RESOLUTION NO.?8-Qft-10?q5 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE APPROVAL OF A SIMILAR USE,PURSUANT TO SECTION 20-3.3 (C)(5)OF THE LAND DEVELOPMENT CODE,ACCEPTING THE CITY MANAGER'S RECOMMENDATION THAT THE "ADULT DAY CARE CENTER"USE BE CLASSIFIED AS A USE THAT IS SIMILAR TO THE PERMITTED USE "DAY CARE CENTER (7 OR MORE CHILDREN)"ONLY;AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 20-3.3 (C)(5)of the Code states that: (5)New or unlisted uses of similar nature. (a)The director of ...Planning &Zoning ...shall consider the nature of the proposed use,its compatibility with other uses permitted in the various districts and determine the zoning district or districts within which the use should be permitted,if any. (b)The City Manager shall transmit the findings and recommendations of the Director of ...Planning &Zoning ...for the classification proposed for any new or unlisted use to the City Commission for review at its next regularly scheduled meeting. (c)The City Commission shall approve the recommendations of the Director or make such determination concerning the classification of the new or unlisted use as it determines appropriate. WHEREAS,no specific provision is presently made in the City's adopted Land Development Code for the proposed use of an "Adult Day Care Center;"and, WHEREAS,Section 20-3.3 (D)of the Land Development Code provides for "Day Care Center (7 or more children)"asa permitted use under the Public and Institutional Uses inthe Permitted Use Schedule;and, WHEREAS,the Director has received a letter and forwarded a report to the City Manager which recommends that the proposed use "Adult Day Care"Similar UseResolution:February 3,1998 of an "Adult Day Care Center"be classified asa "Day Care Center (7 or more children)"for the sole purpose of permitting the location in the appropriate zoning districts;and, WHEREAS,the City Manager has concurred that the use proposedasan "Adult DayCare Center"isanappropriateusein thezoningdistrictwhere"DayCareCenter (7 ormorechildren)" is currently permitted and,thereby,recommends inclusion ofthe usetothe Mayor and City Commission ofthe City of South Miami. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.The proposed "Adult Day Care Center"use is hereby classified asause which is similar tothe permitted use, "Day Care Center (7or more children),"and is,therefore, permitted inthe zoning districts where "Day Care Center (7or more children)"is currently permitted with the same parking requirement which isone parking space for every 250 square feet of gross floor area. Section 2.The City Manager shall have final approval and authority over all matters regarding the determination of the applicant's compliance with the intent of these sections. (a)If theagency determines thatanadultdaycare center isnot operated in compliance with thispartorwithrules adopted underthispart,theagency,notwithstanding any other administrative action ittakes,shallmakea reasonable attempt to discuss withthe owner each violation and recommended corrective action prior to providing the owner with written notification.Theagencymayrequestthesubmission of a corrective actionplanforthecenter which demonstrates agoodfaithefforttoremedyeach violation bya specific date,subject tothe approval of the agency. (b)The owner of a center orits operator or employee found in violation of this part or of rules adoptedunderthispartmaybefinedbytheagency.Afinemaynotexceed$500foreach violation.Inno event,however,may such finesinthe aggregate exceed $5,000. (c)Thefailureto correct a violation bythedatesetbythe agency,orthe failure to comply withanapprovedcorrectiveaction plan,isaseparate violation foreachdaysuchfailure continues,unlesstheagency approves an extension toa specific date. (d)Iftheowner of acenteroritsoperatororemployeeappealsanagencyactionunderthis section andthefineisupheld,the violator shallpaythe fine,plus interest atthelegalrate specifiedins.687.01foreachdaythatthefineremainsunpaidafterthedatesetbytheagency for payment of thefine. (2)Indeterminingwhethertoimposeafineandinfixingtheamount of any fine,theagency shall consider the following factors: (a)Thegravity of the violation,including the probability thatdeathorseriousphysical or emotionalharmtoaparticipantwillresultorhas resulted,theseverity of theactualor potential harm,andtheextenttowhichtheprovisions of theapplicablestatutesorruleswereviolated. (b)Actionstakenbytheowneroroperatortocorrectviolations. (c)Any previous violations. (d)The financial benefittothecenterof committing orcontinuingthe violation. Edition 400.557 Expiration of license:renewal:conditional license or permit. 