AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,AMENDING §20-4.4 (F)OF THE
LAND DEVELOPMENT CODE TO INCREASE DISTANCES FROM OFF-
SITE PARKING TO USES SERVED,TO PERMIT OFF-SITE PARKING IN
RM AND RO DISTRICTS,AND TO REMOVE THE REQUIREMENT FOR
LEASE AGREEMENTS;REPLACING §20-4.4 (G)JOINT USE SPACES;
AMENDING §20-4.4 (H)TO INCREASE THE DISTANCE FROM
METRORAIL STATION TO USES SERVED;CREATING A NEW §20-4.4
(I)TO PROVIDE VALET PARKING FOR HOTELS,HOSPITALS,
OFFICES,RESTAURANTS AND NIGHTCLUBS;CREATING A NEW §
20-4.4 (J)TO PROVIDE PROCEDURES REGARDING THE APPROVAL
OF SHARED PARKING,VALET PARKING AND REDUCED PARKING
IN PROXIMITY TO METRORAIL STATION;AMENDING THE
NUMBERING OF SUBSEQUENT SUB-SECTIONS;AMENDING SECTION
20-5.2 TO ADD A NEW SUBSECTION (14);PROVIDING FOR
RECOMMENDATIONS FROM THE PLANNING BOARD CONCERNING
APPROPRIATE DISTANCE LIMITATIONS AND NIGHTCLUB AND
RESTAURANT SEATING THRESHOLD(S);PROVIDING FOR
SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,theCity of SouthMiamiadoptedaLand Development CodeonOctober
25,1989,via Ordinance No.19-89-1441,including provisions for off-site parking under §
20-4.4,andmorespecifically,LocationandOwnership of Spacesunder§20-4.4 (F),Joint
UseSpacesunder§20-4.4 (G),andMetroRailUsageConsiderationsunder§20-4.4 (H);
and,
WHEREAS,uponreview of theseregulations,Administrationfindsthat§20-4.4 does
not adequately addresslocationandownership of spaces,jointusespaces,MetroRailusage
considerations,valet parkingandspecialparkingprocedures;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:

SECTION 1.That Section 20-4.4 (F)(2)be,and hereby is,amended asfollows:
(F)Location and Ownership of Spaces
(1)All off-street parkingspacesshallbelocatedonthesame lot with the structure oruse
served,except asmaybepermitted below.
(2)Spaces Located Off-Site
(a)Off-site parking spacesshallnotbe permitted in RSr,--RT,RM,and ROr LOr
MO.NR.SR.GR.LH.PRandPIdistricts with provision that if off-street
parkingisadjacenttoresidentialzonedproperties and/or ROzonedproperties,
specialuseprocess would beapplicablefor approval.

Manager Gemmissiefi,afternoticeandhearing.

Method of Calculation

spacesrequiredbySection20-4.4 (B^SpaceRequirements.
Step2,Addtheresults of eachcolumn.The required number of parking spaces shall
equalthe highest column total.
SECTION3.ThatSection 20-4.4 (H)be,andherebyis,amendedasfollows:
(H)MetroRail Usage Considerations viaSpecialParking Permit
Whenalloraportion of aproposedstructureoruseistobelocated within lr500 feetfive
hundred-(S00)-feet of theSouthMiami MetroRail Station,as measured from property lineto
property line,four (4)affirmative votes of theCity Commission may reduce the number of
required off-streetparking spaces forsuchusebyuptofifty(50)percent,depending uponthe
nature andtype of useandits potential user relationship to rapid transit facilities,as provided
for under S 20-4.4 ffl.

SECTION4.ThatSection 20-4.4 (I)be,andherebyis,createdasfollows:
iXX Valet Parking via Special Parking Permit
Upto50%of therequiredparkingforhotels,hospitals,offices,andnightclubs,restaurants
orretailestablishmentsmaybesatisfiedthroughtheprovision of valetparkingspacesvia
specialparkingpermitapprovedbyaffirmativevoteoftheCityCommission.Thenumberof
required parkingspacesthatarenot provided onthesamepropertyastheuseapprovedfor
valetparkingshallbeprovidedviatheoff-siteparkingprovisionsinSection 20-4.4 CF\fl\.or
theCitv Commission mayapprovetheuseofon-streetparkingspacestoprovideforaportion
of orall of the required parkingspaces.
Valet parking,asprovidedinSection 20-4.4 (DT shallnotmakeuse of off-siteparking
locatedadjacenttoresidentialproperty and/or RO zonedpropertyafter7:00 P.M.
Innocaseshallvehiclestackingordoubleparkingbepermittedonpublicrights-of-wayor
publicstreetstosupplytherequiredparkingspacesforthevalet special parkingpermit.
SECTION5.ThatSection 20-4.4 (J)be,andherebyis,createdasfollows:

SpecialParkingPermitsmaybeapproved,disapprovedorapprovedwithconditionsbythe
affirmativevote of fourmembers of theCityCommission.SpecialParkingPermit
proceduresshallfollowthoseproceduresestablishedforSpecialUsePermitsassetforthin
Section 20-5.8,§(B),(C),(D),(E)&(F)andshallfollowthose procedures forPublicHearings
setforthin general in Sections 20-5.1,20-5.2,20-5.3,20-5.4,20-5.5 and 20-5.6.
SECTION6.Section20-5.2 of theLandDevelopmentCodeisamendedtoadd,

SECTION7.ThePlanningBoardisrequestedtorecommend appropriate distancelimitations
andnightclubandrestaurantseatingthreshold(s)fortheproposedordinanceas
itrelatestovaletparking.
SECTION8.Ifanysection,clause,sentence,orphrase of thisordinanceisforanyreason
heldinvalidorunconstitutionalbyacourt of competent jurisdiction,this
holdingshallnotaffectthevalidity of theremainingportions of thisordinance.

SECTION 9.All ordinances or parts of ordinances in conflict withthe provisions of this
ordinance areherebyrepealed.
SECTION 10.This ordinance shall take effect immediately atthetimeof its^passage.
