WHEREAS,the City of South Miami enacted Ordinance No.18-80-1077 which imposed occupational license taxes on persons maintaining a permanent business location or branch office within the City of South Miami for the purpose of engaging inor managing a business,profession,or occupation within the City of South Miami;and, WHEREAS,Ordinance No.18-80-1077 was originally adopted on June 3,1980,and amended by the following ordinances [see Attachments that follow Exhibit A]: Ordinance No.20-83-1180 on Aug 2,1983, Ordinance No.5-91-1470 on Mar 5,1991, Ordinance No.20-91-1485 on Jun 30,1991, Ordinance No.12-92-1507 on Jun 2,1992,and Ordinance No.9-93-1537 on Jul 20 ,1993; and, Occupational License Revision Ordinance Page #1 WHEREAS,theCode of Ordinances doesnot presently contain Ord.No.18-80-1077, nor does the Code of Ordinances contain those ordinances amending Ord.No.18-80-1077, withthe exception of Ord.No.5-91-1470 andOrd.No.12-92-1507,whichare contained under§13-1 of Chapter 13 (entitled "Licenses")intheCode of Ordinances;and, WHEREAS,theMayorandCityCommissiondesiretofurtheramendthoseordinances regulating occupationallicensetaxestoreflectrecentchangesintheFloridaStatutes;and, WHEREAS,theCode of Ordinancescontainsregulations regarding "Bail Bondsmen" under§13-25 through§13-31 in Chapter 13oftheCodeof Ordinances,whicharerelatedto the Municipal Court provisions in Chapter 14whichwere repealed bytheCity Commission via Ordinance No.8-92-1503 onMay5,1992;and, WHEREAS,theMayorandCity Commission desire topublishallofthe regulations regarding occupational license taxes as part of Chapter 13 inthe Code of Ordinances. NOW,THEREFORE,BEIT ORDAINED BY THE MAYOR ANDCITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: SECTION 1.That Section 25 of Ordinance No.18-80-1077 is amended as follows: Sec.13-25.Failure to Obtain License:Delinquencies:Additional Penalties. (a)Any person engaging inor managing any business,occupation or profession without ever having first obtained a local occupation license,as required hereunder,shall be subject toa penalty of twenty-five percent (25%)of the license determined to be due,in addition to a two hundred fifty dollar ($250.00)penalty ifan occupational license isnot applied for within 150 davs of notice. (b)Enforcement procedures for new occupational licenses may commence upon the City becoming aware of any person engaging in or managing any business,occupation or profession withoutfirstobtainingalocal occupational license. (c)Occupational licenses shall be considered delinquent immediately on October 1st of every year.Fines for delinquent occupational licenses shall be assessed per Section 13-2:in addition, those licenses not renewed bv January 31.shall be subject toa two hundred fifty dollar ($250.00) penalty per occupational license. SECTION2.ThatSection2 of OrdinanceNo.18-80-1077 isamendedasfollows: Sec.13-2.TermandDuration-PenaltyforOperationafterDue Date:GracePeriod. Any license issued under this chapter shall expire on the 30th day of September of each year. No license shall be issued for more than one year.Those licenses not renewed by October 1st Occupational License Revision Ordinance Page #2 shall be considered delinquent and subject toa delinquency penalty of ten percent (10%)forthe month of October plusan additional fivepercent(5%)penalty foreach month of delinquency thereafteruntilpaid,providedthatthetotaldelinquencypenaltyshallnotexceedtwenty-five percent (25%)of the occupational licensefeeforthedelinquent establishment.Agraceperiod of thirty days willapplytoanyoccupationallicenserenewedpriortoclose of theregular businessdayonorbeforeOctober 31st.thatis.suchlicense renewals although delinquent will notbe not assessed a delinquency fee. SECTION 3.That Section 16 of Ordinance No.18-80-1077 is amended as follows: Sec.13-16.Revocation for Violation of the Land Development Code or Ordinances. The license ofanypersonforthe operation ofany business maybe revoked bytheCity Manager at any time,upon notice of violation of any ofthe provisions ofthe Land Development Code or ordinances ofthe Citv:applicable