Ord No 21-92-1516ORDINANCE NO.21-921516 XN ORDINANCE OP THE MAYOR AND CITY COMMISSION OP THE CITY OF SOUTH MIAMI,FLORIDA ABANDONING THAT ALLEY COMMONLY KNOWN AS 63RD STREET ALLEY AND LEGALLY DESCRIBED HEREINBELOW;PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the City Commission has the power to vacate, abandon,discontinueandclosean existing publicorprivate street,alley-way,road,highway or other"place used tor travel orany portion thereof,other than a state or federal highway, andto renounce and disclaim any right ofthe City and the public in and to any land in connection therewith;and WHEREAS,the Administration has recommended the vacating of that alley commonly known as 63rd Street Alley and legally described in the attached Exhibit "A",as the said alley presently serves no public purpose tothe City andwill,upon its reversion to the adjacent property owners,constitute additional ad valorem tax revenues to the City;and WHEREAS,therefore,on July 28,1992,a public hearing was setfor September 1,1992 at 7:30 P.M.oras soon thereafter as maybe heard and notice thereof was published ina newspaper of general circulation in Dade County at least two weeks prior to the date stated therein for such hearing;and WHEREAS,the City Commission has now completed the public hearing; NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Thatthe alley commonly knownas63rdStreet Alleyand legally described ~fcn the attached Exhibit "A"within the City ofSouthMiamibe,andthe same hereby is,abandoned, renounced,and disclaimed by the City of South Miami and shall, pursuant to the plat creating that alley,revert to the ownership of the immediately adjacent properties. 3£ctign_l.Noticeofthe adoption ofthis Ordinance bythe Commission shall be published one time,,within 30days following. its adoption,inoneissueofa newspaper of general circulation publishedinDadeCounty.Theproofof publication ofnoticeof public hearing,the Ordinance as adopted,andthe proof of publication ofthenoticeofthe adoption ofsuchOrdinanceshall be recorded in the deed recordsofDade County. Section 3.If any section,clause,sentence,or phrase of this Ordinance is held to be invalid or Unconstitutional by any court o£competent jurisdiction,thensaidholdingshallinno way affect the validity ofthe remaining portions ofthis Ordinance. Section 4.All Ordinances orpartsof Ordinances in conflict herewith be and the samearehereby repealed. Section 5.This Ordinance shall take effect immediately at the time ofits passage.
