AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA AUTHORIZING THE SALE OF A
PORTION OF THE "OLD SOUTH MIAMI PLANT NURSERY"LEGALLY
DESCRIBED HEREINBELOW TO HABITAT FOR HUMANITY INC.FOR
THE SUM OF S 1.00 UPON THE BASIS THAT THE SAID LAND IS
NOT PRESENTLY SERVING ANY PUBLIC PURPOSE;THAT QUALITY
LOW COST HOUSING IS NEEDED IN THE CITY OF SOUTH MIAMI,
FLORIDA;AND THAT HABITAT FOR HUMANITY HAS A PROVEN
RECORD OF PROVIDING QUALITY LOW COST HOUSING;PROVIDING
FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City of South Miami,Florida is the owner of
the premises commonly known astheOld South Miami Plant Nursery,
legally described hereinbelow and hereinafter called the
"premises";and
WHEREAS,the City of South Miami has not utilized the
premises for some time,nor does it appear feasible to utilize
the premises for any public purpose inthe future;and
WHEREAS,the Mayor and City Commission find that there isa
need for quality low cost housing in the City and that Habitat
for Humanity Inc.,a non-profit corporation,hasa proven record
of providing such housing to persons who become homeowners,and
therefore maintain the premises and pay ad valorem taxes to the
City;;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That the City Administration be,and hereby is,
authorized tosellto Habitat for Humanity Inc.theOldSouth
Miami Plant Nursery,legally described as follows:
South25.86feetofLot116,University Park,Plat
Book18atpage46ofthe public records ofDade
County,Florida;and
Lot117,University Park,PlatBook18atpage46of
thepublic records ofDadeCounty,Florida;
for thesumof$1.00.Saidpremisestobesold"asis",withno
warranties,andwithadeedreverterclauserequiringnewsingle
family housing according to City of South Miami Code Standards to
be build within a period of eight months from the execution of
the Deed .
Section 2.If any section,clause,sentence,or phrase of
this Ordinance is held tobe invalid or unconstitutional by any
court of competent jurisdiction,then said holding shall inno
way affect the validity of the remaining portions of this
Ordinance.
Section 3.All Ordinances or parts of Ordinances in
conflict herewith beandthesameare hereby repealed.
Section 4.This Ordinance shall take effectimmediatelyat
the time ofits passage.