provisions ofthe Dade County Code:lawsoftheStateof Florida:violationofthetermsandconditionsofanydevelopment permit,covenant,public restriction or waiver:orforany other good and sufficient reason.Inthe event thatan appeal is filed bv any aggrieved person under §13-27.the Citv Manager mav stop or suspend any construction authorized bvthe waiver,untila decision hasbeen made ontheappeal.Inthe event theCitvManagershoulddeterminethatthe suspension oftheconstructioncouldcauseimminent peril to life or property the Citv Manager mav permit the construction to continue upon such conditions and limitations,including furnishing ofan appropriate bond,asmavbe deemed proper under the circumstances. SECTION4.ThatSection27ofOrdinanceNo.18-80-1077isreplacedasfollows: Sec.13-27.Appeals. (a)An appeal to the City Commission may be filed with the City Clerk upon a form prescribed by the City Clerk.An appeal must be filed within thirty (30)days of the action taken which is the subject of the appeal.An appeal may be filed by any aggrieved person(s). (b)An appeal stays all proceedings in furtherance of the action appealed from,unless the officer from whom the appeal is taken or the City Manager certifies to the City Commission, after notice of appeal has been filed with him,that because of the facts stated in the certificate a stay would,in the officer's or the City Manager's opinion,cause imminent peril to life or property or that because the violation charged is transitory in nature a stay would seriously interfere with enforcement of this Chapter. (c)If certification occurs in accordance with subsection (b)above,proceedings may not be stayed,except by a restraining order,which may be granted by the City Commission or by a court of record on application,on notice to the officer from whom the appeal is taken or the City Managerandonduecause shown. Occupational License Revision Ordinance Page #3 (d)TheCityCommissionshallhearandenteradecisiononallappealswithinsixty(60)days ofthedateoffilingsaidappeal,andshallprovideduenoticeoftheappealtotheparties. (e)TheCity Commission mayreverse,affirmormodifyanyorder,requirement,decision or determination appealed fromandshallmakeanyorder,requirement,decision or determination that,intheCity Commissions'opinion,oughttobemadeinthe circumstances. (f)When practical difficulties or unnecessary hardships would result from carrying outthe strictletter of a provision,theCityCommissionmay,inpassingupon appeals,varyormodify anyregulationor provision of thischapterrelatingtooccupationallicensetaxes,sothatthespirit of thischapterisobserved,publicsafetyandwelfaresecured,andsubstantial justice done. (g)TheCityCommissionshallnotberequiredtohearanappealorapplicationpreviously deniedifitfindsthattherehasbeennosubstantialchangeinconditionsor circumstances bearing ontheappealor application. SECTION5.ThatSection28 of OrdinanceNo.18-80-1077isreplacedasfollows: Sec.13-28.Notice of Violation;Right toAppeal;Order toCeaseandDesist Business. Whenever theCity Manager determines thatthereisa violation ofanyprovisionofthischapter orany other applicable ruleor regulation,the City Manager shall give notice of such violation tothe person or persons who are responsible for either obtaining the required occupational license and/orthe required occupational license renewal.Such noticeof violation shall: (a)bein accordance withthe provisions set forth in Chapter 162of Florida Statutes; (b)inform the person to whom itis directed ofhisorher right toapplyforan appeal hearingbeforetheCity Commission;and, (c)instruct the responsible person(s)identified inthe violation to immediately cease and desist all business,occupational,or professional activities onthe premises. SECTION6.ThatSection29ofOrdinanceNo.18-80-1077 isreplacedasfollows: Sec.13-29.Duties of the City Attorney. The City Attorney,upon request of the City Manager,or upon his or her own initiative,shall institute appropriate action to restrain,prevent,enjoin,abate or correct any and all violations under this chapter,andtotake such other legal action as may be necessary to carry outthe terms