ORDINANCE NO.2-96-160? AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,TO AMEND SECTION 16A-16.1 OF THE CODE OF ORDINANCES OF THE CITY OF SOUTH MIAMI ENTITLED POSITION OF HONORARY CORPORAL OF POLICE;PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE. WHEREAS,Section 16A-16.1 of the City's Code of Ordinances provides a procedure for review of applications requesting theCity Manager to award the position of honorary corporal to Police Officers who have served fifteen (15)years with the police department of the city who have not attained any rank;and, WHEREAS,that procedure includes review of the personnel record of theapplicant,an interview with the applicant if advisable,and a recommendation in writing from the advisory personnel board;and, WHEREAS,the application review can be fairly and more expeditiously processed ifthe review and recommendation is completed by the personnel director ofthe City rather than an advisory personnel board;and, WHEREAS,the Mayor and the City Commission find that itisinthe public interest to amend Section 16A-16.1. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section l.Section 16A-16.1 of the City of South Miami Code of Ordinances is hereby amended to read: There is hereby established the position of honorary corporal of police.Such position shall be awarded solely asa longevity benefit to police officers who have completed fifteen (15)years of above average meritorious service with the police department of the city,but who have not attained the rank of honorary corporal.Such position shall not be considered an increase in rank,nor shall officers who are awarded the position have any additional authority within the department. Officers awarded the position of honorary corporal shall be entitled to wear on their police uniform sleeves a patch or emblem consisting of two (2)corporal stripes with the letter "H"immediately below such stripes,the form of such emblem to be approved by the city manager. Police officers who have served fifteen (15)years with the police department of the city,who have not attained any rank may make application by letter to the city manager for award of the position of honorary corporal.The city manager personnel director shall thoroupon refer the application to the advioory poroonnol board of tho city whoco mombor ohall promptly review the personnel record of the applicant,and if thoy deemed ife-advisable,conduct an interview with the applicant. The board personnel director shall make its a recommendations in writing tothecitymanagerwithinthirty (30)daysfromthedatethe application is filed with thecitymanager. Inthe event of disapproval of the application the applicant may not filea further application for a period of one year following the date of filing of any disapproved application. Officers awarded the position of honorary corporal entitled toa one-half (1/2)step pay increase. shall be Section 2.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this ordinance. Section 3.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.This ordinance shall take effect immediately atthe time of its passage. The procedures requires review by the advisory personnel board. The proposed change would require review by the Personnel Director,eliminating the advisory personnel board review.This change would expedite the procedure,which allows only 30 days for review from the date of application by the officer for such designation. I recommend approval.