400.557 Expiration of license;renewal;conditional licenseor permit.- (1)A license issued forthe operation ofan adult day care center,unless sooner suspended or revoked,expires 2 years afterthedateof issuance.The agency shall notify a licensee by certified mail,return receipt requested,at least 120 days before the expiration datethat license renewal is required to continue operation.At least 90 days prior to the expiration date,an application for renewal mustbe submitted tothe agency.A license shallbe renewed,uponthefiling of an application on forms furnished by the agency,if the applicant has first met the requirements of thispartandofthe rules adopted under this part.The applicant must filewiththe application satisfactory proofof financial abilityto operate thecenterin accordance withthe requirements of thispartandinaccordancewiththeneedsoftheparticipantstobeserved. (2)A licensee againstwhoma revocation or suspension proceeding is pending atthetimefor license renewal may be issued a conditional license effective until final disposition by the agency ofthe proceeding.Ifjudicialreliefissought from the final disposition,thecourt having 1 jurisdiction mayissuea conditional permiteffectiveforthe duration of the judicial proceeding. (3)The agency mayissuea conditional licensetoan applicant for license renewal or change of ownership if the applicant failstomeetallstandardsand requirements forlicensure.A conditional license issued under this subsection must be limited toa specific period not exceeding6months,asdeterminedbytheagency,andmustbeaccompaniedbyanapproved plan of correction. (2)Immediately upondiscontinuanceoftheoperation of acenter,theowneroroperatorshall surrenderthelicenseforthecentertotheagency,andthelicenseshallbecanceledbytheagency. (3)Ifacenterhasachange of ownership,thenewownershallapplytotheagencyforanew licenseatleast60daysbeforethedate of thechange of ownership. Edition 400.562 Rules establishing standards. 400.562 Rules establishing standards.— (1)The Department of Elderly Affairs,in conjunction withthe agency,shalladopt rules to implement the provisions ofthispart.Therulesmust include reasonable andfair standards.Any conflictbetweenthesestandardsandthosethatmaybesetforthinlocal,county,ormunicipal ordinancesshallberesolvedinfavor of thosehavingstatewideeffect.Suchstandardsmust relate to: (a)The maintenance ofadultday care centers with respect to plumbing,heating,lighting, i ventilation,andotherbuildingconditions,includingadequatemeetingspace,toensurethe health,safety,andcomfort of participants and protection fromfirehazard.Suchstandardsmay not conflict withchapter 553 andmustbe based uponthesizeofthestructureandthe number of participants. (b)Thenumberand qualifications ofall personnel employed byadultdaycare centers who have responsibilities forthecare of participants. (c)Allsanitaryconditionswithinadultdaycarecentersandtheirsurroundings,including water supply,sewage disposal,food handling,and general hygiene,and maintenance of sanitary conditions,to ensure the health and comfort of participants. (d)Basic services provided by adult daycare centers. (e)Supportive and optional services providedbyadultdaycare centers. (f)Dataandinformationrelativeto participants andprograms of adultdaycarecenters, including,butnotlimitedto,the physical and mental capabilities andneedsofthe participants, the availability,frequency,and intensity of basic services andof supportive and optional services provided,the frequency of participation,the distances traveledby participants,thehoursof operation,thenumberofreferralstoothercentersor elsewhere,andtheincidence of illness. (2)Pursuant tos.119.07,the agency maychargeafeefor furnishing acopyofthispart,orof therulesadoptedunderthispart,toanypersonuponrequestforthecopy. (3)Pursuanttorulesadoptedbythe department,theagencymayconductan abbreviated biennial inspection ofkey quality-of-care standards,inlieuofa full inspection,of acenterthat hasarecord of goodperformance.However,theagencymustconductafullinspection of a centerthathashadoneormoreconfirmedcomplaintswithinthelicensureperiodimmediately preceding theinspectionorwhichhasaserious problem identifiedduringthe abbreviated inspection.Theagencyshalldevelopthekey quality-of-care standards,takinginto consideration thecommentsandrecommendations of the Department of ElderlyAffairsand of provider groups.These standards shallbe included inrules adopted bythe Department of Elderly Affairs.
