Dixie Highway. BACKGROUND: Located in the General Retail "GR" zoning district, the applicant is proposing to redevelop the entire irregular shaped site located at 6144 S. Dixie Highway which currently has an existing one-story building that is occupied by a furniture store. As part of the revitalization, the applicant is proposing to demolish the existing one-story building and construct two (2) new separate one-story structures . One structure is for retail space and the other structure is for restaurant space . The applicant has requested a variance to waive three (3) off-street parking spaces for the site, reducing the required amount of off-street parking spaces from 27 to 24 . Dixie Highway March 15, 2016 Page 2 of 3 REQUEST: After reviewing the variance request for compliance with the Land Development Code (LDC), Comprehensive Plan and Future Land Use Map, the applicant is requesting the following: 1. Variance of off-street parking space requirements to permit 24 off-street parking spaces where 27 are required via Section 20-S.9(H), LDC 2. Improvement of the right-of-way adjacent to the subject property for credit as on-street parking spaces via Section 20-4.4(A)(2), LDC 3. Payment into the City of South Miami Parking Fund via Section 20-4.4(A)(3), LDC ANALYSIS: Pursuant to the Variance approvals, Section 20-S.9 of the LDC, a variance for off-street parking can be reviewed and permitted by the city commission at a public hearing, after a recommendation by the planning board. When reviewing the project, the following items are noted about the project: • The space is currently occupied by a furniture store. • Once redeveloped, the proposed redevelopment will consist of the following square footages: o Retail Use: 3,S10 square feet o Restaurant Use: 1,SOO square feet • Pursuant to Section 20-4.4(B)(11) of the LDC, the parking condition for retail use is generally one (1) parking space per three hundred (300) square feet of gross floor area • Pursuant to Section 20-4.4(B)(7) of the LDC, the parking condition for general restaurant use is one (1) parking space per one hundred (100) square feet of gross floor area PARKING ANALYSIS As shown on the attached site plan, the applicant is proposing a complete redevelopment of the site. Pursuant to the information listed above, the retail component of the redevelopment will require a total of twelve (12) parking spaces, whereas the general restaurant component will require fifteen (lS) for a total of twenty-seven (27) parking spaces required for the project. After review of the attached site plan, it is shown that the applicant will be providing a total of twenty-two (22) parking spaces on the site. It is important to note that as shown on the attached Revised Plat for Larkin Pines as well as the Sketch of Boundary Survey, the area to the south of the subject property has been reserved for parking and beautification which is considered public right-of-way. The applicant is proposing to redevelop this area as well, adding both landscaping and two (2) additional parking spaces. If approved, the applicant would have to comply with the regulations listed in Section 20-4.4(A)(2) of the LDC which is as follows: Unimproved rights-oj-way adjacent to business property in commercial zoning districts may be improved by the abutting property owner Jor credit as on-street Variance -6144 S. Dixie Highway March 15, 2016 Page 3 of 3 parking spaces by written agreement approved by the application to the City Manager provided that the property owner complies with subsection 20- 4.4(A}{3}. The City Manager upon the advice of the Parking Board, will determine if the installation of parking meters is warranted and appropriate for the area. Furthermore, pursuant to Section 20-4.4(A)(3) of the Land Development Code, An annual fee of one thousand dollars ($1,000.00), per space, which shall increase five (5) percent annually, shall be paid into the Parking Fund for all on- street parking spaces which are credited or counted toward required parking for new structures, or a change in use that increases the minimum number of off- street spaces required after the date of January 2, 2008. Once redeveloped, the applicant will be providing a total of twenty-four (24) off-street parking spaces for the project. In order to meet the minimum requirement of twenty-seven (27) off- street parking spaces for the project, the applicant is requesting a variance to waive three (3) off-street parking spaces. Because the applicant's project will affect the public right-of-way, the proposed commercial redevelopment was reviewed by the Public Works Department. As referenced in the attached emails, Public Works is in agreement with the proposed configuration of the alley in that it will be safer for the users. Furthermore, Public Works has requested that a tree covenant be put in place that will cover all of the landscape improvements that are proposed within the right-of- way. Last the Public Works department is requiring that the applicant make sure that the locations of the proposed plantings do not conflict with any existing utilities. VARIANCE ApPROVAL Pursuant to Section 20-S.9(H) of the Land Development Code, all variance decisions shall be based on an affirmative finding as to each of the following criterion: 1. The variance is necessary to relieve particular extroordinary conditions relating to a specific property; Due to the size and configuration of the subject property, a variance would be necessary to accommodate the minimum amount of off-street parking spaces required to redevelop commercial square footage that is comparable to the amount currently developed on the property (approximately 6,434 S.F.). 