AN ORDINANCE OP THE MAYOR AND CITY COMMISSION OP THE
CITY OF SOUTH MIAMI,FLORIDA,AMENDING ORDINANCE 5-91-
1470 BY PROVIDING A PERIOD OF SEVEN CALENDAR DAYS FOR
PERSONS WHO HAVE FAILED TO EVER OBTAIN AN OCCUPATIONAL
LICENSE TO OBTAIN SUCH LICENSE WITHOUT INCURRING A
FINE;PROVIDING FORSEVERABILITY;PROVIDING FOR
ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS,by Ordinance first enacted in 1948,theCityof
South Miami,Floridarequiredoccupationallicenses;and
WHEREAS,thereafter in Ordinance 5-91-1470,theCityof
SouthMiamiimposeda$300.00fineforthosepersonswhohave
failed toeverobtainan occupational license (as comparedto
personswhose license hasnotbeen timely renewed);
WHEREAS,the Mayor and Commission now wish to amend the
Ordinances by providing a grace periodofsevencalendardays
from the date of notification of the failure to obtain such
occupationallicensewithinwhichthe person whohasfailedto
obtainsuchlicensemayobtainitwithout fine;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Sub-Section 25a)of Ordinance 5-91-1470 be,and
hereby is,amended to read as follows:
Anypersonengaginginormanaginganybusiness,
occupationorprofessionwithouteverhavingfirst
obtained a local occupational license,ifrequired
hereunder,shallbesubjecttoapenaltyoftwenty-five
percent(25%)ofthelicense determined tobedue,in
additiontoanyotherpenaltyprovidedbylawor
ordinance.
Section 2.If any section,clause,sentence,or phrase of
this Ordinance is held to be invalid or unconstitutional byany
court of competent jurisdiction,thensaid holding shall in no
way affect the validity of the remaining portions of this
Ordinance.
Section 3.All Ordinances or parts of Ordinances in
conflict herewith be and the same are hereby repealed.
Section 4.This Ordinance shall take effect immediately at
the time ofits passage.
