No. 27-95-1600ORDINANCE NO.27-95-1600 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE 1996 GENERAL ELECTION OF THE MAYOR AND CITY COMMISSIONERS FOR GROUPS 3L.II AND III;SCHEDULING THE DAY,PLACE AND TIME OF THE ELECTION;PROVIDING FOR QUALIFICATION OF CANDIDATES; PROVIDING FOR CLOSE OF ELECTION BOOKS;APPROVING THE OFFICIAL BALLOT;PROVIDING FOR NOTIFICATION;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS,section 2,article V,of the City of South Miami Charter provides that the City Commission of the City of South Miami shall schedule a general election for February of each even year,and that the mayor shallbe elected fora term of two (2) years and two commissioners shall be elected for terms of four (4) years at the general election;and WHEREAS,thecharterrequirestheCity Commission oftheCity of South Miami to schedule the day,place and time of the general election by ordinance;and WHEREAS,statelawrequireselectionbookstoclosethirty (30)days prior to the election. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:The 1996 general election will be held on Tuesday,February 13,1996.Onthat date,amayorwillbeelected toservea term oftwo (2)years,one (1)commissioner willbe elected to serve the un-expired term of two (2)years created bv a vacancyingroup I.andtwo (2)commissionersfromgroupsIIand III will be elected to serve a term of four (4)years. Section2:Thequalifyingperiodforthiselectionshall be open Tuesday,January 2,1996 and close Tuesday,January 9, 1996,preciselyat5:00 p.m.Candidatesshallqualifyatthe OfficeoftheCity Clerk,6130Sunset Drive,South Miami,Florida. Section 3:Voting shallbe conducted at the Dade County PublicLibrary,6000Sunset Drive,SouthMiami,Florida.Thepolls shall open precisely at7:00a.m.,and close precisely at7:00p.m. Section 4:The official ballot for the 1996 general election is annexed to this ordinance. Section 5:The election books shall close Saturday, January 13,1996. Section 6:The City Clerk shall publish notice of such general election once a week for four (4)consecutive weeks next preceding the general election ina newspaper of general circulation in South Miami.The notice shall contain the date, time,and place of the election and identify the commission groups to be voted for. Section 7:The City Clerk is directed,in conjunction with the Dade County Supervisor of Elections,to comply with all applicable election laws. Section 8:If any section,clause,sentence,or phrase of this ordinance isfor any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect the validity ofthe remaining portions of this ordinance. Section 9:All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