andprovisionsofthischapter. OccupationalLicenseRevisionOrdinancePage#4 SECTION 7.That Section 30 of OrdinanceNo.18-80-1077is replaced asfollows: Sec.13-30.Recovery of Attorneys1 Fees;Court Costs;Administrative Costs;Penalty. Anypersonwho engages inanybusiness,occupationor profession covered bythischapter,who doesnotpaythe required occupational licensetaxwithin150 days after the initial notice of tax due,andwho does not obtain the required occupational license is subject to civil actions and penalties,includingcourtcosts,reasonableattorneys'fees,administrative costsincurredasa resultof collection efforts,andapenaltyupto$250.00. SECTION 8.That Section 12 of Ordinance No.18-80-1077 is amended as follows: Sec.13-12.Transfer of License -Location;Fees. Licenses maybe transferred from one location to another,provided,thatthelicensesare presented tothe Finance Department for the approval of such transfer,and provided further that such license is subject to revocation under §13-16 as determined bv the Director of the Building. Zoning &Community Development where any question of zoning arises,and provided further, thatthe licensee shallpayforsuch transfer,a fee inthe amount of 10%ofthe annual license tax, butnotlessthanthreedollars($3.00)normorethantwentv-fivedollars($25.00). SECTION 9.That Section 13 of Ordinance No.18-80-1077 is amended as follows (including the addition of the title for Section 14whichwasnot included inthe original): Sec.13-13.Change of Ownership;Requirements;Fees. Licenses issued bythe City may be transferred with the approval ofthe Finance Director (except inthe case of alcoholic beverage licenses,which shall require approval ofthe Building.Zoning &Community Development Department)with the businesses for which they were taken out, except as otherwise provided by law,when there isa bone fide sale and transfer of the property used and employed in the business as stock in trade,and not otherwise,subject,however,to the followingconditions: (a)The seller of the business shall present the license to the Finance Department with an endorsement onthe reverse side thereof,assigning allright,titleandinterest tothepurchaser;and, (b)The purchaser shall produce a properly executed instrument showing the transfer of stock of goods and ofthe lease or deed tothe property;and, (c)The purchaser shall file an application for license,and shall qualify inall respects as provided by law and by the ordinances of the City asan applicant for a license, asifheor she had applied for the license inthe first instance;and, Occupational License Revision Ordinance Page #5 (d)AfeeshallbepaidtotheFinanceDepartmentinconnectionwithsuchtransfer, based on 10%of the annual license tax,but not less than three dollars ($3.00)nor more than twentv-five dollars ($25.00). Sec.13-14.Lease Department License Required. Everypersonoperatingwhatiscommonlyknownas"leasedepartment"inanystoreshallpay alicenseforthe operation of eachdepartmentsoleasedaccordingtothe proper classification of thebusinessor occupation assetforththerein. SECTION 10.That Section 19 of Ordinance No.18-80-1077 is amended as follows: Sec.13-19.Licenses to Conform to Zoning and Building Regulations. Where any question ofzoningarises,no license shallbeissued hereunder forany business, occupation or profession untilthe location thereofshallhavefirstbeen approved bythe Director of Building.Zoning &Community Development. SECTION 11.That§13-25 through§13-31,which comprise ArticleIIentitled"Bail Bondsmen" contained in Chapter 13ofthe Code of Ordinances,are repealed,and§13-25 through §13-30 are utilized for the codification of Ordinance No.18-80-1077,as amended,and that the remaining sub-section,§13-31,isreservedasArticle n,andentitled "Reserved". SECTION 12.That Chapter 13,entitled "Licenses"inthe Code of Ordinances,is amended by replacing the existing §13-1,the reserved sub-sections §13-2 through §13-24,and sub-sections §13-25 through §13-30,as set forth in "Exhibit A"(attached),in order to codify the regulations regarding occupational license taxes as contained in Ordinance No.18-80-1077,as amended from time to time bythe City,and including those amendments contained within this ordinance. SECTION 13.All ordinances or parts of ordinances in conflict with the provisions of this ordinanceareherebyrepealed. SECTION 14.