AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI,FLORIDA;AMENDING SECTION 20-3.5 G OF THE
LAND DEVELOPMENT CODE OF THE CITY OF SOUTH MIAMI TO
PROVIDE AN EXEMPTION FOR COLUMNS IN THE FRONT SET BACK IN
THE "MO"MEDIUM OFFICE ZONING DISTRICT;PROVIDING FOR
SEVERABILITY;PROVIDING FOR ORDINANCE IN CONFLICT;AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City of South Miami heretofore enacted a Land
Development Codeon October 25,1989,which Codein Section 20-3.5
G provides for the required front set-back in each zoning district;
and
WHEREAS,the present front set-back for the "MO"(medium
intensity office zoning districtprovides for no exceptions from
the requirement;and
WHEREAS,the Mayor and City Commission believe columns should
be permitted within on the first floor in the "MO"Zoning District,
because columns are both non-intrusive and allow for a colonnade
effect;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That Section 20-3.5 G of the Land Development Code
of the City of South Miami,Florida be,and hereby is,amended to
addto the front setback requirement for the MO Zoning District,
following the existing note "applies to ground floor only":
;columns are permitted within the set-back.
Section 2.If any section,clause,sentence,or phrase of
this Ordinance is held to be invalid or unconstitutional by any
court of competent jurisdiction,then said holding shall in no way
affect the validity of the remaining portions of this Ordinance.
Section 3.All ordinances or part of ordinances in conflict
herewith be,and the same hereby are,repealed.
Section 4.This Ordinance shall take effect immediately at
the time ofits passage.

PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN

ANALYSIS
The City Commission wishes to revise the Land Development Code in
ordertoallowcolumnsintherequiredfrontsetbackfortheMO
"Medium-Intensity Office"Zoning District.Thisfrontsetbackis
fifteen feet and is a requirement for the first floor only in this
district.A four-story maximum height is permitted for structures.
Floors above the first may extend tothe front property line.The
purpose of the required set back onthe ground floor is to provide
a protected pedestrian space along the street front of buildings.
The proposed changes to this provision would still provide for a
pedestrian space onthe ground floor along the street front of the
building,butwouldalsopermitcolumnsin the setbackinorderto
support floors aboveandtoprovideimprovedaesthetic conditions
by allowing columns,colonnades and arcades for such buildings.
