Ord No 02-82-1126V ORDINANCE NO.2-81-1126 AN ORDINANCE OF THE CTIY CF SOUTH MIAMI,FLORIDA, GRANTING VARIANCES TO TEJ PAL SING!JCWHAL,M.D., TO ALLOW USE OF A TEMPORARY DRIVEWAY ACCESS TO ELEVEN (11)PERMANENT PARKING SPACES WHERE A PERMANENT DRIVEWAY IS NORMALLY REQUIRED CDNDrTIONED UPON NECESSARY AGREEMEOT FOR TEMPORARY DRIVEWAY ACCESS FROM ADJOINING PROPERTY CWNER OR CMNERS SHALL BE FOR A PERIOD OF NOT LESS THAN YEAR TO YEAR; PROVIDING TERMS AND CONDITIONS GOVERNING EXPIRATION OF SAME;PROVIDING TERMS AND CONDITIONS FOR RENTAL AGREEMENT SHOULD ONE BE OBTAINED;PROVIDING FOR EXECUTED COPIES OF SAID AGREEMENT TO BE FURNISHED TO THE CITY OF SOUTH MIAMI AS A CONDITION OF SAID VARIANCE;AVARIANCETO ALLCW AZERO (0)FOOT LANDSCAPED STRIP ON THE SOUTH'PRDPERTY LINE WHERE A TIVE FOOT LANDSCAPED STRIP WOULD NORMALLY BE REQUIRED;ANDAVARIANCETO ALLCW AZERO (0)FOOT IANDSCAPED STRIP ALONG A PORTION OF THE EAST PROPERTY LINE WHERE A FIVE (5)FOOT LANDSCAPE STRIP WOUID NORMALLY BE REQUIRED AS TO CERTAIN DESCRIBED PROPERTY LOCATED AT 7211 AND 7221 SOUTHWEST 58TH AVENUE, SOUTH MIAMI,FLORIDA. WHEREAS,the Planning Advisory Board oftheCityof South Miami, Florida,has recommended the approval ofthe variances herein after granted. NOW,THEREFORE,BEITORDAINED BY THEMAYORANDTHECITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That Tej Pal Singh Jowhal,M.D.,be,andheis hereby granted the following variances fora medical office. A.A Variance toallowuseofa temporary driveway access to eleven (11)permanent parking spaces where a permanent driveway is normally required conditioned as follows: (1)Thatthesaidownerobtainsan agreement withthe adjoining property ownerorownersforsaid temporary driveway access andthat said agreement shallbeforaperiodofnotlessthanyearto year. (2)Thatinthe event of expiration or termination of said temporary driveway access agreement,thenany andall Occupational Licenses issued byvirtueof this variance shall automatically benulland void. (3)That provided,however,always inthe event the said ownerand/orlicenseeobtainsarentalagreementor agreements from yeartoyear permitted suchowner or licensee to legally park eleven (11)automobiles within 300feetofthe described property,then said variance shall remain in full force and effect. (4)Thatintheevent of termination ofsaidrental agreement provided inthe foregoing subparagraph (3), thenanyandall Occupational Licenses shall automatically benulland void. (5)Executed copies ofthe required temporary driveway access agreement ortherequiredparkingrental agreement or agreements shallbe furnished tothe CityofSouthMiamiasaconditionofsaid variances. B.A Variance toallowazero (0)foot landscaped strip on thesouth property linewhereafive (5)foot landscaped stripwould normally be required. 0> C.AVariancetoallowazero (0)foot landscaped strip along a portion oftheeast property line where a five (5)foot landscaped strip wouldnormallybe required. Section 2.Thatsaidpropertyislocatedat7211and7221 S.W.58th Avenue,South Miami,Florida,andmoreparticularlydescribed as: Lots 51and52,lessthe East 50feet,of W.A.LARKINS SUBDIVISION,as recorded in PlatBook 3,Page 198,ofthePublicRecords ofDadeCounty,Florida.