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity ofthe remaining portions ofthis ordinance. (a)Nopersonshall engage inormanagethebusinesses,occupations or professions enumerated inthisordinanceandrequiredtobelicensedbytheCity,withoutfirsthavingpaidtheamount oflicensetaxrequiredforeachseparatelocationintheCity,fortheuse of theCity,andhaving obtainedaCitylicensetherefor.Forthepurpose of thisordinance,anypersonholding himself outtothepublicbysign,printedmatter,telephonedirectoryclassifiedsection,Citydirectory, postofficeboxorotherwise,regardless of whethersuchpersonactuallytransactsanybusiness orpracticesaprofessionorengagesinanoccupationshallbeconsideredas engaging inbusiness andshallbeliableforanoccupationallicensetaxtherefor,accordingtotheclassification of the business so held out or advertised,as set fourth herein. (b)ProfessionalpractitionersarerecognizedprofessionsregulatedbyStateBoardsrequiring examination and certification.Professional licenses are individual licenses and each person engagedinthepracticeoftheirprofessionwhetheralone,inapartnershiporasanemployeeof anotherperson,partnership,corporationor professional associationshallobtainanoccupational license. Sec.13-2.Term and Duration -Penaltyfor Operation after DueDate;Grace Period. Any license issued under this chapter shall expire onthe 30th day of September of each year. Nolicenseshallbeissuedformorethanoneyear.ThoselicensesnotrenewedbyOctober 1st shallbeconsidereddelinquentandsubjecttoa delinquency penalty often percent(10%)forthe monthofOctoberplusan additional five percent (5%)penaltyforeachmonthof delinquency thereafter untilpaid,provided thatthetotal delinquency penalty shallnotexceed twenty-five percent (25%)ofthe occupational license fee forthe delinquent establishment.Agrace period of thirty days will apply to any occupational license renewed prior to close ofthe regular business dayonor before October 31st,thatis,such license renewals although delinquent will not be not assessed a delinquency fee. Sec.13-3.Fractional Licenses. Unless otherwise provided,for each license obtained between October 1st and April 1st,the full tax for one year shall be paid,and for each license obtained from April 1st to September 30th, one-halfthefulltaxforoneyearshallbepaid. Sec.13-4.Applications -Date;Filing;Necessary Information. Every person engaged inor managing any business,profession or occupation referred tointhis chapter inthe City is required to procure a City license as herein provided and shall,onor before October 1st ofeach year,and always before engaging inany business,profession or occupation, Editorial Change:The term "tax collector"has been replaced by the term "Finance Department". filean application onthe prescribed form with the Finance Department,signed byan officer, partnerorowner of thebusiness.Alllicensesshallbeappliedforandissuedintherealname of theapplicant;incaseswheretheapplicanthasqualifiedunderthelaws of Floridafortheuse of a "Fictitious Name",the license,if issued,shall show the real name as well as the fictitious nameoftheapplicant.Insuchapplication,theapplicantshallsetforththename of theowner (ifafirm,thenames of allmembers of thefirm;ifacorporation,thenames of allofficers of the corporation);the location of the business;thefull nature of the business;where the license tax isbased thereon;thevalueofstockcarriedorthenumberofseats,machines,employees,gasoline pumps,rooms,orvehicles,etc.,used,asthecasemaybe;andsuchother pertinent information asmaybe prescribed by the Finance Department. Sec.13-5.Misrepresentation of Material Fact. Anylicense obtained under theprovisionsofthischapterupona misrepresentation of amaterial factshallbedeemednullandvoid,andthelicenseewhohasthereafterengagedinanybusiness undersuchlicenseshallbe subject to prosecution fordoing business without alicense,tothe sameeffectanddegreeasthoughnosuchlicensehadeverbeenissued. Sec.13-6.Value of