An Ordinance amending the City of South Miami Land Development Code, Section 2
20-6.1 (C) to provide for more flexibility for attendance at Environmental Review 3
and Preservation Board meetings. 4

WHEREAS, many of the members of the Environmental Review and Preservation Board 6
(“ERPB”) work during the day and some are working professionals who have important 7
meetings with clients and/or customers that could cause them to miss an ERPB meeting from 8
time to time; and 9

WHEREAS, If the rules were amended to excuse them from missing meetings where 11
there were enough members present to make quorum then members would be more likely to 12
communicate with each other beforehand to find members who could cover for members who 13
needed to be absent; and 14

WHEREAS, ERPB meetings are held early in the morning during the normal working day 16
when most people need to be at, or going to, work; and 17
18
WHEREAS, the City desires to amend Section 20-6.1 (C) to provide for more flexibility for 19
attendance at Environmental Review and Preservation Board meetings. 20

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE 22
CITY OF SOUTH MIAMI, FLORIDA: 23

Section 1. Sections 20-6.1 (C) of the City of South Miami’s Land Development Code 25
is hereby amended and shall read as follows: 26

20-6.1 - Administrative entities. 28
(C) Environmental Review and Preservation Board. 29
(1) Establishment and Membership. 30
(a) An environmental review and preservation board is hereby created which shall consist of 31
nine (9) members who reside or work in the city, except as provided in ii. below. 32
i. The mayor, with the advice and consent of the city commission, shall appoint the 33
members of the board. 34
ii. Board membership shall include at least one (1) registered landscape architect 35
licensed to practice in the State of Florida. If it is determined by the City Commission 36
that the position of landscape architect cannot be filled by a qualified individual who 37
resides or works in the City, the residency requirement may be waived by the 38
Commission and the position of landscape architect may be filled by a qualified 39
individual who does not reside or work in the City. 40
iii Board membership shall include two (2), but no more than four (4), architects licensed 41
to practice in the State of Florida. 42

iv. Members of the environmental review and preservation board may not work for the 1
City or be employed by any company that has contracts with the City. 2
v. Members shall serve for a term of two (2) years. 3
(b) Any member of the board shall be automatically removed for missing three (3) regular 4
meetings in a row that results in the board lacking a quorum for those meetings or five (5) 5
meetings in a twelve (12) month period that results in the board lacking a quorum for those 6
meetings. 7
i. The Planning and Zoning Director shall keep a record of meetings missed. 8
ii. The Planning and Zoning Director shall advise the City Commission and the member 9
being removed that such member has been automatically removed. 10

Section 2. Codification. The provisions of this ordinance shall become and be made 12
part of the City of South Miami’s Land Development Code. 13

Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance 15
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this 16
holding shall not affect the validity of the remaining portions of this ordinance or the Guidelines 17
adopted hereunder. 18

Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all 20
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. 21

Section 5. Effective Date. This ordinance shall become effective upon enactment. 23
