FROM: Dwayne Williams, Planning Director SUBIECT: An Ordinance amending the City of South Miami Land Development Code, Article II, "Definitions," Sect,ion 20-2.3, "Definitions," to add definitions for "Variety Retail" and "Retail Outlet -Off-Price Retail," and Article VII, "Hometown District Overlay Ordinance," Section 20-7.12, Permitted Uses," to provide that such uses shall not be permitted in the Hometown District Overlay. BACKGROUND: While the City has a traditional and economically vibrant downtown area known as the Hometown District, it is has been found that retail establishments that sell mostly or regularly discounted products including outlet stores, off-price retail, variety stores, etc. tend to offer substantial discounts on products with value pricing or everyday low prices that can adversely affect the economic viability and aesthetics of a traditional downtown commercial area. Even though these types of establishments offer a value and valuable product to consumers, it is necessary to the economic viability of the City's traditional downtown to redirect such establishments to other parts of the City. PLANNING BOARD ACTION: At the October 13, 2015 public hearing the Planning Board motioned to deny the ordinance as written to the Commission with a vote of 6 to 0, and a recommendation to the Commission for the ordinance. to permit the land uses as a Special Use regulation. The boards reasoning for a Special Use regulation was to establish a case by case review as to compatibility of proposed retail uses. STAFF RECOMMENDATION: Staff recommenqs Commission approval of the ordinance as written without the regulatory inclusion of a special use condition. Variety stores will remain 'a permitted use in the General Retail, TODD~MU 4, TODD-MU 5, and TODD-LJ zoning districts. The South Miami Land Development Code, Article II, "Defmitions," Section 20-2.3, "Definitions," is hereby amended and shall read as follows: () (J l) () 1 2 * * * 3 Retail Outlet -Off-Price Retail. Shall mean a retail outlet store that regularly sells 4 over produced or irregular merchandise, including but not limited to household and 5 clothing goods, directly to the consumer at prices that are generally lower than the 6 regular everyday retail prices of department and specialty stores. The store 7 merchandise is generally purchased by the store from a wholesaler, or the store can be 8 owned by the manufacturer for the purposes of selling over-produced or irregular 9 merchandise at discount prices. This category may include but is not limited to outlet 10 stores, close-out retailers, discount stores, dollar store, or value shop, with products at 11 substantial discounts, value pricing, or everyday low prices. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 * * * Varietv Retail. Shall mean a retail store that sells a wide range of inexpensive household and clothing goods. Variety stores often have product lines including food and drink, personal hygiene products, small home and garden tools, office supplies, decorations, electronics, garden plants, toys, pet supplies, remaindered books, recorded media, and motor and bike consumables. Larger stores may sell frozen foods and fresh produce. A variety store may sell all goods at a single price, in which case it may be called a price-point retailer. This category may include but is not limited to outlet stores, close-out retailers, discount stores, dollar store, or value shop, with products at substantial discounts, value pricing, or everyday low prices. * * * 27 Section 2. The South Miami Land Development Code, Article VII, "Hometown 28 DistrictOverlay Ordinance," Section 20-7.12, Permitted Uses," is hereby amended and 29 shall read as follows: 30 31 20-7 .12 -Permitted uses. 32 The uses below are applicable to both new and existing buildings in the Hometown 33 District: USE TYPE: Unadjusted Parking Requirements: I ~ 1 parking space required per: A. Outdoor dining is permitted of 5 right in special pre-approved areas (see Regulating Plan). 6 In addition to the uses above, monumental civic building uses are encouraged in the 7 Hometown District and in particular for certain strategically located sites. Civic building 8 uses shall include, for el'ample: City, county, state, or federal buildings, including library, 9 post office, meeting hall, administrative offices, performance place, police substation, 10 and similar uses. 11 (D) Planned Unit Developments, Variety Retail, and Retail Outlet -Off-Price Retail uses (. __ ) 12 shall not be permitted in the Hometown District. , 13 * * * 14 Section 3. If any section, clause, sentence, or phrase of this 18 ordinance is for any reason held invalid or unconstitutional by a court of competent 19 jurisdiction, this holding shall not affect the validity of the remaining portions of this 20 ordinance or the Guidelines adopted hereunder. 