A Resolution of the South Miami Commission of the City of South Miami, Florida, calling on Florida Governor Rick Scott, State Senate President Andy Gardiner, and State Speaker of the House Steve Crisafulli to enact a bill to install embedded, in-road, solar-powered, marker lights in or within a 1-mile radius of an urban area in conjunction with the construction, reconstruction, or other change of any state transportation facility. In 2013, most bicyclist fatalities in the US occurred between 4 PM and Midnight (48 percent) and 68 percent in urban areas. Bicyclists in the US accounted for 2.35 percent of all traffic fatalities and approximately 48,000 bicyclists were injured in 2013. In 2013, 743 people lost their lives in bicycle/motor vehicle crashes, or two people every day of the year in the US. 83 percent of bicyclists in the US surveyed said they felt threatened for their personal safety during their rides by motorists. 68 percent of bicyclists fatalities in the US occurred in urban areas. 57 percent of bicyclists fatalities in the US occurred at non-intersections. In 2013, the State of Florida ranked first in the nation with the highest rate of bicyclist fatalities with 5.5 percent of all total traffic fatalities, compared to the national percentage of 2.35 percent. In 2012, the National Safety Council (NSC) estimated that the bicycle fatality crash cost to SOciety is $3.3 billion and the bicycle injury cost to society is $2.9 billion. Furthermore, many costal roads in the State of Florida are required to turn off street lights during turtle nesting season (March thru October). Embedded, In-Road Solar Marker Lights will provide a bike lane lighting source during the turtle season and throughout the year. Public agencies are required to maintain minimum reflectivity of longitudinal pavement markings unless continuous lighting assures that the markings are clearly visible at night. When Embedded, In-Road Solar Markers (RRPMs) supplement or substitute for longitudinal lines, minimum pavement retro reflectivity levels are not applicable. Embedded, In-Road Solar Markers Lights are approved by the Florida Department of Transportation (FOOT) as an Internally IIlumir:1!1ted Raised Pavement Markers (II RPM). Embedded, In-Road Solar Marker Lights are economical and easy to install with zero maintenance. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1: The City of South Miami calls on Florida Governor Rick Scott, State Senate President Andy Gardiner and State House Speaker Steve Crisafulli to require, in conjunction with the construction, reconstruction, or other change of any state transportation facility, the installation of embedded, in-road, solar-powered marker lights for bicycle ways located in, and within I-mile of, all urban areas. Section 2: Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 3. Effective Date. This resolution shall become effective immediately upon adoption by vote of the City Commission. PASSED AND ADOPTED this __ day of _____ , 2016.
