A Resolution for special use approval to permit an animal hospital /
veterinarian at 6396 S.Dixie Highway.
WHEREAS,pursuant to Section 20-3.4(B)(4)(b)of the Land Development Code (LDC),
the applicant,Southeast Veterinary Referral Center submitted Application No.PB-15-040 tothe
Planning Board requesting a Special Use Approval to operate an animal hospital /veterinarian at
6396S.Dixie Highway,within the General Retail "GR"zoning district;and
WHEREAS,animal hospitals /veterinarians are permitted asa special use within the
General Retail "GR"zoning district pursuant tothe Permitted Uses,Section 20-3.3(D)of the
Land Development Code (LDC)andsubjectto meeting special use requirements setforthin
Special Use Conditions Section 20-3.4 of theLDC;and
WHEREAS,the applicant's general restaurant special use meets the special use
requirements set forth in LDC Section 20-3.4(B)(21)which are:
i.All such usesshallbe located within afully enclosed,air-conditioned,soundproof
structure.
ii.There shall beno overnight boarding of animals except for medical purposes.
iii.The hours of operation forvisitsand treatment willbe7:00a.m.to9:00p.m.
Monday through Saturday;hours of operation shallnot prevent emergency medical
treatment.
WHEREAS,the approval of aspecialuse requires a recommendation fromthe Planning
Boardandthe approval of theCity Commission aftera public hearing;and
WHEREAS,atthe December 8,2015 Planning Board meeting,and following a public
hearing,the Board reviewed application PB-15-040 and voted 7ayes,0naysto recommended
approval of the request fora special useto permit an animal hospital /veterinarian;and
WHEREAS,theCity Commission desirestoacceptthe recommendation of the Planning
Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:

subject to approval by the ERPB

Director in the future,tobe adversely affecting the health or safety of persons
residing or working inthe vicinity of the proposed use,ortobe detrimental tothe
publicwelfareorpropertyorimprovementsinthe neighborhood,ornotbein
compliancewithotherapplicableCodeprovisions,thespecialuseapprovalmaybe
modified or revoked bytheCity Commission upon notification anda public hearing.
Section 2.Severability.If any section clause,sentence,or phrase of this resolution isfor
any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3.Effective Date.This resolution shall become effective immediately upon
adoption by vote of theCity Commission.

Background:
Located in the General Retail "GR"zoning district,the applicant is proposing internal
renovations located at 6396 S.DixieHighway.The one-story building currently has two
separate spaces,both ofwhich are currently occupiedby Southeast Veterinary ReferralCenter.
One side,6394 S.DixieHighway,is occupied by the animal hospital,whichwas previously
approved byResolution#04-07-12389.The other side,6396S.Dixie Highway,was recently
vacated by Enterprise Rent-A-Car and is currently occupiedbyoffices for the veterinary
hospital.The applicant is proposing to combine both spaces into one space to include
additional offices and examination rooms.
Subject Building located 6396 S.Dixie Highway
Pursuant tothe regulations listed inthe Permitted Uses,Section 20-3.3(D)ofthe Land
Development Code (LDC),a special use permit is required forthe operation ofan animal
hospitalor veterinary.
Analysis:
Pursuant tothe Special Use Conditions,Section 20-3.4 ofthe LDC,a special usemaybe
approved and permitted by the city commission ata public hearing,after a recommendation by
the planning board and that such use complies with the general requirements,special
requirements,andanyother conditions thatthe city commission may consider appropriateand
necessary.*v
When reviewing the project,the following items are noted aboutthe project:
•The space is currently occupied bythe applicant for administrative purposes
•Thesquarefootageofthe building will notbe changed astheseareinternalrenovations.
•Once redeveloped,theveterinaryuse will increase by800squarefeetfrom2,600to
3,400 square feet.
Pursuant tothe information provided,the minimum amountof parking spaces required forthe
proposed project is as follows:

Based onthe calculations listed above,the proposed animal hospital /veterinary will be
required to provide a minimum of nine (9)parking spaces where twenty-four (24)parking
spaces are provided.
After review oftheproject,theproposed animal hospital /veterinary use complies with both
thegeneraland special requirements listed inboth Section 20-3.4(A)and Section 20-3.4(B)(21)
andof the LDC,respectively,in that the use:
•Iscompatibleandcomplementarytotheexistinguseswithin the surroundingareas;and
•Isprovidingfully enclosed,air-conditioned,soundproof structure.
•Will not provide overnight boarding of animals except for medical purposes.
•Will operatefor visits and treatments between 7:00am to 9:00pm,Monday through
Saturday;hoursof operations shallnot prevent emergency treatment.
Furthermore,the requested specialusedoesnotconflictwith the Comprehensive Planand
complies with the LDC requirements set forthinSection 20-5.8(B)of the LDC in that the use:
a)Will not adversely affect the health or safety of persons residing or working in the vicinity
of the proposed use,
b)Willnotbe detrimental to the public welfare or property or improvements in the
neighborhood;and,
c)Complies with all other applicable Code provisions.
Last,if the special use is,in the future,determined by the Director of Planning,to be adversely
affecting the healthor safety of personsresidingorworkingin the vicinity of the proposeduse,
tobe detrimental to the public welfare or property or improvements in the neighborhood,orto
benotincompliancewith other applicableCode provisions,the specialuseapprovalmaybe
modified or revoked by the City Commission upon notification andpublic hearing.
Planning Board Action:
At the December 8,2015PlanningBoard meeting andfollowingapublichearing,the Board
voted7-0to recommend approval of the requestforaspecialusetopermitan animal /
veterinarian.
Staff Recommendation:
Staff recommends approval by the City Commission.

WHEREAS,pursuant to section 20-3.3(D)ofthe Land Development Code applicants Miguel
Cervoni and Teresita Carro have fiJed Application No.PB-06-038 requesting a Special Use Approval to
operate an animal hospital at6394S.Dixie Highway;and
WHEREAS,an animal hospital is allowed as a special useinthe "GR,:Genera)Retail zoning
district subject to meeting general conditions specified in LDC Section 20-5.8 and subject to meeting
special requirements set forth inLDC Section 20-3.4(B)(2));and
WHEREAS,the approval ofa special use requires a recommendation from the Planning Board
andthe approval of theCity Commission after a public hearing;and
WHEREAS,on December 12,2006the Planning Board,after public hearing,voted 6ayes0
naystorecommend approval with conditions ofthe special use request;and
WHEREAS,the K4ayor and City Commission of the Cityof South Miami desire to accept the
recommendation of the Planning Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:

S.Dixie Highway inthe"GR"General Retail zoning use district is hereby approved subject tothe
followingconditions:
(1)All such uses shall be located within a fully enclosed,air-conditioned,soundproof structure.

(3)The hours of operation for visits and treatment will be 7:00 a.m.to 9:00 p.m.Monday through