2. Denial of the variance would result in hardship to the owner. Hardship results if the restriction of the zoning ordinance, when applied to a particular property, becomes arbitrary, confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; Variance -6144 S. Dixie Highway March 15, 2016 Page 4 of 3 Due to the irregular shape of the subject property, denial of the variance would limit the redevelopment capability of the site and make it more restrictive than other properties in the G R district. 3. The extraordinary conditions and circumstances do not result fram the actions of the applicant; The shape or size of the lot has not been reduced or modified by the applicant. The current shape of the lot is how it was originally platted. 4. The requested variance is the minimum variance necessary to make possible the reasonable use of the land, building or structure; While there isn't a maximum requirement for building coverage for the "GR" zoning district, the district does have a maximum impervious coverage which is 85% of the lot. Based on the size of the subject lot, the maximum amount of impervious coverage allowed for the site would be approximately 13,136 square feet. Because the applicant is proposing to pave 13,059 square feet (84.5%), there would be no additional area available to add the parking spaces that are deficient. Furthermore, the applicant is proposing the best use of the irregularly shaped lot. 5. That the approval of the variance will be consistent with the generol intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Because the area surrounding the subject property is populated with commercial type uses followed by residential districts further to the east, a buffer between the subject property and the residential properties has been created. Because of this, a variance for three (3) parking spaces would not be injurious to the neighborhood or detrimental to the public welfare of the community. PLANNING BOARD ACTION: At the November 10, 2015 public hearing the Planning Board recommended approval of the Variance with a vote of 5 to 0. STAFF RECOMMENDATION: Staff recommends approval for the Variance application to reduce the minimum off-street parking requirement from 27 to 24 parking spaces for the proposed commercial redevelopment located at 6144 S. Dixie Highway. This approval is subject to the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations: 1. Pursuant to Section 20-4.4(A}(2} of the Land Development Code, the applicant shall enter into a parking space agreement with the City for the two (2) proposed parking spaces that will be located in the public right-of-way. Because the area surrounding the subject property is within the GR zoning district, the variance would not be injurious to the neighborhood or detrimental to the public welfare of the community. 11 WHEREAS, the approval of a variance requires a recommendation from the Planning 12 Board and the approval of the City Commission after a public hearing; and 13 14 WHEREAS, at the November 10, 20 IS Planning Board meeting, and following a public 15 hearing, the Board reviewed application PB-15-030 and voted 5 ayes, 0 nays to recommend 16 approval of the request for a variance to reduce the required number of parking spaces from 27 to 17 24 for the proposed commercial redevelopment; and 18 19 WHEREAS, the City Commission desires to accept the recommendation of the Planning 20 Board and approve the Variance. 21 22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 23 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 24 25 Section 1: The recitals set forth in this resolution have been found to be supported by 26 competent substantial evidence and they are incorporated into this resolution by reference. 27 28 Section 2: Variance Application (PB-15-030) submitted by applicant Manaca South 29 Miami Center LLC, requesting a variance of Section 20-4.4(B)(1I) of the Land Development 30 Code to reduce the required number of required parking spaces from 27 to 24 for a proposed 31 commercial redevelopment located at 6144 South Dixie Highway in the General Retail (GR) 32 zoning district is hereby approved. Dr. Philips asked how the rear parking spaces would be accessed, if there is no entrance, only an exit Mr. Proctor responded that the spaces would be accessed through the alleyway. Dr. Dr. Philips asked how employee parking would be managed. Mr. Proctor explained how the parking space ratio for restaurant uses in the GR zoning district work and how it will manage parking spaces for workers of the restaurant Mr. Basu stated that the correct parking space ratio for restaurant uses for the record. He then stated that the city's parking is an issue because the city uses suburban parking requirements in an urban setting. The issue needs to be addressed. Mr. Greiner stated that he was in agreement with Mr. Basu in that the parking issue should be addressed. 