WHEREAS,on October 25,1989,the City Commission voted to adopt Ordinance No.19-89-1441,theCity's Land Development Code, including Section 20-4.3,entitled "Sign Regulations";and, WHEREAS,from time to time,the City Commission has amended these regulations regarding specific issues or particular matters concerning the permitted signage inthe City of South Miami;and, WHEREAS,the City Commission created a Signage Regulation Review Committee to review the existing signage regulations,in order to determine if these regulations adequately address the needs of this community regarding signage regulation;and, WHEREAS,the Committee met on July 26,1996,August 1,1996, August 8,1996,August 15,1996,and finally August 22,1996,and proposed revisionstotheexistingsignageregulations;and, WHEREAS,the Mayor and City Commission desire to adopt those changes proposed bytheSignage Regulation Review Committee. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Signage Ordinance:2ndReadingOctober 1,1996 Section 1.Section 20-4.3 is hereby amended by replacing the section in its entirety with the comprehensive signage regulation package prepared by Signage Regulation Review Committee and attached hereto as "Exhibit A". Section 2.Section 20-2.3 "DEFINITIONS"is hereby amended by deleting all definitions from the term "Sign"through the terms "Sign,window ordoorglass identification",inclusive. Section 3.Section 20-4.8(F)(3),regarding non-conforming signs erected prior to October 26,1989,is hereby deleted. Section 4.Section 20-4.8(F)is hereby re-named to reflect the deletion of sub-section (3)as follows:"Nonconforming Use of Signo aed Structures". Section 5.Section 20-6.1(0 (3)(m),regarding the powers and duties of the Environmental Review &Preservation Board is hereby amended by deleting the term "signs". Section 6.Section 20-4.6(D)(1),regarding ERPB sign review standards,is hereby deleted and sub-section (2)is re-numbered. Section 7.Section 20-4.6(D)is hereby re-named to reflect the deletion of sub-section (1)as follows:"SignG and Storage". Section 8.Section 20-5.11,regarding the review of projects bythe ERPB,isherebyamendedbydeletingtheterms"sign"or "andsigns"throughout thissection;thereare5instances. Section 9.Section 20-5.16,regarding sign permit approvals, is hereby deleted inits entirety,tobe re-named as"Reserved". Section 10.If any section,clause,sentence,or phrase of this ordinance isforany reason held invalid or unconstitutional byacourtofcompetent jurisdiction,theholdingshallnot affectthe validity oftheremainingportionsofthisordinance. Section 11.All ordinances or parts of ordinances in conflict with the provisions ofthis ordinance are hereby repealed. BACKGROUND &ANALYSIS: The Signage Regulation Review Committee met July 26,1996,August 1,1996,August 8,1996, August 15,1996 and August 22,1996.The Committee completed their review ofthe existing signage legislation and proposed changes to the existing regulations.Additions are indicated by underline fontanddeletionsareindicatedbystrike-throughfont. The Committee proposed that approval bythe Environmental Review &Preservation Board [ERPB]for certain signage be continued and that a wider range of sign-types be permitted for all commercial properties inthe City.The Committee merged current regulations in order to create a single commercial district (for signage purposes)with additional signs permitted along U.S.1. Also,the Committee formatted all regulations into a new chart which contains actual regulations instead ofthe previously utilized reference numbers.Finally,in order to permit flexibility and additional signage for commercial properties,a new sub-section is proposed to permit additional signage under the discretion of the Environmental Review &Preservation Board [ERPB]. Ms.SusanRedding,chairperson of theSignageRegulation Review Committee,openedby reviewingthe committee's workand discussing the concerns outlinedinAdministration's memorandum,explainingthat search lightswerenotlimitedduetotheircostsand portable signs werelimitedto restaurants with approval foroutdoordining.Inher presentation,Ms.Redding introducedthree members of thesignagecommitteewhowerepresentat tonight's meeting, includingMs.AnnaDupree,Ms.LydiaWhite,andMr.Jorge Garcia. Infurther discussion of the two concernsthatare outlined inthe August 27th memorandum,Mr. Mackey suggested that search lightsbe permitted in conjunction with special events applications handledviatheCityManager'soffice.BothMs.ReddingandMs.White concurredwith staffs suggestion. Publichearingwas opened Mr.Mackeynotedforthepublic record thatfor signage itemsnotincludedunderthe proposed ordinance,an applicant hastheoptionto approach theERPBforitsreviewand approval.In regard to Mr.Pinkus'inquiryinvolving "hardship"cases associated with signage,applicants will havetheoptiontoseek approval of ERPB.In addition,Ms.Reddingnotedthat signage permitted and erected legally before passage of the ordinance willbe allowed to remain,until such time astheuse changes entirely. Mr.Pinkus statedthatfrom what hehadheardthusfarat tonight's meeting,theproposalas containedintheordinanceimprovesonthe regulations currentlyineffect.Mr.Pinkus related experiences incurred withexisting signage regulations,as applicable tothenew restaurant, "TrattoriaSole",presentedearlierat tonight's meeting. Publichearingwasclosed. Following theclose of the public hearing,Mr.Kerr inquired astothe status of neon signs stating "open"that are currently