AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO REPEALING
ORDINANCE NO.22-82-1145,WHICH ESTABLISHES PROCEDURES
FOR THE BIANNUAL AMENDMENT OF THE COMPREHENSIVE PLAN;

THE RULES CONTAINED IN THE FLORIDA ADMINISTRATIVE CODE;
PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN
CONFLICT;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,onJune 8,1982,theCity Commission oftheCityof
SouthMiamiadopted procedures forthe biannual amendment ofthe
City'sComprehensive Plan;and,
WHEREAS,onJanuary 19,1989,theCityCommissionadopted
the City's Comprehensive Plan which includes procedures for the
amendmentoftheComprehensivePlanunderAppendix A-6;and,
WHEREAS,thesetwosetsofregulationsrequireoverlapping
andextraordinary requirements forthenumberofPublic Hearings,
duetothe existence oftwo separate setsof regulations;and,
WHEREAS,theMayorandtheCityCommissionfindthatitis
inthepublicinteresttocondensetheseamendmentproceduresfor
theCity's adopted ComprehensivePlantoasinglesource.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Ordinance No.22-82-1145 is hereby rescinded.
Section 2.Appendix A-6 oftheCity's adopted Comprehensive
Plan is recognized asthesolesourcefor amendment procedures.
Section 3.Chapter 163ofthe Florida Statutes [F.S.],as
amended from time to time,and applicable Rules contained in the
Florida Administrative Code [F.A.C],as amended from time to
time,are recognized as being superior to Appendix A-6,and where
conflicts or extraordinary requirements resulting from conflicts
between either Florida Statutes or Florida Administrative Code

and Appendix A-6 occur,then provisions ofthe Florida Statutes
and Florida Administrative Code shall supersede and prevail over
the provisions set forth in Appendix A-6.
Section 4.If any section,clause,sentence,or phrase of
this ordinance is for any reason held invalid or unconstitutional
byacourtofcompetent jurisdiction,the holding shallnot
affect the validity ofthe remaining portions of this ordinance.
Section 5.All ordinances or parts of ordinances in conflict
with the provisions ofthis ordinance are hereby repealed.
Section 6.This ordinance shall take effect immediately at
the time of its passage.

BACKGROUND &ANALYSIS:
The City currently has two sets of regulations which require public hearings and advertising for
the adoption of Comprehensive Plan amendments.Because these two sources overlap and
conflict,the City must advertise and hold Public Hearings five times for each amendment tothe
Comprehensive Plan.This is expensive and results in extraordinary requirements for both the
City and applicants who desire to request changes tothe adopted Comprehensive Plan.
OrdinanceNo.22-82-1145 was,infact,adoptedsevenyearspriortothe City's currentlyadopted
Comprehensive Plan.The Comprehensive Plan itself contains provisions for the amendment of
the Comprehensive Plan under Appendix A-6.These provisions meet the requirements set forth
intheFlorida Statutes andthe State-adopted Rules contained intheFlorida Administrative Code.
The proposed ordinance for first reading (1)rescinds Ordinance No.22-82-1145,(2)designates
Appendix A-6ofthe adopted Comprehensive Plan asthesole source for amendment procedures,
and(3)recognizes theFlorida Statutes andtheFlorida Administrative Codeassuperiortothe
rulesunder Appendix A-6,inorderto avoid any future conflicts and extraordinary requirements.
ThePlanningBoardvoted6:0torecommendapproval of theproposedordinancerepealingthe
previous Ordinance No.22-82-1145.

Board.Mr.Tuckerexplainedthatthisdocument"streamlinesandclarifies"the procedures for

the request.

COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,
Section 1.That Section 7 of Ordinance No.13-81-1107,
heretofore adopted as the South Miami Comprehensive Plan be,and the same is
hereby amended to read as follows:
Section 7.Biannual Amendment Procedures
In an effort to maintain the overall integrity of the
Comprehensive Plan and provide for coordinated review
of requested amendments,requests for amendments to the
Comprehensive Plan shall be accepted only during October
and November of each odd numbered year,except that the
Mayor and City Commission may initiate an amendment at
anytimeby Resolution.
(a)Applications for amending the South Miami Compre
hensive Plan may be filed with the Buidling,Zoning and
Community Development Department during the months of
October and November of each odd numbered year.Said
applications for amendments shall be processed in the
manner prescribed by Section 163.3187,Florida Statutes,
and the requirments of the Official Zoning Ordinance of
of the City of South Miami.Where there is a conflict
between these requirements,the State Law shall take
precedence.
(b)When applications have been filed pursuant to
Section (a)above,the Planning Board shall hold a
preliminary Public Hearing on all proposed amendments
during the first fourteen (14)days of January of even-
numbered years.
(c)After the preliminary Public Hearing,the Building,
Zoning,and Community Development Department shall prepare /*
a final review and recommendation regarding each
application.Said report shall be presented to
the Planning Board nolaterthanthe second Friday
in February of even numbered years.
(d)The Planning Board shall hold a second Public
Hearing as soon as possible afterthe transmittal
ofthe final recommendations required by subsection
(c)above,but no later than the last Tuesday in
February of even numbered years,and shall makea
final recommendation tothe Mayor and City Commission
no later thanthe second Wednesday in March ofeven
numbered years.
(e)The City Commission ,after one or more Public
Hearings,shall take final action on all applications
no later than the second Tuesday of June ofeven
numbered years.
Section 2.Any Sections or parts of Sections of this Ordinance
mybe renumbered and/or combined withother Sections or parts of Sections ofthe
South Miami Comprehensive Plan andany amendments thereto,asis necessary,to
ensure the continuity and consistency within and between the various elements of
said Comprehensive Plan.
Section 3.All Ordinances or parts of Ordinances in conflict
herewith be,and the same are hereby repealed to the extent necessary to
implement this Ordinance.
Section 4.This Ordinance shall take effect immediately atthe
time of its passage.

Public Participation Procedures for Amending
the 1988 Comprehensive Plan
1.Schedule,as a minimum,onelocal planning agency public participation
workshop on each proposed plan amendment or group of amendments tobe
considered together.
2.Direct the appropriate City Administrative personnel to provide noticeto the
generalpublic of the scheduled planning workshop(s).At a minimum,the
notice should include publicationofonelegalnoticeof the City'sdesiretoobtain
the direct involvement of individuals and groups in the plan amendment
process.The notice should state that the City welcomes the participation of those
withaspecial interest inplan amendments aswellasthosewithageneral
interest.Include in the noticean invitation to participate inplan amendment
decision-making by:
a.reviewing proposed plan amendment drafts and related studies;
b.attending the public participation workshops and participating in
discussions subject to workshop procedural rules;and
c.presenting to the LPA written material containing relevant facts,ideas
and comments.
3.Adopt proceduralrulesforthe conduct of comprehensive plan workshops.Rules
shouldincludereservingtime for:1)presentation ofplanningresearchand
recommendations by the local planners and consultants,2)discussion oflocal
planner and consultant presentations,and3)presentation of comments by the
public.
4.Directthe appropriate City official to distribute the proposed planamendment
drafts and related studies.
5.Directthe appropriate City official to prepare copiesofplan amendment drafts
and related studies for distribution.
6.Direct local planners to prepare a public comment review report.The report
should summarize public comments.It should also indicate how the planning
process has responded topublic comments.
7.Hold local planning agency and City Commission public hearings on proposed
plan amendments.Schedule hearings and provide notice as required by
Florida law.
8.Assign responsibility for monitoring effectuation of this public participation
plan to the individual with the most appropriate administrative authority.

WHEREAS,the Planning Board does meet onthe second and last
Tuesdayofeach month at7:30 PM,aspreviouslysetforthvia
legislationinthe1971ZoningCode(nowrepealed);
WHEREAS,the Planning Board has requested that an official
schedule including a planned summer break be codified;and,
WHEREAS,the Planning Board has also requested that their
summer break coordinate with the City Commission summer break;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That §20-6.1 (B)(2)(d)is created as follows:
(d)The Planning Board shall hold regular meetings at7:30
PM,on the second and last Tuesday of each month with
the exception ofthe months of June and July.The
Planning Board shallholdone regular meeting at7:30
PM on the second Tuesday ofJuly.Meetings need not be
held if there are no scheduled agenda items.When the
daysetforanyregularmeeting(specified above)falls
onaday designated asalegal,public,national or
religious holiday,allagendasitemsshallbeheardat
thenext,regularmeeting date.All regular meetings
shall be held at City Hall.

Section 2.All ordinances or parts of ordinances in conflict
with the provisions ofthis ordinance are hereby repealed.
Section 3.If any section,clause,sentence,or phrase of
this ordinance is for any reason held invalid or unconstitutional
byacourtofcompetent jurisdiction,thisholdingshallnot
affect the validity ofthe remaining portions of this ordinance.
Section 4.This ordinance shall take effect immediately at
the time of its passage.