21 22 Section 5. (a) Cb) (c) Cd) (e) If) (g) (h) ti) The board of trustees shall be comprised of seven (7) members consisting of the two (2) active employees orthe city elected by participants of the plan, two (2) citizen ofthe city, two (2) individuals with financial backgrounds and the appointment of one (I) active employee of the city designated by the city manager, all to be appointed by the mayor with the advice and consent of the city commission. No board of trustee member shall receive any compensation or emolument for services on the pension board. The board members shall each serve for a period of two (2) years, or tmtil their successors are appointed, which appointment shall be evidenced by an acceptance in writing of such appointment. A member ofihe pension board may resign by delivering a written resignation to the city clerk, and such resignation shall become effective upon its delivery or at a later date specified therein. If, at any time there shall be a vacancy in the membership ofthe board, provided there are not less than five (5) members, the board shall continue to act until such vacal1CY is filled as provided above. The board shall hold meetings upon such notice, at city hall, and at such times as its members may from time to time determine but in no event Jess than once each calendar quarter. A majority of the members of the board at the time in office shall constitute a quorum for the transaction of business. All action taken by the board at any meeting shall be by vote of the majority of its members present at such meeting. Subject to the tenns of this plan, the pension board shall from time to time adopt bylaws, rules and regulations for the administration of the plan and the conduct and transaction of its business and affairs. The pension board shall have such powers as may be necessary to discharge its duties hereunder; including but not limited to, the power to interpret and construe the plan, to determine all questions of eligibility for benefits, duration of employment, computation of benefits, value of benefits and similarly related matters for the purposes of the plan, and the pension board's determination of all questions arising under this plan shall be conclusive and binding upon all employees, retired employees, participants and all other persons. No member of the pension board shall be precluded from becoming a participant under this plan if otherwise eligible. The board shall keep accurate records and minutes of its proceedings and actions. The pension board shall prepare annually a repoti showing in reasonable detail and account of the operations for the preceding year, as required by section 112.63 and 185.221 and shall deliver a copy within sixty (60) days thereof to the city commission. The pension board shall also file with the appropriate governmental bodies all necessary fonns and documents that must be furnished in accordance with applicable law. The board shall, from time to time, issue written instructions to the insurance company, if applicable with respect to the pensions and other benefits to be provided pursuant to this plan. The board may authorize one or more of its members to sign on its behalf any document relating to the administration of this plan. Except for gross negligence or willful breach ofthe terms of this plan, no member of the pension board shall incur any individual liability for any action or failure to act pursuant to the terms of this plan. No member of the pension board shall be liable for the acts of any other member of the pension board. The members of the pension board may engage agents, to include consultants, custodians, actuaries, accountants, auditors and investment managers to assist them in their duties and may consult with counsel who may be an independent counselor who may be counsel to the employer. TIle members ofthe pension board shall be relieved of all responsibility whatsoever for anything done or not done upon the written advice of counsel. . The members of the pension board may inspect the records of the employer whenever such inspection shall be reasonably necessary in order to determine any fact peliinent to the perfonnance oftheiI' duties under this plan. The (k) (I) members of the pension board, however, shall not be required to make such inspection, but in good faith'may rely on any statement of the employer or any of its officials or authorized employees. The board shall identify and publicly report any direct or indirect holdings it may have in any scrutinized company, as defined in F.S. § 215.473. and proceed to sell, redeem, divest, or withdraw all publicly traded securities it may have in such company beginning January I, 2010, and shall thereafter be prohibited from purchasing or holding such securities. The divestiture of any such security must be completed by September 30, 2010. In accordance with Ch. 2009-97, Laws of Florida, no person may bring any civil, criminal, or administrative action against the board or any employee, officer, director, or advisor of such board based upon the divestiture of any security pursuant to this paragraph.
