RESOLUTION NO.:209-15-14548 A Resolution authorizing the City Manager to replace existing shade covers at Murray Park and to purchase new poolside shade structures from Apollo Sunguard Systems, Inc.through a piggyback agreement from the Clay County,Florida RFP No.13/14-8 for an amount not to exceed $37,417.92 WHEREAS,the existing shade covers (2)located at Murray Park are worn out and need to be replaced in order to provide players and spectators protection from the sun;and WHEREAS,there are no fabricated shade areas on the pool deck and minimal natural shade at the Murray Park Aquatic Center to provide patrons protection from the sun;and WHEREAS,the proposed shade structures are 18'(2)and 20'(2)in diameter witha10' elevation (in-ground installation)and can withstand 105 mph wind load with the cover onand 170 mph wind load with the cover off;and WHEREAS,the new shade structures would give the option of shade to reduce the risk of heat related illnesses and improve the comfort of the spectators at Murray Park Aquatic Center;and WHEREAS,the purchase willbe made through a piggyback agreement from the Clay County,Florida RFP No.13/14-8,which contains a number of vendors who are authorized to sell park and playground equipment to Clay County,Florida;and WHEREAS,competitive bids were sought fromat least three (3)different sources of supplylistedin the awardmadeby Clay County,Florida through responses toits RFP No.13/14- 8;Apollo Sunguard Systems,Inc.wason the ClayCountylistof vendors anditwas the lowest andmost responsive vendor selected from Clay County,Florida RFP No.13/14-8 bidders list. NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHE CITY OF SOUTH MIAMI,FLORIDA THAT: Section 1.TheCity Manager is authorized to expend an amount not to exceed $37,417.92toApolloSunguardSystems,Inc.for the purchase andinstallationoftwo(2)new replacement shade coversatMurrayParkandfour(4)new single-post,hexagon shade structures at Murray Park Aquatic Center.TheCity Manager isalso authorized to expend 10% or $3,741.80 in the event that any unknown conditions arise that would warrant a change order.The total expenditure shallbe charged to the Parks and Recreation Capital Improvement account number 301-2000-572-6450,which has a balance of $381,128 before this request was made. After generating a RFQ fora project,and before bidder's submission ofits quotation in response tothe RFQ,the County may require requested bidder (s)to attend asitevisit with County personnel to familiarize the bidder (s)with the site and determine additional services that may be required to complete the project.Bidders willbe responsible forthe accuracy ofall fixed measurements. which apetitionhas been timelyfiledmaybe modified or waived solongassuchmodification 32 orwaivershallnothinderorthwarttheproperandexpeditiousresolutionoftheprotest,or otherwiseoperatetounderminethesalutarypurposesofcompetitive,publicbidding. 18.Onlytotheextentnecessarytoavoidamiscarriage of justiceortopreventamanifest violationofahearingparticipant'sproceduralor substantive dueprocessrights,ahearingofficer maymodify or suspendthe applicability ofanyofthe provisions or requirements ofthissection inthecourse of conductingaprotestproceeding hereunder;provided,ahearingofficermaynot modifyorsuspendany of theprovisionsorrequirements of subsections3,4,6,7,8,16,20,21 and 22 hereof. 19.Exceptandtotheextent specifically provided inthis
