Res No 043-16-14598RESOLUTION NO:043-16-14598 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to dispose of the "surplus" items. WHEREAS,Section 2-4.7 titled "Surplus city-owned property"of the City of South Miami Codeof Ordinances states that all personal property owned by the Cityshall not besold unless and untilitis declared to be surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached list of personal property items be classified as "surplus"because said property serves no useful function for any activity or in any location within the City and should besold to the highest bidder by way ofa City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances;and WHEREAS,the attached listingof personal property represents current fitness equipment located at the Gibson-Bethel Community Center and such equipment willbe replaced with substitute equipment through a competitive solicitation and proposal evaluation process issued by the City at a later date;and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH MIAMI,FLORIDA; Section 1.The personal property described in the attached list of fitness equipment located at the Gibson-Bethel Community Center is deemed to be "surplus"at the commencement of the work for replacement of said equipment and City Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7 of the CityCode of Ordinances,including sale at public auction,or by granting of a credit in conjunction with the replaced with substitute equipment through a competitive solicitation and proposal evaluation process issued by the City. Section 2.Severability.Ifany section,clause,sentence,or phrase of this resolution is foranyreasonheld invalid or unconstitutional byacourtof competent jurisdiction,thisholding shall not affect the validityof the remaining portions of this resolution. Section 3. enactment. (a)Items of personal property ownedbythecity shall notbesoldunlessand until itis declared tobesurplus propertybyresolutionof the city commission. (b)Thecitycommissionshallnotconsider declaring any Hem of personal property tobesurplusunlessthecity manager has affirmatively recommended such action thereon. (c)Upon determination by resolution bythecitycommissionthatanitemofpersonalpropertyissurplus,thecity manager isherebyauthorizedtoselltothehighestbidderatpublicsaleor,ifapprovedbythe commission by resolution,atpublicauction,saiditemofpersonalpropertyafteradvertisingthedate,timeandplaceofsaid saleorauctiononcea week forthree(3)consecutive weeks inanewspaperofgeneral circulation inthecity. Thecitymanagershallhavethe righttoacceptorrejectanyorallbids.Inthe event thepersonalpropertyshall beofferedforsaleorauction,andnobidsshallbereceivedtherefor,itshallbe deemed thatsuchpropertyhas novalueandthecity manager inhisdiscretionmayorderit destroyed or otherwise disposed of. (d)This section shallnotapplyto stolen,abandoned or confiscated personalpropertywhichhas come into the city's possession.
