A Resolution of the City of South Miami,Florida,Approving the Transit Service-Title VI
Program Plan,in accordance with Title VI of Civil Rights Act of 1964
WHEREAS,the City's Transit Service ("Transit Service")provides an important civil function by
offering fixed-route transit services allowing all members of the public to access jobs,essential
community services,shopping,medical appointments and other vital transit uses;and
WHEREAS,the Transit Service,asaSub recipient of ARRA pass-through funding,is required by
MDT to have an approved Title VI Program Plan ("Plan"),in accordance with Title VI of the CivilRights
Actof 1964,which prohibits discrimination on the basis of race,color,and national originin programs
and activities;and
WHEREAS,the Plan serves to ensure that users of the Transit Service are able to make anti
discrimination complaints and to have procedures inplacefor investigating,tracking and providingan
administrative remedy to these types of complaints;and
WHEREAS,the Planwillalso increase public awareness to the Transit Service,including those
persons withlimitedEnglish proficiency,byproviding access tovital documents inEnglish,Creoleand
Spanish languages;and
WHEREAS,the Mayor andCityCommissionof the City of South Miami,find the proposed Plan
tobein the best interest of the City,andan enhancement to the quality oflifeofallTransitService
users.
NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHECITYOF
SOUTH MIAMI,FLORIDA THAT:
Section 1:TheCity of South Miami,Florida,hereby approve the Somi Transit Service-Title VI
ProgramPlan (attached hereto as"Exhibit I"),inaccordancewithTitle VI of Civil Rights Actof1964,as
required for the City of South Miami.
Section 2.Severability.Ifany section clause,sentence,or phrase ofthis resolution isforany
reasonheld invalid or unconstitutional byacourtof competent jurisdiction,the holdingshallnotaffect
the validityof the remaining portions of this resolution.
Section3.EffectiveDate.Thisresolutionshallbecomeeffectiveimmediatelyuponadoptionby
vote of the City Commission.

accordance with TitleVIandgivespublic notice that it complies with TitleVI of
the CivilRights Act of 1964 andall related statutes.TitleVI provides that "No
person in the United States shall,on the ground of race,color,or national origin,
be excluded from participation in,be denied the benefits of,or be subjected to
discriminationunderanyprogramor activity receivingFederalfinancial
assistance."
The Plan also ensures that users of the Transit Service are able to make anti
discrimination complaints andhas procedures inplacefor investigating,tracking
and providing an administrative remedy to these types of complaints.
In complying with requirements of MiamiDade County and the Federal
Government,the execution of the TitleIVPlanis the first step to move forward
with the SoMi Trolley System.

Any person who believes she or he has been discriminated against on the basis of race,color,

Title VI Procedure
1.When a complaint is received by TheCity of SouthMiami,the Citywill review itto
determine if our office has jurisdiction.The complainant will receive a written acknowledge
ment within ten(30)days informing him/her whether the complaint willbe investigated by
ouroffice.Ifthe decision isnot to investigateasaTitleVI complaint,the notification shall
state thereason (s)forthedecision.
2.Ifa complaint is incomplete,additional information maybe requested,and the complainant
willbe provided thirty (30)business daysto submit the required information.Iftheinfor
mation is not received within the time requested,the casecan be administratively closed by
I TheCityofSouth Miami.A case canalsobe administratively closedifthe complainant holong
er wishes to pursue their case.
3.TheCityofSouthMiamiwill make everyefforttocomplete the investigation within sixty
(60)diays of receivingthe complaint Once the investigationis completed,a letter stating the

MINORITY REPRESENTATION ON COMMITTEES AND COUNCIL
TheCity of SouthMiami does not have any transit-related committees.If any such committee
is established in the future,thisPlanwillbe amended to depict minority representation on
such committee,andto describe the efforts madeto encourage participation of minorities on
such committee.
PROVIDING MEANINGFUL ACCESS TO LIMITED ENGLISH
PROFICIENT PERSONS
LEP referstopersonsforwhom English isnottheirprimarylanguageandwhohavea limited
abilitytoread,write,speakorunderstand English.It includes peoplewho reported totheUS
Census that theyspeak English lessthan very well,notwell,or not at all.
Inordertoensuremeaningfulaccesstoitsservicesandprograms,TheCity of SouthMiami
usestheinformationobtainedinaFour Factor Analysisto determine thespecificlanguage
services that areappropriate.ThisanalysishelpsTheCityof South Miamito determine ifit
communicates effectivelywith LEP personsandinforms language access planning.
LIMITED ENGLISH PROFICIENT(LEP)
FACTOR 4 -Resources and Costs for LEP Outreach
The Four Factor Analysis isan individualized assessment that considers:
1.The numberorproportionof LEP persons eligible to be servedorlikelytobe
encountered bythe any applicable transit related facilities;
2.Thefrequency with which LEP personscome into contact with the applicable
transit related facilities:
3.Thenatureandimportanceofthe applicable transitrelated facilities to people's
lives;and
4.The resources availabletoTheCity of SouthMiamifor LEP outreach,as wellas
the cost associated with that outreach.
Thefirst step intheanalysisisunderstandingtheproportion of LEP personswhomay
encounter the transit relatedfacilities,their literacyskillsinEnglishand their native language,
the location of their community andneighborhoodsand,moreimportantly,ifanyareun
deserved,asa result of alanguagebarrier.
Todothis,the City attemptedtoevaluatethelevelof English literacy and towhat degree
peopleinitsserviceareaspeakalanguageotherthan English andwhatthoselanguagesare.
