A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,AUTHORIZING
EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF
SOUTH MIAMI AND MIAMI-DADE COUNTY,THROUGH ITS SAFE
NEIGHBORHOOD PARKS OFFICE SUBSTANTIALLY IN THE
FORM OF THE AGREEMENT ATTACHED HERETO AS EXHIBIT A
DESIGNATING THE CITY MANAGER AS THE CITY'S
REPRESENTATIVE AND AUTHORIZING AND APPROVING
RECEIPT OF $59,500.00 IN PROCEEDS OF THE SAFE
NEIGHBORHOOD PARKS BOND PROJECT AND APPROVING USE
OF THE BOND PROCEEDS TO BE USED TO PAY CERTAIN COST
RELATED TO THE DESIGN OF A FACILITY KNOWN AS THE
"MULTIPURPOSE CENTER"TO BE LOCATED AT MURRAY PARK
SITUATED AT 6700 S.W.58TH PLACE.
WHEREAS,thecitizens of MetropolitanDadeCountyhaveauthorizedthe
issuance of general obligation bonds(the tcBonds")forthepurpose of financing capital
improvement programs for certain parks,beaches,natural areas and recreation facilities;
and
WHEREAS,to implement andgive effect tothebond program,Metropolitan
Dade County,Florida enacted Ordinance 96-115,theSafe Neighborhood Parks Ordinance
(the"Ordinance");and
WHEREAS,itis necessary and desirable to improve the quality of life,to benefit
property values,to promote prevention of juvenile crime by providing positive recreation
opportunities,andto improve the recreation facilities for youth,adult,and senior citizens
inthis community throughthe improvement of ourparksandnaturalareas;and
WHEREAS,inordertofosterthoseimportantvalues,theprojectsmore
specifically listed below have been identified for reimbursement pursuant tothe terms of
the Ordinance;and
WHEREAS,pursuant tothetermsofthe Ordinance,the passage ofthis resolution
andtheacts contemplated bythis resolution are conditions to obtaining agrant;and
WHEREAS,theCity of SouthMiamiwishestoratifytheapplicationforthegrant
monies fortheprojectlistedbelowsubjecttoalltermsandconditions of the Ordinance;
and
WHEREAS,theCity of SouthMiamiauthorizesthe acceptance of thefunds
awardedpursuanttotheapplicationandtofurtherevidenceacceptancethereforeby.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.TheCity of SouthMiamiherebyratifiestheapplicationforagrant
tofundcertaincostrelatedtothedesign of theprojectandintheamountlistedbelow,and
inconnectionwithsuchapplicationtoexecutesuchgrantagreementandothercontracts
anddocuments,toexpendSafeNeighborhoodParksbondfundsreceivedforthepurpose
describedinthefundingrequest,toexecuteanynecessaryamendmentstothegrant
application andcontracts,andtakesuchotheractsasmaybenecessarytobindtheCity of
SouthMiamiandaccomplishtheintent of thisresolution.Applicationhasbeenmadeand
tentatively approvedwithrespecttoeach of the following project(the <cProjects")inthe
amount set forth below.

Section 2.City of South Miami shallcompleteeach of theProjectsin
accordancewiththeterms of thegrantagreement,theOrdinance,andtheadministrative
rulesauthorizedbythe Citizens'OversightCommittee(the"Committee")toimplement
theOrdinance.If thetotalcost of aProjectexceedsthevalueallocatedinthegrant,then
theCity of South Miami will provideany supplemental fundsrequiredtocompletethe
Project.Intheeventthat supplemental funds are necessary for completion ofaProject,as
of thepointintimethatitisknownthat supplemental fundsareneeded,theCity of South
Miamiwilldemonstratethatsuchsupplementalfundshavebeencommittedtothe Project
priortoandasa condition of disbursement or further disbursement of grant funds.The
requirement fortheCity of South Miami toprovideany supplemental funds required to
complete theProject may,atthesole discretion of the Committee,be modified inwholeor
inpartbyareductioninscope of workconsistentwiththe Ordinance.
Section 3.TheCity of SouthMiamirecognizesanddirectsthatanybeach,
park,orotherpublic facility acquired,developed,rehabilitatedorrestoredwithbond
funds,includingtheProjects,shallbeopenandaccessibletothepublicwithout
discriminationastorace,color,gender,age,religion,belief,residence,natural origin,
marital status or disability.
Section4.Tothe extent allowedbylaw,theCity of South Miamishallcommit
anyandallfundswhichmayberequiredtooperate,maintainandprovideprogrammingat
eachpark project upon itscompletion.

Section 5.NosubstitutionincapitalprojectfundingbytheCity of South
Miamishalloccurasaresult of thegrantforwhichtheCity of SouthMiamihasapplied
and has been awarded.
Section 6.Thisresolutionshalltakeeffectimmediatelyuponapproval.
