AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH
MIAMI,FLORIDA,EXTENDING THE PROVISIONS OF ORDINANCE NO.14-92-
150^1ADOPTED BY THE SOUTH MIAMI CITY COMMISSION ON AUGUST 25,1992,
AS AN EMERGENCY ORDINANCE FOR AN ADDITIONAL THIRTY (30)DAY PERIOD,
UNTIL NOVEMBER 25,1992,WHICH ORDINANCE PROVIDES FOR THE IMMEDIATE
ISSUANCE OF PERMITS FOR THOSE APPLYING FORE PERMITS TO MAKE
NECESSARY BUILDING,PLUMBING,ELECTRICAL AND/OR ROOFING REPAIRS TO
THEIR HOMES AND BUSINESSES IN THE CITY;WAIVING PERMIT FEES AND
ENVIRONMENTAL REVIEW AND PRESERVATION BOARD FEES FOR THE PERIOD OF
THIRTY DAYS FROM THE DATE OF PASSAGE OF THIS ORDINANCE;WAIVING
PROVISIONS OF THE CITY OF SOUTH MIAMI TREE ORDINANCE FOR THOSE
TREES DAMAGED OR UPROOTED BY HURRICANE ANDREW TO ALLOW RESIDENTS
AND BUSINESS PEOPLE TO REMOVE TREES AND URGING THAT REPLACEMENT
TREES BE PLANTED IN AN ATTEMPT TO RECOVER THE TREES AND CANOPY THAT
THE CITY HAS BEEN KNOW FOR AN THAT HAS MADE SOUTH MIAMI THE CITY OF
PLEASANT LIVING;PROVIDING FOR THIS ORDINANCE TO BE PASSED ASAN
EMERGENCY ORDINANCE AND THEREBY DISPENSING WITH THE REQUIREMENT FOR
TWO READINGS AND PUBLIC HEARING IN VIEW OF A PUBLIC EMERGENCY
AFFECTING LIFE,SAFETY,HEALTH,PROPERTY OR THE PUBLIC PEACE OF THE
CITY.
WHEREAS,on August 24th,1992,Hurricane Andrew swept through
South Florida causing devastating damage to homes and businesses;
and
WHEREAS,on August 25th,1992,the Mayor of the City of South
Miami called an emergency meeting ofthe City Commission at which
time Ordinance No.14-92-1509 was passed and adopted providing for
immediate issuance of permits for necessary repairs,waiving
specific permit fees,sanitationchargesand provisions ofthe
South Miami Tree Ordinance for a period of thirty (30)days from
that date of passage;and
WHEREAS,on September 29,1992,theCity Commission extended
the provisions ofthisOrdinanceuntilOctober25th,1992;and
WHEREAS,itisthedesireoftheMayorandCity Commission of
theCityofSouth Miami,Florida,toextendtheprovisionsofthat
emergencyordinanceforaperiodofanadditionalthirty (30)days
until November 25th,1992.
NOW,THEREFORE,BEIT ORDAINED BY THE MAYOR ANDCITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That Ordinance No.14-92-1509,providing for
immediateissuanceofpermitsfornecessary building,plumbing,
electrical and/or roofing repairs totheirhomesand businesses in
the City;waivingpermitfeesandEnvironmentalReviewand
Preservation Board fees for the period of thirty days from August
25th,1992,to September 25th,1992,and then extended foran
additional thirty (30)day period from September 25th,1992,to
October 25th,1992;waiving provisionsoftheSouthMiamiTree
Ordinance for those trees damaged or uprooted by Hurricane Andrew
to allow residents and business people to remove trees and urging
that replacement trees be planted inan attempt to recover the
trees and canopy that the City has been known for an that has made
South Miami the City of Pleasant Living,be and the same is hereby
further extended for an addition thirty (30)day period until
November 25th,1992.
Section 2.That,pursuant to Charter provisions under Article
II,Section 6,"Ordinances",D(3),this ordinance is to meet a
public emergency affecting life,safety,health,property or the
public peace and requirements fora section reading and public
hearing are hereby dispensed with in view of the emergency.