Stock Carried. Wheneverinthischapteralicensetaxisbaseduponordeterminablebythe"valueofstock carried",thevalue of stock carried shallbethe wholesale cost value of all stock in trade and merchandise on hand as of theclose of thefiscalyear of the licensee next preceding thestart of thelicenseperiodin question.Wherethe license isnota renewal licenseorthelicenseehasnot completed onefiscalyear,thenthevalueofstockcarriedshallbethecostvalueofallstockin trade and merchandise on hand as of the date of the commencement of business.The true value of stockcarried,asabovedefined,shallbestatedbytheapplicantforalicenseorforarenewal of license.Intheeventanapplicantfora license failsorrefusestostateorsetforththevalue ofstockcarried,asabovedefined,orsetsforthsuchvalueinaccurately,theFinanceDepartment oftheCityshallfixand determine such value from any information inhis possession,andthe value so fixed shall be used to determine the amount of license tax due the City. Sec.13-7.Determination of Classification. Intheeventofa disagreement between an applicant andtheCityonthe question ofproper classification ofany business,occupation or profession for license purposes,the Finance Department shall decide the proper classification,with the right,inthe applicant,to appeal from such decision totheCity Commission whose decision uponthepointshallbe final. Sec.13-8.License to Apply to One Place of Business. All licenses provided for herein shallbe issued forand apply toonlyone place of business within the City. Editorial Change:The term "tax collector"has been replaced by the term "Finance Department". Sec.13-9.Bills or Notices for License Tax. Itis hereby declared tobe unnecessary for the City to send out bills or notices to persons engaged in business intheCitywith respect tothe payment or nonpayment of license taxes. Sec.13-10.Exemptions to Specified Persons. Exemption fromthe payment of the license taxsetforth herein shall be allowed in such cases asareprovidedforinthischapterandinthefollowingcasesasprovidedforbythelawsofthe State of Florida: (a)Disabled veterans of theSpanish American War,World War I,WorldWar n, Korean Conflict,Vietnam Conflict and widows of such deceased veterans (exempted upto$50.00 annually); (b)Confirmed cripples,deaf andmutepersons;invalids physically incapable of manual labor;widows with minor dependents;persons 65 years of ageorolder; (c)Growers of farmandgroveproducts,including products manufactured therefrom (except intoxicating liquors,wineandbeer); (d)OrganizationsissuedState of Florida Non-Profit Organization Certificates;and (e)Other organizations soapprovedbytheCityCommission. Sec.13-11.Posting of License. Every license shallbepostedina conspicuous placeintheplaceofbusinessforwhichitis issued and the holder of such license shall exhibit sametotheCity license inspector,his deputy oranypoliceofficeruponbeing requested todosobyanyofthem. Sec.13-12.Transfer of License -Location;Fees. Sec.13-14.Lease Department License Required. Everypersonoperatingwhatiscommonlyknownas "lease department"inanystoreshallpay alicensefortheoperationofeachdepartmentsoleasedaccordingtotheproperclassification of the business or occupation assetforththerein. Sec.13-15.Termination of License on Notice of Bankruptcy. WhenanypersonengagedinmercantileorotherbusinessintheCityshallmakeanassignment forthebenefit of creditors,orwhenanysuchpersonshallbe adjudicated avoluntaryoran involuntary bankrupt or declared insolvent,any license theretofore issued,authorizing suchperson todobusinessintheCity,shall immediately be terminated andshall,uponsuch assignment for thebenefitof creditors oruponsuch adjudication in bankruptcy,immediately becomenulland void. Sec.13-16.Revocation for Violation of the Land Development Code or Ordinances. Sec.13-17.Re-issuance of License;Payment of Debts Due City Prerequisite. Anypersonbeing delinquent inthepayment of any assessment,taxes,feesorany moneys due untotheCityshallbeasa prerequisite tothe re-issuance of an occupational license berequired topayanyassessment,taxes,feesorsums of money of anynature whatsoever dueuntotheCity