in widespread use.Mr.Mackey confirmed thatsuch standardized neon signswouldnotbe permitted underthenew ordinance.Mr.Mackey stated thatcustomizedneon signs,exhibiting thename of the business only,wouldbe permissible.Mr.Kerr added thathe found such signs helpful,particularly for motorists driving bydifferent establishments. Mr.Basu acknowledged thatthenew ordinance represented liberalized signage regulations.He stated his concern thatin providing such regulations,theCitywas removing the"checks and balances"provided bythe ERPB.Mr.Basu characterized the proposed ordinance as a "cafeteria plan",in that an applicant has the ability to pick and choose signs,as provided inthe schedule. Mr.Basu opined that a cap onthe amount of signage an applicant mayhave should bein place andshouldbeclearlystatedinthenew ordinance. 7 Staff responded thatthe signage committee had found thatthe average business person should be permitted more of avoiceinsome applications for signage.Staff explained thatthose applications involving signage thatmaybe characterized beyond whatis typically attached toa building,such as those concerning historical or contributive structures,orthosehaving considerable impactonthe surrounding environment,willcomebeforeERPBfor review. Staff notedthatmerchantsandownerswill,in general,be "self-limiting"intheirchoice of signage.Staff pointed out that,in general,people will tend to choose signage thatis good for themandforthecommunity,in order thattheir business willnotbe perceived asa detriment to the environment. Ms.Redding added that whatever is finally chosen and passed bythenew ordinance should be enforced by theCity. Mr.Basu responded that the matter being considered tonight is of a subjective nature and that theERPB sets thecommunity's "tastes".In response to Mr.Basu's inquiry regarding caps placed on one facade,staff responded that there is a cap on the amount of flat signage and that thereisacumulativecap,asopposedtoan overall,calculated cap. Discussion then ensued in regard toa hypothetical example involvingatwo-story building, approximately 25 feet in height and 50 feet in width with approximately 250 square feet permitted for signage.Mr.Basu gave an item-by-item list of signage that maybe included,such as awning signs with logos,building marker,two beacons,directional signs,display panel, hangingsign,mural,projecting sign,etc. Mr.Basustatedthat,inconclusion,an applicant mayhavealot of signage.Staff responded that applicants are permitted more options.Mr.Basu emphasized that there needs tobea cap onthe cumulative sign area.Staff maintained thatthe signage committee desired toofferthe business communityavariety of optionsthatmaybe considered in regard toits signs. Ms.Dupree explained that,ultimately,the applicant is going tohaveto obtain a permit,and she notedthatthe permit isgoingtoactasa controlling mechanism.Ms.Dupree stated thatthenew ordinance willnot create "openseason"in regard tonewsignage applications.Mr.Mackey stated thata safeguard isin place,inthatthe Planning Director hastheoption of recommending asignageapplicationforERPBreviewand approval. Mr.Illas inquired as totheuse of real estate signs,including size of signs and riders.Mr.Illas statedthathehada concern with the new ordinance,inthatthereareno size limitations involving riders specified inthe document.Mr.Illas suggested that riders be limited toone foot byone foot insize and totwoin number.Ms.Redding responded withthe suggestion that the ridersnotbeany wider thanthesigns. In regard to proposed language contained in Section 20-4.3 (I)(2)for townhouse districts,real estate signs,Mr.Illas suggested two signs be permitted for corner properties allowing for maximum exposure. 7 Mr.Basureturnedtohisconcerns involving theoptionsofferedbythe ordinance.Hestatedthat the options should be addressed in some fashion that would prevent them from becoming "overwhelming"with signage.He stated that the ERPB threshold thatthe new ordinance currently provides foris "way out".Mr.Basu called for tighter control,such as more ERPB involvement sooner.Mr.Kerr responded by following upon Ms.Dupree'searlier remarks in that Planning staff and the City permit both act as controlling mechanisms. Mr.Garcia suggested that a cap be placed onthe amount of choices or options.Mr.Mackey suggested thatacapbeplacedonan overall amount. Mr.Oliveros concurred that language should be added,such asthat including ERPB review,to provide for tighter control of proposed signage.Mr.Oliveros suggested that the language for subsection (H)(1),Permitted Sign Schedule,be changed to state that a signage request,if found by the City tobe aesthetically incompatible regarding surrounding areas,be required to appear beforeERPBforitsapproval. In response to Mr.Basu's inquiry involving signage by multiple tenants at properties,staff responded that this is an issue to be resolved between lease holder and property owner.Mr.Illas added that this type of issue goes beyond the "realm"of the Board's jurisdiction and concurred thatthiswouldbeanissuesettledbetweenlesseeandowner.Mr.Oliverosfurtheraddedthat this isa legal issue tobe resolved between the subject parties,without City involvement. In regard to Mr.Basu's questions,the Board and staff reviewed and discussed the proposed language (page 17)regarding murals for properties along South Dixie Highway and along Bird Road.Mr.Basustatedthathehadconcernsaboutcontentand appropriateness of murals,in general.
