WHEREAS,onJune 8,1982,theCity Commission oftheCityof SouthMiamiadopted procedures forthe biannual amendment ofthe City'sComprehensive Plan;and, WHEREAS,onJanuary 19,1989,theCityCommissionadopted the City's Comprehensive Plan which includes procedures for the amendmentoftheComprehensivePlanunderAppendix A-6;and, WHEREAS,thesetwosetsofregulationsrequireoverlapping andextraordinary requirements forthenumberofPublic Hearings, duetothe existence oftwo separate setsof regulations;and, WHEREAS,theMayorandtheCityCommissionfindthatitis inthepublicinteresttocondensetheseamendmentproceduresfor theCity's adopted ComprehensivePlantoasinglesource. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Ordinance No.22-82-1145 is hereby rescinded. Section 2.Appendix A-6 oftheCity's adopted Comprehensive Plan is recognized asthesolesourcefor amendment procedures. Section 3.Chapter 163ofthe Florida Statutes [F.S.],as amended from time to time,and applicable Rules contained in the Florida Administrative Code [F.A.C],as amended from time to time,are recognized as being superior to Appendix A-6,and where conflicts or extraordinary requirements resulting from conflicts between either Florida Statutes or Florida Administrative Code 2nd Reading May 7th,1996 Amendment Revision Ordinance Page #1 and Appendix A-6 occur,then provisions ofthe Florida Statutes and Florida Administrative Code shall supersede and prevail over the provisions set forth in Appendix A-6. Section 4.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional byacourtofcompetent jurisdiction,the holding shallnot affect the validity ofthe remaining portions of this ordinance. Section 5.All ordinances or parts of ordinances in conflict with the provisions ofthis ordinance are hereby repealed. BACKGROUND &ANALYSIS: The City currently has two sets of regulations which require public hearings and advertising for the adoption of Comprehensive Plan amendments.Because these two sources overlap and conflict,the City must advertise and hold Public Hearings five times for each amendment tothe Comprehensive Plan.This is expensive and results in extraordinary requirements for both the City and applicants who desire to request changes tothe adopted Comprehensive Plan. OrdinanceNo.22-82-1145 was,infact,adoptedsevenyearspriortothe City's currentlyadopted Comprehensive Plan.The Comprehensive Plan itself contains provisions for the amendment of the Comprehensive Plan under Appendix A-6.These provisions meet the requirements set forth intheFlorida Statutes andthe State-adopted Rules contained intheFlorida Administrative Code. The proposed ordinance for first reading (1)rescinds Ordinance No.22-82-1145,(2)designates Appendix A-6ofthe adopted Comprehensive Plan asthesole source for amendment procedures, and(3)recognizes theFlorida Statutes andtheFlorida Administrative Codeassuperiortothe rulesunder Appendix A-6,inorderto avoid any future conflicts and extraordinary requirements. (b)When applications have been filed pursuant to Section (a)above,the Planning Board shall hold a preliminary Public Hearing on all proposed amendments during the first fourteen (14)days of January of even- numbered years. (c)After the preliminary Public Hearing,the Building, Zoning,and Community Development Department shall prepare /* a final review and recommendation regarding each application.Said report shall be presented to the Planning Board nolaterthanthe second Friday in February of even numbered years. WHEREAS,on October 26,1989,the City Commission ofthe CityofSouthMiamiadoptedaLand Development Codewhich includedprovisionsfororganizationofthePlanningBoard; WHEREAS,the Land Development Codedoesnot contain a schedule for the regular meeting ofthe Planning Board,nor has anysummerbreakeverbeen observed bythePlanning Board; WHEREAS,the Planning Board does meet onthe second and last Tuesdayofeach month at7:30 PM,aspreviouslysetforthvia legislationinthe1971ZoningCode(nowrepealed); WHEREAS,the Planning Board has requested that an official schedule including a planned summer break be codified;and, WHEREAS,the Planning Board has also requested that their summer break coordinate with the City Commission summer break; NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That §20-6.1 (B)(2)(d)is created as follows: (d)The Planning Board shall hold regular meetings at7:30 PM,on the second and last Tuesday of each month with the exception ofthe months of June and July.The Planning Board shallholdone regular meeting at7:30 PM on the second Tuesday ofJuly.Meetings need not be held if there are no scheduled agenda items.When the daysetforanyregularmeeting(specified above)falls onaday designated asalegal,public,national or religious holiday,allagendasitemsshallbeheardat thenext,regularmeeting date.All regular meetings shall be held at City Hall. 2nd Hearing;May 2f,1996 Planning BoardSummerBreak Ordinance 1 Page 2 of Ord.#9-96-1609 Section 2.All ordinances or parts of ordinances in conflict with the provisions ofthis ordinance are hereby repealed. Section 3.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional byacourtofcompetent jurisdiction,thisholdingshallnot affect the validity ofthe remaining portions of this ordinance.