beforetheaforesaidoccupationallicensewillbere-issuedbytheauthorities of theCity.This requirement shall pertain to any assessment,tax,fee or charge due for services rendered the premises occupied by such business oranyfee,taxor assessment or charge of whatever nature requiredforservicesrenderedtheaforesaidbusinesslocation,butthesameshallnotimpairany obligation onthepart of the property ownertopayanysumsdueontotheCitybyvirtue of fees, assessments,taxesorchargesandthissectionshallbedeemedto require thegoodstanding of anybusinesswithintheCity limits priortoitsbeingqualifiedto conducting business therein. Sec.13-18.Regulatory Provisions Remain in Effect. Unlessotherwise herein specifically excepted,changedor differentiated,allqualifyingor regulatoryprovisions of theCityapplicabletooraffectingany of thebusinesses,operations, occupations or classifications covered bythis chapter shallbeand remain infullforce and effect. Sec.13-19.Licenses to Conform to Zoning and Building Regulations. Whereanyquestion of zoningarises,nolicenseshallbeissued hereunder foranybusiness, occupation or profession untilthelocation thereof shallhavefirst been approved bythe Director of Building,Zoning &Community Development. Sec.13-20.Authority of Finance Department to Promulgate Rules. TheFinance Department maymakesuchrulesandregulations,not inconsistent withthischapter, asmaybenecessaryorproperfortheenforcementoftheprovisionshereof. Sec.13-21.License Fee a Debt. Theamountofanylicensetaxandpenaltyimposedbytheprovisions of thischapterishereby declaredtobeadebtduetotheCity,andanypersoncarryingonany business withoutfirst havingprocuredalicensefromtheCitysotodo,shallbeliabletotheCityfortheamountof such license tax recoverable in any court of competent jurisdiction. EditorialChange:The term "tax collector"hasbeenreplacedbythe term "Finance Department". Sec.13-22.Replacing LostorDestroyedLicenses;Fee. For the purpose of replacing any mutilated,destroyed or lost license certificate receipt relating toany occupational licensegrantedbytheCity,theFinance Department ishereby authorized and empowered tocausetobeexecutedand delivered andappropriateduplicatelicensecertificateor receipt,uponthe submission of evidence satisfactory tothe Finance Department thatthe original certificate or receipt was mutilated,destroyed or lost,anduponthe holder ofsuch original furnishing theCitywithindemnity satisfactory tosaidcollector,anduponthepaymenttothe City bythe holder ofthesumofone dollar ($l.00)for each duplicate license certificate or receipt executed and delivered hereunder. Sec.13-23.Reciprocity. Any person whohas obtained a license byor through examination inany other cityin Dade County,which has requirements similar tothoseinthis code with respect tothe issuance and granting of licenses forthe several businesses or occupations,may,if approved bythe examining boardandwithouttheformalityofanexamination,begranteda certificate orlicenseby reciprocity,upon the payment of the occupational license taxor charges applicable to such business or occupation. Sec.13-24.Schedule of License Taxes. Thevarious businesses,occupations andprofessionswithintheCityarehereby classified forthe purpose of thisordinanceandassessmentsoflicensetaxesthereforareherebyfixedperannum, unlessotherwiseprovidedassetforthinthescheduleattachedheretoandmadeaparthereof, and entitled "Schedule of License Taxes". Sec.13-25.Failure to Obtain License;Delinquencies;Additional Penalties. (a)Anypersonengaginginor managing any business,occupation orprofessionwithoutever havingfirstobtainedalocal occupation license,as required hereunder,shallbesubjecttoa penalty of twenty-five percent (25%)ofthe license determined tobedue,in addition toatwo hundred fiftydollar($250.00)penaltyifan occupational licenseisnotappliedforwithin150 days of notice. (b)Enforcement procedures fornew occupational licenses may commence upontheCity becoming awareofanyperson engaging inor managing any business,occupation or profession withoutfirst obtaining alocaloccupationallicense. (c)Occupational licenses shall be considered delinquent immediately on October 1st of