A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE CITY OF
SOUTH MIAMI CHARTER;CREATING A CHARTER REVISION
COMMISSION;PROVIDING AN EFFECTIVE DATE.
WHEREAS,the Mayor andCityCommission of theCity of South Miami recognize
that the City of South Miami Charter isin need of revision;and,
WHEREAS,an undertaking to revise the charter skill,judgment,wisdom and
substantial commitment by volunteers;and,
WHEREAS,the Mayor andCity Commission desireto establish a Charter Revision
Commission to evaluate and to make specific recommendations for revision tothe charter.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.TheCity of SouthMiami Charter Revision Commission is hereby
created.The commission shall consist of five members,whoshallbe appointed bythe
mayorwiththeadviceandconsent of thecitycommission.Thecity commission statesits
desirethatthemembership of thecommissionshallconsist of atleastoneattorneywhois
licensedtopracticelawintheState of Floridaandwhohasexpertiseinthearea of municipal
law.Themayorisrequested,inappointingmemberstothecommission,togivedue
considerationtoselectingmembersbaseduponprinciples of ethnicandgenderinclusion,and
leadership and professional capability.Thecitymanagershallserveasanon-votingex officio
member of the commission.
Section2.TheCity of SouthMiamiCharter Revision Commission shallbe
chargedwiththeresponsibilities of preparingaworkplanandscheduleforaccomplishing
itsworkinaperiodnottoexceedoneyear,unlessthattimeisextendedbythecity
commission;studyingandmakingrecommendationstothecity commission regarding
necessaryorusefulrevisionstothecharter;holdingpublicworkshopsuponapprovalbythe
citycommission;and,preparingdrafts of therecommendedrevisionstothecharter.
Section 3 The city manager will provide for staff and logistic support.Support
mayinclude,butnotbelimitedto,scanningthecharterintothe city's computer systemin

Word format and publishing theamended charter,as finally adoptedbythecitycommission
andby referendum.Thecityattorneyshallbe responsible forreviewingproposedrevisions
tothecharterforlegal sufficiency.Thecityclerkwillprovidesupportin research,retrieving
and indexing prior revisions tothe charter.The city manager may present a budget tothecity
commissionwhichwillincludetheanticipatedcost of logisticsupport,andothercostitems.
Section 4.Pursuant totherequirements of Section 166.031,FloridaStatutes,and
Section5.03,Miami-DadeCountyCharter,thecitycommissionshall,byordinance,submit
totheelectors of thecitytheproposedamendmentstothecharter.Theproposed
amendmentsshallbesubmittednotlessthan60days,normorethan 120 days,beforethe
next scheduled generalelection.Upontheapprovalbytheelectors of anyamendmentsto
thecharter,the amended charter shallbefiledwiththeFlorida Secretary of Stateandwith
the Circuit Court,in and for the Eleventh Judicial Circuit,Florida.
Section 5.This resolution shalltake effect immediately upon approval.
PASSED AND ADOPTED this 3rd day of March,1998.
