No. 02-93-1530AORDINANCE NO.9-Q^-i^nA AN ORDINANCE OFTHEMAYORANDCITY COMMISSION OPTHE CITYOFSOUTHMIAMI,FLORIDA;AUTHORIZING THECITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE METROPOLITAN DADE COUNTY STORMWATER UTILITY FOR ALL CANAL CLEANING AND MAINTENANCE OF ALL PUBLICLY OWNED CANALSWITHINTHE BOUNDARIES OFTHECITYOFSOUTH MIAMI,WHICH AGREEMENT PROVIDES FOR EACH EQUIVILANT RESIDENTIAL UNIT IN THE CITY TOBE CHARGED $7.50 QUARTERLYTOFUNDTHECOSTOF CANAL/STORMWATER MAINTENANCE;PROVIDINGFOR REIMBURSEMENT OF CLEANING/MAINTENANCE OF CITY CANALS/CANAL BANKS DURING 1991-92;PROVIDING FOR SEVERABILITY;PROVIDINGFOR ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the City has 2.888 miles of canals;and 5.776 miles of canal banks;and WHEREAS,Dade County no longer funds maintenance of said canals fromthe County General Fund;and WHEREAS,Dade County has created the stormwater utility agency to promote intergovernmental cooperation to effectively andefficientlymanagestormwater run-off;and WHEREAS,the canal system is an important element of the total stormwater management system;and WHEREAS,the Federal Government has mandated all local governments create a stormwater management system;and WHEREAS,theCityofSouth Miami haspreviouslysignedan interlocal agreement with Dade County for stormwater management; and WHEREAS,theattached interlocal agreementwill provide the City with both canal maintenance and the mechanism to fund this needed work on an annual basis;and WHEREAS,theCity's1992-93Budgetincludesdrainage projectstobefundedfromthesource described above. NOW,THEREFORE,BE IT ORDAINED BYTHEMAYORAND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That the City Manager be authorized to executed the attached interlocal agreement. Section 2.That any Dade County claim for funds for the 1991-92 fiscal year will not be a part of this interlocal agreement. Section 3.That Dade County will not withhold any funds for South Miami projects if said withholding is related to the 1991- 92fiscalyear. Section 4.That the City authorizes the County to deduct S 2,800.00 per year during each year of the five year term (for a total of $14,000.00)from the Storm Water Utility Fund due the City by the Dade County Storm Water Utility,said deduction being a reimbursement throught the Dade County Storm Water Utility for cleaning and maintenance of City canals and canal banks during the 1991 -92 fiscal year. SeCti°n 5-The ^itial rate per equivilant residential unit is hereby established at $7.50 per quarter for the first year of the Interlocal Agreement. SeCti°n 6'If an*action,clause,sentence,or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction,then said holding shall in no way affect the validity of the remaining portions of this Ordinance. SeCtl°"7-AU Ordinances or parts of Ordinances in conflict herewith be,and the same hereby are,repealed. SeCti°"8-This O^inance shall take effect immediately at the time of its passage.