every year.Finesfor delinquent occupational licenses shallbe assessed perSection 13-2;in addition, those licenses not renewed by January 31,shall be subject toa two hundred fifty dollar ($250.00) penalty per occupational license. Any person convicted for violating any of the terms of this chapter shall,upon conviction thereof ina Metropolitan Dade County Court,besentencedtopayafinenot exceeding thesum of five hundred($500.00)Dollarsorserveatermnottoexceed(60)daysorbothsuchfineandsentence, inthediscretionoftheMetrojudge.Eachday's violation ofanyofthetermsofthischapter shallbedeemedandconsideredandisherebyspeciallydeclaredtobeaseparateanddistinct violation of theterms of thischapter,andpunishableassuch. Sec.13-27.Appeals. (a)An appeal totheCity Commission maybefiledwiththeCity Clerk upon aform prescribed bytheCityClerk.Anappealmustbefiledwithinthirty(30)days of theactiontakenwhichis thesubject of theappeal.Anappealmaybefiledbyanyaggrievedperson(s). (b)Anappealstaysallproceedingsinfurtheranceoftheactionappealedfrom,unlessthe officer from whom the appeal is taken ortheCity Manager certifies totheCity Commission, after notice of appeal has been filedwithhim,that because of thefacts stated inthe certificate astay would,inthe officer's ortheCity Manager's opinion,cause imminent peril tolifeor propertyorthatbecausetheviolationchargedistransitoryinnatureastaywouldseriously interfere with enforcement of this chapter. (c)If certification occurs in accordance with subsection (b)above,proceedings may notbe stayed,exceptbya restraining order,whichmaybegrantedbytheCity Commission orbya court of recordonapplication,onnoticetotheofficerfromwhomtheappealis taken ortheCity Manager and on due cause shown. (d)TheCity Commission shallhearandenteradecisiononall appeals within sixty(60)days ofthedateoffilingsaidappeal,andshallprovideduenoticeoftheappealtotheparties. (e)TheCityCommissionmayreverse,affirmormodifyanyorder,requirement,decisionor determinationappealedfromandshallmakeanyorder,requirement,decisionordetermination that,intheCityCommissions'opinion,oughttobemadeinthecircumstances. (f)Whenpracticaldifficultiesorunnecessaryhardshipswouldresultfromcarryingoutthe strictletterofa provision,theCity Commission may,in passing uponappeals,varyormodify anyregulationorprovisionofthischapterrelatingtooccupationallicensetaxes,sothatthespirit ofthischapterisobserved,publicsafetyand welfare secured,andsubstantialjusticedone. (g)TheCityCommissionshallnotberequiredtohearanappealorapplicationpreviously denied if itfinds that there has been no substantial change in conditions or circumstances bearing ontheappealor application. Whenever theCity Manager determines that there isa violation ofany provision ofthis chapter oranyotherapplicableruleorregulation,theCityManagershallgivenotice of suchviolation tothepersonorpersonswhoareresponsibleforeitherobtainingtherequiredoccupationallicense and/or the required occupational licenserenewal.Suchnotice of violation shall: (a)beinaccordancewiththeprovisionssetforthinChapter162ofFloridaStatutes; (b)informthepersontowhomitisdirectedofhisorherrighttoapplyforanappeal hearing before the City Commission;and, (c)instruct the responsible person(s)identified inthe violation to immediately cease and desist all business,occupational,or professional activities on the premises. Sec.13-29.Duties of the City Attorney. TheCityAttorney,uponcomplaintoftheCityManager,oruponhisorherown initiative,shall instituteappropriateactiontorestrain,prevent,enjoin,abateorcorrectanyandallviolations underthischapter,andtotakesuchotherlegalactionasmaybenecessarytocarryouttheterms and provisions of thischapter. Sec.13-30.Recovery of Attorneys'Fees;Court Costs;Administrative Costs;Penalty. Anypersonwhoengagesinanybusiness,occupationorprofessioncoveredbythischapter,who doesnotpaytherequiredoccupationallicensetaxwithin150daysaftertheinitialnoticeoftax due,andwhodoesnotobtaintherequiredoccupationallicenseissubjecttocivilactionsand penalties,includingcourtcosts,reasonableattorneys'fees,administrativecostsincurredasa result of collection efforts,anda penalty upto$250.00.
