WHEREAS, there have been several strikes of governmental sanitary workers wit hin Dade County in recent days, and WHEREAS, a strike of the City's sanitary workers would necessitate emergency measures for the collection of garbage; NOW THEREFORE , BE IT ORDAINED BY THE MAYOR An CITY COUNCIL' OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That Ordinance 10 -70 -686 be and is hereby amended b'- adding thereto as Section 7 (A -1) 'the following "SECTION 7. EXTENT OF 'SERVICE AND POINTS "6F CO LECTION. (A) x (A- 1)"Emer encY- Conditions: Whenever strike, natural ca lam ity, "or other emergency "shall occur, the City.'Manager may invoke the following emergency cond'it'ions for a periof of 30 days by written notice mailed to all domestic garbage customers: 'Domestac'jGarbage. Garbage containers are hereby re hired to be placed at the front `:. q p _property Tine or curb on the day of sche'd'uled collection. Such contners'' -shall be removed from public view with- in 24 hours after the scheduled collection day. Conta 'iners may be placed at locations other than stated above with'the approval of the City Manager. Those contbiners and locations not approved will not be picked up. Containers in approved locations will be emptied at least twice each week.' Such emergency conditions may be extended`there- after only with approval of a majority of the City Council by resolution duly passed." Section 2. If any section, sentence, clause, phrase, or word of this ordinance is for any 'reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this-ordinance;-and it shall be construed to have been the intent of the Council of the City of South Miami to °pass this ordinance without such unconsti- tutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the exclusion "of such part or parts shall be deemed and held to be valid as if such ' parrts had not been in- c luded `''there iii, Section 3. That any person, persons, firm, partnership or corporation violating any of the - provisions hereof shall, upon conviction, be punished by a fine not to exceed $500;00, or by imprisonment not to exceed six month`s, or by both such fine and imprisonment in the d scretion`of the Municipal Judge. Each day a violation is permitted to exist shall constitute a separate offense. Section 4. This ordinance "shall take effect immediately upon passage. Section 5. It is intended that this Ordinance be permanent in nature and shall be included in the Code of Ordinances, City of South Miami, Florida. Section 6. That because of the emergency necessitating passage of this Ordinance reading at a second meeting is hereby dispensed with. PASSED and ADOPTED this 6th day of'October, 1970.
