A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE CITY OF
SOUTH MIAMI CODE OF ORDINANCES;CREATING A CODE
REVISION COMMISSION;PROVIDING AN EFFECTIVE DATE.
WHEREAS,the Mayor andCityCommission of theCity of SouthMiamirecognize
thatthe City of South Miami Code of Ordinances isin need of revision;and,
WHEREAS,an undertaking torevisethecodewill require a substantial amount of
time and effort;and,
WHEREAS,the Mayor and City Commission desire to establish a Code Revision
Commission to evaluate andto make specific recommendations for revision tothecode.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.TheCity of SouthMiamiCodeRevisionCommissionisherebycreated.
The commission shallconsist of sevenmembers,whoshallbe appointed bythe mayor with
theadviceand consent of thecitycommission.Thecity commission statesitsdesirethatthe
membership of thecommissionshallconsist of 3attorneyswhoarelicensedtopracticelaw
inthe State of Florida and who have expertise inthearea of municipal law.The mayor is
requested,inappointingmemberstothe commission,togivedueconsiderationtoselecting
membersbaseduponprinciples of ethnicandgenderinclusion,andleadershipand
professional capability.Thecity manager shall serveasa non-voting ex officio member of
the commission.
Section2.TheCity of SouthMiamiCodeRevisionCommissionshallbecharged
withtheresponsibilities of preparingaworkplanandscheduleforaccomplishingitswork
inaperiodnottoexceedsixmonths,unlessthattimeisextendedbythecitycommission;
studying andmaking recommendations tothecity commission regarding necessaryoruseful
revisionstothecode of ordinances;evaluatingtechnologyandcostfor data-basing thecode;
holding-public workshops upon approval bythecity commission;and,preparing drafts of the
recommended revisions to the code.

The commission shallnotaddressthe city's comprehensive planandland
development regulations,norshallitbe concerned withtheformand structure of thecity
government.
Thecity manager willprovidefor staff andlogisticsupport.Supportmayinclude,but
notbe limited to,scanning thecodeintothe city's computer system in Word formatand
publishing the amended code,asfinallyadopted.The Municipal Code Coiporation maybe
engaged to review thecodefor non-compliance withstatelaws.Thecity attorney shallbe
responsibleforreviewingproposedrevisionstothecodeforlegalsufficiency.Thecityclerk
will provide support in research,retrieving and indexing resolutions and ordinances.The
city manager may present a budget tothecity commission which will include the anticipated
cost of logistic,review bythe Municipal Code Corporation,andthe cost of data-basing the
revised code onthe city's computer system.
Section 3.This resolution shalltake effect immediately upon approval.
