A Resolution for special use approval to permit a law office at 6001 SW 70 Street, Unit CU-l0l.
BACKGROUND:
On October 2,2001, the City Commission adopted Ordinance #24-01-1755 which changed the official
zoning map for the property located at 6001 SW 70 Street, identified as the Valencia Condominium
Building, from "MO" Medium Intensity Office to "TODD MU-5" Transit Oriented Development District
Mixed Use-5. As part ofthe approval, it was specifically designated that all commercial space on the first
floor of the building facing SW 59th Place is limited to retail uses as set forth in the city's Permitted Use
Schedule.
Due to vacancies in the commercial space, the City adopted Ordinance #06-10-2031 on February 2,
2010. Ordinance #06-10-2031 amended the site plan for the Valencia Condominium building and
allowed retail uses, office, business and personal services as set forth in the Permitted Use Schedule to
occupy the commercial space, provided that each office, business and personal services use be
approved via the Special Use Permit process as set forth in Section 20-5.8 of the Land Development
Code (LOC). Because the applicant, Jonathan David, is proposing to open a law office at the Valencia
Condominium bUilding, it is required that his item be reviewed under the Special Use Permit process.

REqUEST:
The applicant is requesting approval from the City Commission to operate a law office at 6001 SW 70
Street, Unit CU-101. Pursuant to Ordinance #06-10-2031, each office, business and personal services use
is approved by the Special Use Permit process set forth in Section 20-5.8.
ANALYSIS:
Pursuant to the Special Use Conditions, Section 20-3.4 of the LDC, a special use may be approved and
permitted by the city commission at a public hearing, after a recommendation by the planning board
and that such use complies with the general requirements, special requirements, and any other
conditions that the city commission may consider appropriate and necessary.
When reviewing the project, the following items are noted:
• Tenant Space #CU-l0l is currently vacant.
• The attached Building Plan, sheet A-O, shows that the tenant space is approximately 515 square
feet.
• The applicant is proposing to operate as a law office.
• Pursuant to the attached Designation of Right to Use Parking Space, a total of two (2) parking spaces
have been designated to Tenant Space #CU-101.
As shown on the attached Floor Plan, sheet A-l, the applicant is proposing to renovate the tenant space
in order to accommodate the use of a law office. Typically a law office would be a use that is permitted
by right on properties that are zoned TODD MU-S. However, pursuant to Ordinance #06-10-2031, all
office and personal service type uses that wish to operate in the Valencia Condominium building are
required to obtain a Special Use Permit from the City Commission prior to commencement, for which a
law office is categorized.
PARKING SPACE ANALYSIS
Pursuant to the information provided, the minimum amount of parking spaces required for the
proposed law office is as follows:

Based on the calculations listed above, the proposed law office will be required to provide a minimum of
two (2) parking spaces for which the applicant has provided documentation that states that they will be
assigned.
SPECIAL USE ApPROVAL
After review of the project, the proposed law office use complies with the general requirements listed in
Section 20-3.4(A) of the LDC in that the proposed use:
• Complies with all requirements established in the TODD MU-S zoning district;
• Is compatible and complementary to the existing uses within the surrounding areas;

