No. 025-98-102921 RESOLUTION NO.25-98-10292 2 3A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE 4 CITY OF SOUTH MIAMI,FLORIDA,RELATING TO BOARDS; 5 CREATING THE CITY OF SOUTH MIAMI GRANT ADVISORY BOARD; 6 PROVIDING ORGANIZATION,DUTIES AND RESPONSIBILITIES; 7 PROVIDING AN EFFECTIVE DATE. 8 9WHEREAS,theMayorandCityCommission of theCity of SouthMiami find that 10 itisinthepublicinteresttomakes grants of public funds,fromtimetotime,toprivatenon- 11 profit organizations to further identifiable public purposes;and, 12 13WHEREAS,thecitycommissionadoptedguidelines,byResolutionNo.66-97- 14 10266,tobeutilizedbyagrant advisory boardin evaluating grant proposals andinmaking 15 recommendations tothecitycommission;and, 16 17 WHEREAS,theMayorandCity Commission desiretocreatetheCity of South 18 Miami Grant Advisory Board,to provide forits organization,dutiesand responsibilities. 19 20 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY 21 COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: 22 23Section1.TheCity of SouthMiami Grants Advisory Boardiscreatedas follows: 24 25(a)Composition.Theboardshallconsistof5 members. 26 27(b)Appointment and terms of members.Members ofthe board shall be appointed by 28the Mayor,as provided inthe City Charter.Members oftheboard shall be permanent 29residentsor employed inbusinessesintheCity. 30 31 (c)Terms of office.In order thatthe terms of office ofall members ofthe board 32shallnotexpireatthesametime,theinitial appointments totheboardshallbeas 33follows:3members of theboardshallbeappointedforaterm of twoyearsfromdate 34 of itsfirstmeetingand2 members shallbe appointed totheboardforaterm of three Page 1 of3 1 years.Appointed membersshall thereafter serveforaperiod of 2yearsoruntiltheir 2 successor is appointed,whichever occurslater. 3 4(d)Chairperson and vice-chairperson.The chairperson andvice-chairpersonshall 5beelected by the members of theboardforaterm of oneyear.Appointments tofill 6anyvacancyontheboardshallbefortheremainder of the unexpired terms.When 7any member of theboardfailstoattendthree consecutive meetings without an 8 excused absence,he or she shall be removed by the city commission.An "excused 9absence"shall be defined asanabsence resulting duetoa personal or family illness, 10deathinthefamily,beingout of townbecause of business,professional,orother 11 commitments subjecttotheapproval of thechairperson. 12 13 (e)Organization of the board.Members of the board shall electsuchofficers,in 14additiontothe chairperson anda vice-chairperson,asmaybedeemednecessary.Two 15 members shall constitute aquorumnecessarytoholda meeting andtakeanyaction. 16 Members shallserve without compensation or expense.Regular andspecial 17meetings oftheboardshallbe scheduled,andnotice of suchmeetings shall begiven, 18 asprovidedintheCity of SouthMiamiCode of Ordinances for meetings of the city 19 commission.Minutes shallbe kept by city staff of all meetings. 20 21 (f)Duties and responsibilities ofthe board.The duties and responsibilities of the 22 board shall include the following: 23 24 (1)Toserveinan advisory capacity,andmake recommendations,tothe 25 city commission regarding applicationsfor grants; 26 27 (2)To determine whether an applicant isa Florida not-for-profit 28 corporation currentlyingoodstandingwiththeSecretary of State, 29 Division of Corporations,andanIRC§501(C)(3)orother federal tax- 30 exempt organization; 31 32 (3)Todeterminewhetheran applicant has demonstrated character and 33 abilitytoadministerpublic funds toaccomplishapublicpurpose,and 34 hasan established accounting system to document the administration 35 grantfunds; Page2 of3 1 2 (4)Toevaluatetheapplicationforgrant funds inlight of thepublicpurpose 3 of the proposal,benefit tothe public,ability to document the 4 accomplishment of programobjectives,deliverables,expectedduration 5 of the program andabilitytoachievefunding self-sufficiency;and, 6 7 (5)Toapplythe grant-giving guidelines toeach application andto 8 recommend amendments tothe guidelines. 9 10(g)City manager toactas city commission liaison and to provide support.The 11 City Manager shallactasthecity commission's liaisontotheboard.TheCity 12 Managershallprovide staff supporttoassisttheboardin accomplishing its 13 duties and responsibilities. 14 15 Section2.If anysection,clause,sentence,orphrase of thisresolutionisforany 16 reasonheld invalid or unconstitutional byacourt of competent jurisdiction,the holding shall 17notaffectthe validity of the remaining portions of this resolution. 18 19 Section3.Allresolutionsorpartsofordinancesinconflictwiththeprovisions of 20this resolution are hereby repealed. 21 22 Section 4.This resolution shalltake effect immediately upon approval. 23 ~ 24 PASSED AND ADOPTED this 20th day of January,199 25 26 ATTEST: 27 r[MgZ£) 28 CITY CLERK 29 30 READ AND APPROVED AS TO FORM: 31 32 33 ^eiTY ATTORNEY 34 35 \\DELL_6100\Data\EGallop\Csmord-res\Grant advisory board-res.doc Page 3 of3
