No. 17-93-1543ORDINANCE NO.17-93-1543 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,DIRECTING THE CITY CLERK TO SUBMIT TO THE ELECTORATE AT THE MUNICIPAL ELECTION OF FEBRUARY,.1994 THE QUESTION OF WHETHER TO AMEND ARTICLE II,SECTION 6B(3)OF THE CHARTER OF THE CITY OF SOUTH MIAMI BY REQUIRING READING ONLY THE TITLE OF ORDINANCES. WHEREAS,the Charter of the City of South Miami,Florida currently provides in Article II,Section 6B(3):"Each ordinance shall be read in its entirety on both of the first and second readings;"and WHEREAS,Florida Statute 166.041 (3)(a)provides: Except as provided in paragraph (c)(i.e. zoning ordinances),a proposed ordinance may be read by title,orin full,on at least two separate days and shall,at least ten days prior to adoption,be noticed once ina newspaper of general circulation in the municipality.";and WHEREAS,the Mayor and City Commission wish to submit a Charter Amendment which would require reading only the title of ordinances to the electorate at the Municipal Election in February, 1994. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That a separate ballot question in the February, 1994 Municipal Election appear in substantially the following form: Shall Article II,Section 6B(3)of the Charter of City of South Miami be amended to require reading of only the title of ordinances? Yes No Section 2.That the City Clerk is hereby directed to prepare the aforesaid ballot question in conjunction with the Dade County, Supervisor of Elections in accord with all applicable State,County and City election laws.
