Res No 014-16-14569RESOLUTION NO.014"16-1 4569 A Resolution of the South Miami Commission of the City of South Miami, Florida,calling on Florida Governor Rick Scott,State Senate President Andy Gardiner,and State Speaker of the House Steve Crisafulli to enact a bill to install embedded,in-road,solar-powered,marker lights for bicycle ways located in,and within 1-mile of,all urban areas. WHEREAS,in 2013,most bicyclist fatalitiesintheUSA occurred between 4PMand Midnight (48 percent)and68 percent in urban areas;and WHEREAS,manycoastalroadsintheState of Floridaarerequiredtoturn off street lightsduringturtlenestingseason(Marchthru October).Embedded,In-RoadSolarMarker Lightswillprovideabikelanelightingsourceduringtheturtleseasonwhichwillnotdisturbthe turtles as well as throughout the year;and WHEREAS,bicyclistsintheUSAaccountedfor2.35percent of alltrafficfatalitiesand approximately48,000bicyclistswereinjuredin2013;and WHEREAS,in 2013,743peoplelosttheirlivesinbicycle/motorvehiclecrashes,ortwo peopleeveryday of theyearintheUnitedStates;and WHEREAS,83percentof bicyclists intheUnitedStates surveyed saidtheyfelt threatenedfortheirpersonalsafety,bymotorists,duringtheirrides;and WHEREAS,68percentofbicyclists fatalities intheUnitedStatesoccurredinurban areas;and WHEREAS,57percentof bicyclists fatalities intheUnitedStates occurred atnon- intersections;and WHEREAS,in 2013,theState of Florida ranked firstinthe nation with the highest rate ofbicyclistfatalitieswith5.5percentofalltotaltrafficfatalitiesinFlorida,comparedtothe national percentage of 2.35 percent;and WHEREAS,publicagenciesarerequiredtomaintainminimumreflectivityof longitudinalpavementmarkingsunlesscontinuouslightingassuresthatthemarkingsareclearly visible at night;and WHEREAS,when Embedded,In-Road Solar Markers (RRPMs)supplement or substitute for longitudinal lines,minimum pavement retro reflectivity levels arenot applicable; and Res.No.014-16-14569 WHEREAS,Embedded,In-Road Solar Marker Lights improve the nighttime visibility of bike lanes and bicyclists and reduce therisk of roadway departure crashes by making thebike lanes visible for drivers ata greater distance;and WHEREAS,Embedded,In-Road Solar Markers Lights are approved bythe Florida Department of Transportation (FDOT)asan Internally Illuminated Raised Pavement Markers (IIRPM);and WHEREAS,Embedded,In-Road Solar Marker Lightsare economical andeasyto install with zero maintenance;and WHEREAS,in 2012,The National Safety Council (NSC)estimated that the bicycle fatality crash cost to society is$3.3 Billion andthe bicycle injury cost to society is$2.9 Billion. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT: Section 1:The City of South Miami calls on Florida Governor Rick Scott,State Senate President Andy Gardiner andState House Speaker Steve CrisafuUi to require,in conjunction withthe construction,reconstruction,orother change of anystate transportation facility,the installation of embedded,in-road,solar-powered marker lightsfor bicycle ways located in,and within 1-mile of,all urban areas. Section 2:Severability.If any section clause,sentence,or phrase of this resolution isfor any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this resolution. In 2013,most bicyclist fatalitiesin the US occurred between 4PMand Midnight (48 percent)and68 percent in urban areas.Bicyclistsin the US accounted for2.35 percent of all traffic fatalities and approximately 48,000 bicyclists were injured in 2013.In 2013,743 people lost their lives in bicycle/motor vehiclecrashes,or two people every day of the yearin the US.83 percent of bicyclistsin the US surveyed said they felt threatened for their personal safety during their rides by motorists.68 percent of bicyclists fatalities in the US occurred in urban areas.57 percent of bicyclists fatalities in the US occurred at non-intersections.In 2013,the State of Florida ranked firstin the nation with the highest rate of bicyclistfatalitieswith5.5 percent of all total trafficfatalities, compared to the national percentage of 2.35 percent.In 2012,the National Safety Council (NSC)estimated that the bicycle fatality crash cost to society is$3.3 billion and the bicycleinjury cost to society is$2.9 billion.Furthermore,many costalroadsin the State of Florida are required to turn off street lights during turtle nesting season (March thru October).Embedded,In-RoadSolarMarkerLightswillprovideabikelane lightingsourceduring the turtle season and throughout the year.
