81R165232 B»*fJU»f9 PH fo 21 m:II136 h 1 ORDINANCE NO.14-81-1108 AN ORDINANCE OFTHE CITY OF SOUTH MIAMI,FLORIDA, ABANDONING AND VACATING A CERTAIN DESCRIBED UNIMPROVED RIGHT-OF-WAY LOCATED ON SOUTHWEST 60TH AVENUE BETWEEN SOUTHWEST 82ND STREET AND SOUTHWEST 83RD STREET,SOUTH MIAMI,FLORIDA,WHICHUNIMPROVEDRIGHT-OF-WAYISBORDERED ONTHEEASTBYLOTS15AND 16,BLOCK4,SEAVIEWPARK AMENDED,PLATBOOK 17,PAGE80,DADECOUNTY,FLORIDA,AND BORDEREDONTHEWESTBYTHE EAST^OFTHE SW%OFTHE NW% OF THE SE%OF SECTION 36-54-40,LESS THE SOUTH 355 FEET,LESS THEEAST25FEETTHEREOF,DADECOUNTY,FLORIDA,ANDWHICH UNIMPROVED RIGHT-OF-WAY IS FURTHER OUTLINED IN BLUE ON THAT CERTAIN SKETCHATTACHEDTOTHIS ORDINANCE,RETAINING CERTAINRIGHTSTHEREIN,ANDPROVIDINGWHENTHIS ORDINANCE SHALL TAKE EFFECT. WHEREAS,theCity has determined thatit is inthebest interest of the City that the unimproved right-of-way hereinafter described be abandoned and vacated;and WHEREAS,the City has no need for the unimproved right-of-way hereinafter abandonedandvacated;and WHEREAS,it would be to the interest of the general welfare of the citizens of the City of South Miami to abandon and vacate the unimproved right-of- way hereinafter referred to. NOW,THEREFORE,BEIT ORDAINED BY THEMAYORAND CITY COMMISSION OFTHE CITYOF SOUTH MIAMI,FLORIDA: Section 1.That all the land shown as "unimproved right-of-way",locat edon Southwest 60thAvenuebetween Southwest 82ndStreetand Southwest 83rdStreet in the City of South Miami,Florida,said unimproved right-of-way being 50 feet wide and 187 feet long moreor less,running north and south,which unimproved right-of- way is bordered ontheeastby Lots 15and 16,Block4,SeaviewPark Amended,Plat Book 17,Page 80,Dade County,Florida,and bordered on the westby the East h of the SW h oftheNW h oftheSE h ofSection36-54-40,lesstheSouth355feet,lessthe East 25feet thereof,Dade County,Florida,andwhich unimproved right-of-way is furtheroutlinedinblueonthatcertainsketchattachedtothisOrdinance,be,and thesameisherebyabandonedand vacated. Section 2.The City retains the right to maintain,install,operate, repair and replace by itself orby any licensee ora holder ofa franchise from the City any poles,wires,pipes,conduits,sewer mains,water mains,or any other facility or equipment for the maintenance or operation of any utility now located anywhere within the unimproved right-of-way or hereinafter located within 10 feet of the center line of the unimproved right-of-way portion thereof abandoned or - -1- tf> s» 1MII36 PG vacated bythis Ordinance.