3 Ms. Fischer asked the applicant ',f there were available on-street parking spaces. Mr. Sm',th responded yes but there wasn't a large amount available. Mr. Held asked when the special use extension for the item would be discussed. Mr. Proctor responded that he has every intention of raising the issue with the City Commission because they are the only body that can rule on that request. Mr. Held stated that the extension should be made a part of the request so that the Planning Board can hear it and make a recommendation to the City Commission. Mr. Proctor added that he doesn't anticipate the project commencing until at least a year from commission approval. Mr. Greiner responded that when the City Commission looks at an extension request, they are considering other factors that could affect the project such as progress of the project. The Chairperson opened the floor to public comments on PB-1S-029 and PB-1S-030. None at this time The Chairperson closed the floor to public comments on PB-1S-029 and PB-1S-030. We discussed the option of utilizing the existing alley as the neighbor is doing to accommodate some parking spaces and the location for the dumpster for garbage pickup. PW believes that to improve the safety of the alley it should be reconfigured so traffic will only enter from the east and west sides and exit to the south. We presented this alternative as an idea. The applicant shall be responsible in gather all the required information and if needed the consent from the neighbors. Redevelopment, as designed on the attached plans, will consist of a one-story restaurant building of approximately 1,500 square feet in size, with patron area of approximately 1,100 square feet, and a one-story retail building of approximately 3,500 square feet in size. Redevelopment with enhanced off-street parking and landscaping will bring the Property into greater compliance with modern City regulations. The restaurant building will be located adjacent to South Dixie Highway, and the retail building will be located to the South, closer to S.W. 61st Avenue. 18 of the 24 parking spaces provided will be located along the South Dixie Highway frontage of the Property, thereby continuing the orientation of the traffic impacts of the Development toward South Dixie Highway. There will be four additional parking spaces located to the south, adjacent to the public alley and the area further south, where two additional parking spaces will be developed by the Applicant. This additional parking is located in an area that is designated for "parking and beautification" on the plat governing development of the Property. A copy of the plat entitled "Larkin Pines" recorded in Official Records Book 53, at Page 41, is attached. The Applicant makes the following specific requests in conjunction with the Application: . 1. Special Use Approval for a general restaurant, including beer/wine service and outdoor dining; and 2. Variance of parking requirements to permit 24 off-street parking spaces (27 spaces required). The request for a restaurant complies with the standards in the "GR" zoning district, which allows a broad range of retail uses, including restaurants. The development of a restaurant on the Property will comply with City's prescribed standards for "special use" approval in that a restaurant will not adversely affect the health and safety of persons residing or working in the area and will not be detrimental to the public welfare. The variances of off-street parking requirements IS substantiated by the following facts: 1. The variance is necessary to relive particular extraordinary conditions relating to a specific property. The size and configuration of the Property result in variances to redevelop commercial square footage that is comparable to the amount currently developed on the Property. Denial ofthe variance would result in hardship to the Owner. The shape of the Property, with a narrow width of about 65 feet in the center of the Property, distinguish the Property and limit the Property's redevelopment capability in a manner that is more restrictive than other properties in the GR District. 3. Extraordinary conditions and circumstances do not resolve from the actions of the Applicant. The Applicant has not reduced or otherwise altered the size or shape of the Property since purchasing the Property in 2013. 4. The requested variance is the mmunum variances necessary to make possible the reasonable use of the land, building or structure. The Land Development Code offers unreasonable restrictions on restaurants by (1) requiring more parking in the GR District for restaurants than required in the Hometown District. 5. Approval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. The area surrounding the Property is non-residential, and the right-of-way areas include additional parking spaces available to visitors to the Property. The application complies with Future Land Use Objective 1.1 by bringing the Property into compliance with the purposes of the current Land Development Code in.the following ways: (a) The development is a Mixed-Use development that complies with modern goals and objectives; and (b) The development dramatically expands the amount of landscaping and open space on the Property. Section 20.S.8(c) of the Land Development Code provides that an approved special use shall lapse after 6 months if no master building permit has been issued. By virtue of this application and ,the ability of the City Commission vested in the Land Development Code to extend the approval period, please accept this request to extend this time frame to one (1) year after City Commission approval. There are existing leases governing use of the Property that will delay re-development. In addition, the building permit process, particularly at certain Miami-Dade County agencies, is lengthy and cumbersome.
