately 1,100 square feet, and a one-story retail building of approximately 3,500 square feet in size. Redevelopment with enhanced off-street parking and landscaping will bring the Property into greater compliance with modern City regulations. The restaurant building will be located adjacent to South Dixie Highway, and the retail building will be located to the South, closer to S.W. 61st Avenue. 18 of the 24 parking spaces provided will be located along the South Dixie Highway frontage of the Property, thereby continuing the orientation of the traffic impacts of the Development toward South Dixie Highway. There will be four additional parking spaces located to the south, adjacent to the public alley and the. area further south, where two additional parking spaces will be developed by the Applicant. This additional parking is located in an area that is designated for "parking and beautification" on the Plat governing development of the Property. A copy of the Plat entitled "Larkin Pines" recorded in Official Records Book 53, at Page 41, is attached. The Applicant makes the following specific requests in conjunction with the Application: ' 1. Special Use Approval for a general restaurant, including beer/wine service and outdoor dining; and 2. Variance of parking requirements to permit 24 off-street parking spaces (27 spaces required). The request for a restaurant complies with the standards in the "GR" zoning district, which allows a broad range of retail uses, including restaurants. The development of a restaurant on the Property will comply with City's prescribed standards for "special use" approval in that a restaurant will not adversely affect the health and safety of persons residing or working in the area and will not be detrimental to the public welfare. The variances of off-street parking requirements IS substantiated by the following facts: 1. The variance is necessary to relive particular extraol'dinary conditions relating to a specific property. The size and configuration of the Property result in variances to redevelop commercial square footage that is comparable to the amount currently developed on the Property. Denial of the variance would result in hardship to the Owner. The shape of the Property, with a narrow width of about 65 feet in the center of the Property, distinguish the Property and limit the Property's redevelopment capability in a manner that is more restrictive than other properties in the GR District. 3. Extraordinary conditions and circumstances do not resolve from the actions of the Applicant. The Applicant has not reduced or otherwise altered the size or shape of the Property since purchasing the Property in 2013. 4. The requested variance is the minimum variances necessary to make possible the reasonable use of the land, building or structure. The Land Development Code offers unreasonable restrictions on restaurants by (1) requiring more parking in the GR District for restaurants than required in the Hometown District. 5. Approval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or .otherwise detrimental to the public welfare. The area surrounding the Property is non-residential, and the right-of-way areas include additional parking spaces available to visitors to the Property. The application complies with Future Land Use Objective 1.1 by bringing the Property into compliance with the purposes of the current Land Development Code in the following ways: (a) The development is a Mixed-Use development that complies with modern goals and objectives; and (b) The development dramatically expands the amount of landscaping and open space on the Property. Section 20.5.S(c) of the Land Development Code provides that an approved special use shall lapse after 6 months if no master building permit has been issued. By virtue of this application and .the ability of the City Commission vested in the Land Development Code to extend the approval period, please accept this request to extend this time frame to one (1) year after City Commission approval. There are existing leases governing use of the Property that will delay re-development.