The proposed use complies with Section 20-3.4(A) of the LDC in that the use complies with all
requirements established in the TODD MU-5 zoning district. Additionally, with an existing counseling
services use to the south of the Valencia Condominium building and an automobile repair/body-shop to
the north, the proposed use would be both compatible and complementary to the existing uses within
the surrounding area.
Moreover, the requested special use does not conflict with the Comprehensive Plan and complies with
the LDC requirements set forth in Section 20-5.8(B) of the LDC in that the use:
a. Will not adversely affect the health or safety of persons residing or working in the vicinity of the
proposed use,
b. Will not be detrimental to the public welfare or property or improvements in the neighborhood;
and,
c. Complies with all other applicable Code provisions.
last, if the special use is, in the future, determined by the Director of Planning, to be adversely affecting
the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental
to the public welfare or property or improvements in the neighborhood, or to be not in compliance with
other applicable Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing.
PLANNING BOARD ACTION:
At the February 17, 2016 Planning Board meeting and following a public hearing, the Board voted 6-0 to
recommend approval of Special Use Permit application PB-16-003.
After the Board recommended approval for the item, they held a discussion on encouraging the City
Commission to revisit special use approvals at the Valencia Condominium building in order to permit
office, business and personal uses in the building without the requirement to go through the special use
permit process. The Board voted 6-0 to recommend that Ordinance 06-10-2031 be amended to strike
the last sentence in Section 1 that reads:
" ... provided that each office, business and personal services use is opproved by the
Special Use permit process set forth in Section 20-5.8."
RECOMMENDATION:
Staff recommends approval for the Special Use application to operate a law office at 6001 SW 70 Street,
Unit CU-101.

8 approved via Ordinance #24-01-1755 prohibited this and any other office or personal services
9 type uses from occupying the ground floor of the Valencia Condominium building; and

11 WHEREAS, due to vacancies in the ground floor commercial area, the City Commission
12 passed and adopted Ordinance #06-10-2031 on February 2, 2010, amending the Site Plan
13 (Section 1, Condition 1) for the Valencia Building (aka Shoal Creek Properties), as submitted to
14 the City on September 28, 2001, in order to show that in addition to retail uses, office, business
15 and personal services as set forth in .the LDC Pe=itted Use Schedule for the TODD MU-5
16 zoning district shall be pe=itted in the commercial space of the project, provided that each
17 office, business and personal services use is approved by the Special Use pe=it process set forth

AN ORDINANCE OF THE MAYOR & CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, RELATING TO AN AMENDMENT TO THE SITE
PLAN FOR THE VALENCIA BUILDING LOCATED AT 6001 SW 70 th STREET
WHICH SITE PLAN WAS ADOPTED VIA ORDINANCE NO. 24-01-1755 ON
OCTOBER 2, 2001; THE AMENDMENT WOULD ALLOW OTHER USES IN
ADDITION TO RETAIL USES IN THE FIRST FLOOR COMMERCIAL SPACES;
PROVIDING FOR SEVERABILTY; PROVIDING FOR ORDINANCES IN
CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission on October 2, 2001 adopted Ordinance 24-01-

of the building facingSW 59 th Place was to be limited to "Retail" uses as sel forth in the
Land Development Code Permitted Use schedule; and
WHEREAS, over the past eight years most of the commercial spaces on the ground
floor have remained vacant and it has been difficult to attract tenants which are strictly
retail establishments; and
WHEREAS, in order to expand the opportunities for local residents to establish
businesses in the building and the community, the City Commission at its November 3,
2009 meeting adopted Resolution No. 196-09-13005 requesting the Planning Board and
the Planning and Zoning Department to initiate the necessary legislation to amend the
adopted site plan to allow other uses (office, business and personal services as set forth in
LDC Permitted Use Schedule); and
WHEREAS, The Planning Board at its December 22, 2009 meeting, after public
hearing, approved a motion by a vote of 5 ayes 0 nays recommending that the proposed
amendment as shoWn in the attached draft ordinance be adopted; and
WHEREAS, the City Commission. desires to accept the recommendation of the
Planning Board and enact the aforesaid amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the Site Plan (Section 1, Condition 1) for the Valencia Building (aka Shoal
Creek Properties), as submitted to the City on September 28, 2001 and adopted by

