No. 076-98-10343RESOLUTION NO.76-98-103"43 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING PERSONNEL; ACCEPTING AN OMBUDSMAN PROPOSAL AND DIRECTING IMPLEMENTING AN OMBUDSMAN PROGRAM FOR THE SOUTH MIAMI POLICE DEPARTMENT;APPROVING AN EXPENDITURE IN THE AMOUNT OF $2,250.00 AND CHARGING THE AMOUNT TO ACCOUNT NO001-1100-511-345Q PROVIDING AN EFFECTIVE DATE. WHEREAS,the Mayor andCity Commission of the City of South Miami desire to createan Ombudsman program toaddresspersonnel problems intheCity of South Miami Police Department by providing amethodtoreceive,evaluateandinvestigate complaints and issues raised about personnel,policies and procedures;and, WHEREAS,theOmbudsmanwillendeavortofacilitate improvement in communicationsbetweendepartmentalpersonnel,cityofficialsandgroupsaffectingthe efficient operation of the South Miami Police Department;and, WHEREAS,abenefittoberealizedbyeffectivelyimplementinganOmbudsman program,inreducingoreliminatingthecauses of recurringcomplaintsandtoimprovingjob satisfaction,isthe reduction ininternalaffairscomplaints,complaints filedwiththeEEOC andtheFloridaCommissiononHuman Relations,andcivilactionsfiledagainstthecity;and, WHEREAS,theMayorandCityCommissiondesiretoaccepttheOmbudsman proposal submitted by Mr.Steve Bertucelli. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.The Ombudsman proposalbyMr.Steve Bertucelli fortheSouthMiami PoliceDepartmentisapproved.Mr.Bertucelliwillcreateprotocolrelatingtomaintaining theconfidentiality,andthedisclosure,of informationreceivedfromemployeesinthecourse of actingasthe Ombudsman.A contract between theCityandMr.Bertucelli shallbe prepared and submitted totheCityCommissionforapproval.Mr.Bertucelli shallactasan independentcontractorunderthecontract,andnotasanemployeeoragent of theCity.A copy of Mr.Bertucelli's April2,1998proposalisannexedandmadeapart of this Resolution.
