ORDINANCE NO.
AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
AMENDING SECTION 11-6 OF THE CODE OF ORDINANCES TO
PROVIDE FOR THE SANITIZATION,ODOR ELIMINATION AND
MAINTENANCE OF CONTAINERS FOR STORAGE OFREFUSE;
CREATING SECTION 20-3.6 (R)IN THE LAND DEVELOPMENT CODE
TO FURTHER PROVIDE FOR THE SCREENING AND LANDSCAPING
OF REFUSE ENCLOSURES;PROVIDING FOR ORDINANCES IN
CONFLICT;PROVIDING FOR SEVERABILITY;AND,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS,theCity of SouthMiami regulates thecollection,preparation,
containenzation and storage of refuseasdefinedunderSection 11 of theCity of SouthMiami
Code of Ordinances;
WHEREAS,theregulationscontainedunderSection 11 do not provide for
sanitization,odor elimination and maintenance of containersforstorage of refuse;
WHEREAS,the City of SouthMiamiamendedSection 20-4.6(D)(2)of theLand
Development Code,viaOrdinance #15-92-1510,inordertorequirethescreening of refuse
containersoncommercialand multi-family residentialpropertieswiththefollowing language:
ExposedStorageUtilityareas,Utilitybuildingsandstructuresand similar accessoryareas
andstructuresshallbe subject tosuchplacements,screen plantings or other screening
methodsasshallbe required to prevent theirbeingincongruouswithexisting or contemplated
environment or surrounding property;
WHEREAS,this provision of theLand Development Codedoes not address specific
requirementsforscreeningandlandscaping of refuseenclosuresand refuse containers;and,
WHEREAS,theCity Commission desirestoinclude requirements forsanitization,
odor elimination and maintenance of containersforstorage of refuse and specific
requirementsforthescreeningandlandscaping of refuseenclosuresandcontainersinthe
interest of publichealth,safetyand general welfare;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:

SECTION 1.That Section 11-6 be amended to read as follows:
Sec.11-6.Storing of refuse.
No owner,tenant orlesseeshall permit thestoring of refuse uponhis premises except in
containersasherein approved of sufficient capacitytohold three (3)days accumulation of
refuseinresidentialandcommercialareas of thecityorshall permit refusetobescattered
fromsuchpremisesintothepublicstreetsoralleys of thecity.Whereputresciblewasteis
storedincommercialcontainers,saidcontainersshallbesanitizedbychemicalapplication
aftereachcollectionto prevent odors,or refrigeration techniquesmaybeutilizedto prevent
odors,andthe containers shallbeclosedatalltimes.except when loaded or unloaded.
Commercialcontainersshallbewashedatleasttwicea yearr ormorefrequently:theyshall
berepairedtomaintainsafe,sanitaryandodor-freeconditions.Theareaaroundany
containershallbekeptfree of debrisandlitter.Refuseenclosuresshallbeprovidedper
Section 20-3.6 (K)of theLand Development Code.
SECTION 2.ThatSection 20-3.6 (R)be,andherebyis,createdtoreadasfollows:
(R)Screening and Landscaping of Refuse Enclosures and Containers for the Storage
of Refuse in Commercial and Multi-Family Residential Zoning Districts
Whenplansfornewcommercialormulti-familyresidentialconstruction,orplansfor
anadditiontoanexistingcommercialormulti-familyresidentialstructureandplans
fortherenovation of anexistingcommercialormulti-familyresidentialstructure
wherethecumulativecost of theadditionorrenovationexceedsfiftypercent(50%)of
theassessedvalue of theexistingcommercialormulti-familyresidentialstructureare
submitted,thenallsuchplansshallmakeprovisionsforarefuseenclosureand
containersforstorage of refuseinaccordancewiththefollowingprovisions:
(1)Therefuseenclosureshallbelocatedinthe required rear setbackareaor
requiredsidesetbackarea of theproperty.
(2)Therefuseenclosureshallbeplacedatleastfive(5)feetfromanyproperty
line,butnotwithinanytriangle of visibilityorutilityeasement.
(3)The refuse enclosureshallbelocatedsuchthat garbage ortrashtruckswillnot
blocktheintersections of streetsoralleyswhileservicingcontainers.
(4)Therefuse enclosure shallconsistof:(a)aconcretepador impervious pavers
asabase which is designed to prevent seepage of any sanitizing chemical or
liquidwasteintothegroundorintoanystormwaterdrainagesystem;(b)
minimumfive(5)foothighenclosurewalls;theheight of wallsmustbeequal
toor greater thanthe contemplated height of refuse containers;and,(c)an
accessgatewhichscreensallrefusecontainersfromview;theheight of gates
mustbeequaltoorgreaterthanthecontemplatedheight of refusecontainers.

(5)An impervious surface shallbe provided between the enclosure and street or
alley from which the containers willbe serviced,andshallbe maintained in
good condition.
(6)Landscaping,hedges andtreesshallbe provided asset forth in Section 20-4.5
Landscaping Requirements inthesame manner as prescribed for vehicular use
areas,andshall constitute a landscape buffer of at least 5feetin width.
(7)Plans may include a refuse container roominlieu of a refuse enclosure
provided that the container room(a)shallbe located onthe rear orside of
structure,(b)shallbeeasily accessible for servicing,and(c)shallbefully
enclosed and include doorswhichmaybe secured and locked to prevent
vandalism or other damage.
(8)Refuse container rooms and refuse enclosures shallbe subject to review and
approval byboththe Director of Building,Zoning &Community Development
andthe Director of Public Works prior to permit approval.
SECTION 3.Ifanysection,clause,sentence,orphrase of this ordinance isforanyreason
held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnot
affectthevalidity of the remaining portions of this ordinance.
SECTION 4.All ordinances or parts of ordinances in conflict withthe provisions of this
ordinance are hereby repealed.
SECTION5.Thisordinanceshalltakeeffectimmediatelyat
