RESOLUTION NO.061-16-14616 A Resolution for special use approval to permit a law office at 6001 SW 70 Street,Unit CU-101. WHEREAS,even though a law office useis permitted by right inthe Transit Oriented Development District Mixed Use-5 "TODD MU-5"zoning district,the original site plan approved via Ordinance #24-01-1755 prohibited thisandany other office or personal services type uses from occupying the ground floor of the Valencia Condominium building;and WHEREAS,dueto vacancies inthe ground floor commercial area,the City Commission passed and adopted Ordinance #06-10-2031 on February 2,20105 amending the Site Plan (Section 1,Condition 1)forthe Valencia Building (aka Shoal Creek Properties),as submitted to the City on September 28,2001,in order to show that in addition to retail uses,office,business and personal services asset forth intheLDC Permitted Use Schedule forthe TODD MU-5 zoningdistrictshallbe permitted inthe commercial space of the project,provided thateach office,businessand personal servicesuseisapprovedbytheSpecialUse permit processsetforth in Section 20-5.8;and WHEREAS,pursuant to Ordinance #06-10-2031,Jonathan David,the applicant,is requesting review and approval undertheSpecialUsepermit process setforthinSection20-5.8 of the Land Development Code; WHEREAS,theapproval of aspecialuserequiresa recommendation fromthePlanning Boardandtheapproval of theCityCommissionafterapublichearing;and WHEREAS,attheFebruary 17,2016PlanningBoardmeeting,andfollowingapublic hearing,theBoardreviewedapplication PB-16-003 andvoted6ayes,0naystorecommend approval of therequestforaspecialusetooperatealawoffice;and WHEREAS,theCityCommissiondesirestoaccepttherecommendationofthePlanning Board. Parking Space Analysis Pursuant to the information provided,the minimum amount of parking spaces requiredfor the proposed law office isas follows: Law Office Parking Space Requirement 515 SrF-z 1 Parking Space 250Srft «2 Parking Spaces Basedon the calculations listed above,the proposed law office willbe required to provide a minimum of two(2)parkingspacesforwhich the applicanthasprovided documentation that states that they willbe assigned. Punning Board Action: At the February 17,2016 PlanningBoard meeting andfollowingapublic hearing,the Board voted 6-0 to recommend approval of SpecialUsePermitapplicationPB-16-003.