WHEREAS, Application No. PB-OI-OI5 was submitted to tbe Planning and Zoning Department
by Shoal Creek Properties L.L.e., said application requesting to amend tbe official zoning map of the
City of South Miami by changing tbe zoning use district for property legally described as Lots I through
25, Block 15, Larkins Townsite Subdivision, said site being bounded on tbe south by S.w .. 70th Street, on
the east by S.W. 59th Place, on tbe north by S.W. 69 th Street, and on tbe west by S.W. 61" Avenue from
"MO" Medium-Intensity Office Use District to "TODD (MU-5)", Transit Oriented Development
District (Mixed-Use 5) Use District.; and
WHEREAS, the purpose of the change of zoning is to pennit the construction of a six
story residential apartment building with 294 dwelling units and 6,812 square feet of commercial
space; and
WHEREAS, tbe proposed rezoning is consistent witb ·the Amended Future Land Use Map of tbe
City of South Miami Comprehensive Plan; and .
WHEREAS, after review and consideration, tbe Planning and Zoning Department recommended
approval of the application witb conditions; and
WHEREAS, on August 28, 200 I, after Public Hearing regarding the proposed rezoning
application, the Planning Board recommended approval witb conditions by a vote of (5-0); and
WHEREAS, the City Commission desires to accept tbe reco)TllUendation of tbe Planning Board
and enact tbe aforesaid amendment.
NOW, THEREFORE, BE IT ORDAINED BY TIlE MAYOR AND THE CITY COMMISSION

Section 1 . That tbe City's Official Zoning Map shall be amended by changing tbe zoning on

said site being bounded on tbe soutb by S.W .. 70'" Street, on the east by S.W. 59th Place, on the north by
S.W. 69 th Street, and on tbe west by S.w. 61" Avenue from "MO" Medium-Intensity Office Use District

be subject to the conditions specified in Section 2 of tbis ordinance.

(I) The proposed development shall be as shown on the Site Plan submitted to the City on
September 28, 2001, as may be modified by revisions required by conditions set forth in this
section;
(2) Applicant shall submit a mitigation plan for tree removal and canopy replacement as set forth
in the Land Development Code;
(3) Applicant to submit a Unity of Title document as required by LDC Section 20-8.16;
(4) Applicant shall provide a minimum three-foot buffer between the garage (north side) and the
sidewalk;
(5) The entrance to the parking garage to be relocated to a position approximately midway
between SW 59 th Place and the driveway entrance to the Lee Park condominiums, in order to
insure pedestrian safety and adequate traffic flow. Said location of garage entrance to be
shown on the revised Site Plan as submitted to the City on September 28, 2001;
(6) Storefront delivery I service, to comply with City ordinances.
(7) To the extent economically feasible, the Applicant to redesign the proposed streetscape
elements in order to conform to the City'S street tree requirements and the Community
Redevelopment Area Streetscape Plans for the area, as follows;

• Along SW 59th Place, SW 69 th Street, and SW 61" Avenue, the triangular "bulbouts"
containing street trees shall be squared off or rounded, and either redesigned to
incorporate continuous curb and gullers; or, alternatively, a covenant must be executed by
the property owner to maintain in perpetuity the guller area between the existing curbing
and the self-contained landscape islands.
• For the portion of70'" Street between SW 61" Avenue and the building entrance, the
above referenced plan for bulbout landscape islands shall be incorporated, thus providing
additional on-street parking and the required street trees.
• For the portion of 70 th Street between the building entrance and SW 59 th Place, the
sidewalk shall be widened to provide eight (8) feet of sidewalk, said sidewalk to
incorporate street trees in tree grates, thereby providing the street trees required by the
Land Development Code while allowing a minimum five (5) foot unobstructed pedestrian
passageway as required by the Americans with Disabilities Act (ADA).
Section 3 The change of zoning adopted by this ordinance shall be reflected on all Regulating
Plan Graphic illustrations contained in Section 20-8.17 of the Land Development Code.
Section 4 If any section, clause, sentence, or phrase of this ordinance is for any reason held
invalid or unconstitutional by a court of competent jurisdiction, this hol<ling shall not affect the validity of
the remaining portions of this ordinance.

Section 5 All ordinances or parts of ordinances in conflict with the provisions of this ordinance
are hereby repealed.
Section 6 This ordinance shall be effective on the date when the Comprehensive Plan Future
Land Use Map amendment application for the same property is effective.
