AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI,FLORIDA AMENDING PARAGRAPH 20-3.6(H)OF
THE LAND DEVELOPMENT CODE,PROVIDING FOR REGULATION OF
THE HEIGHT OF PHYSICAL BARRIERS,TO INCLUDE THE TERM
"GATES,"TO INCREASE THE ALLOWABLE HEIGHT OF PHYSICAL
BARRIERS BETWEEN VERTICAL SUPPORTS FROM TWO (2)FEET TO
THREE (3)FEET;PROVIDING FOR SEVERABILITY;PROVIDING FOR
ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City of South Miami enacted a Land Development
Codewhich,in paragraph 20-3.6(H),regulates the height of
physical barriers;
WHEREAS,term "physical barriers"includes fences,wall,
trellises and hedges,but inadvertently omits reference to"gates";
WHEREAS,theheightofphysicalbarriersinresidential
districtsislimitedtofour (4)feetabovegradeforthefirst
tier,andtoanadditionaltwo (2)feetforthesecondtier;and
Whereas,theMayorandtheCity Commission findthatitis
desirabletoinclude"gates"withinthesection,toincreasethe
allowableheightofthesecondtierfromtwo (2)feettothree (3)
feet.
NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR ANDCITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Thatparagraph 20-3.6(H)oftheLand Development
Code is amended to read:
(H)Physical Barriers
(1)All fences,walls,trellises,and hedges may
be erected onor along a property line,but
shall not extend into official public rights-
of-way or project onorover adjacent
properties.
(2)Height Limit
Residential
(a)no change
(b)no change
(c)Inrequiredyardsadjacenttoa right-of-way
fences,walls,trellises,gates and hedges
shall not exceed four (4)feetin height above
grade.Fencesandwallsmaybeincreasedbytwo
(2)feetin height abovegradeandgatesmaybe
increasedbythree (3)feetabovegradeprovided
that the upper two (2)feetof the fence and
wall surface andthe upper three (3)feetof the gate
betweenverticalsupportsisdesignedasauniform
patternwithaminimumofsixty (60)percentopen area.
Section 2.Ifany section,clause,sentence or phrase of this
ordinance is held to be invalid or unconstitutional by any court
ofcompetent jurisdiction,theholdingshallinnowayaffectthe
validityoftheremainingportionsofthis ordinance.
Section 3.Allordinancesorpartsof ordinances in conflict
herewith be and the same are hereby repealed.

Section 4.This ordinance shall take effect immediately at
the time of its passage.
