SUBIECT: An Ordinance amending the City of South Miami Land Development Code, Article VIII Transit Oriented Development District, "Definitions," Section 20-8,2, "Definitions," to amend vertical story floor height maximum. BACKGROUND: Upon recent review of maximum floor height per buildable story of 14 feet in the Transit Oriented Development District (T.O.DD); the need to increase the first floor buildable story height to 18 feet for interior loading and delivery areas was raised as an issue to be , proposed. ANALYSIS: The Transit Oriented Development District (T.ODD) promotes a walkable area with a mix of land uses around,a mass transit system. To provide for various and proper height' and vehicle turning radius in the interior loading areas of structures in the T.q.D.D the developer will be permitted to build the first floor vertical story height up to a maximum of eighteen (18) feet. This will provide ceiling clearance to accommodate the height of commercial motor vehicles ranging from 13 feet, 6 inches to 14 feet. STAFF RECOMMENDATION: Staff recommends Commission approval of the ordhlance to increase the maximum first floor height in the Transit Oriented Development District (T.O.D.D). AnACHMENTS: • Draft Ordinance • 1 2 ORDINANCE NO. ______ _ 3 An Ordinance amending the City of South Miami Land Development Code, Article 4 VIII Trausit Oriented Development District, "Definitions," Section 20-8.2, 5 "Definitions," to amend vertical story floor height maximum. 6 7 WHEREAS, the City of South Miami provides in its Land Development Code 8 for the location and distribution of uses throughout the City; and 9 10 WHEREAS, the City has a zoning district known as the Transit-Oriented 11 Development District (T.O.D.D.) located within walking distance of a dedicated mass 12 transit center, the South Miami Metrorail Station; and 13 14 WHEREAS, the T.O.D.D. is designed to encourage a mix of high density uses, 15 specifically residential, retail and office uses, and encourages redevelopment through 16 flexible and performance-oriented zoning and other ,regulations; and 17 18 WHEREAS, the Administration has reviewed the feasibility and effect of 19 revising the vertical story floor heights in the T.O.D.D.; and 20 21 WHEREAS, while developments within the T.O.D.D. have various permitted 22 heights of 2 stories to 8 stories, it is necessary to provide for higher first floor vertical 23 heights for delivery vehicle loading and unloading on the first floor for structures taller 24 than two stories; and 25 26 WHEREAS, the intent of the action proposed is to provide the structural design 27 element needed in the T.O.D.D. to permit a higher first floor to accommodate loading 28 integrated within a building's design; and 29 30 WHEREAS, the City Commission desires to adopt this amendment to 31 accomplish the above objectives. 32 33 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 34 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 35 36 Section 1. The South Miami Land Development Code, Article VIII, Transit- 37 Oriented Development District (T.O.D.D.) "Definitions," Section 20-8.2, "Definitions," 38 is hereby amended and shall read as follows: 39 40 41 * * * 42 Story: The horizontal division of a building between the surface of a floor and the surface 43 of the next floor above, or the next ceiling if there is no floor above. For the purposes of 44 these regulations, a story shall be interpreted as each vertical unit of fourteen (14) feet 45 maximum, except that a maximum of eighteen (] 8) feet shall be permitted on the first 46 floor (at sidewalk, street level), e.g. a one-floor cinema twenty-two (22) feet tall shall be 47 considered a two-story building. 1 2 3 * * * 4 Section 3. Codification. The provisions of this ordinance shall become and 5 be made part of the Code of Ordinances of the City of South Miami as amended. 6 7 Section 4. Severability. If any section, clause, sentence, or phrase of this 8 ordinance is for any reason held invalid or unconstitutional by a court of competent 9 jurisdiction, this holding shall not affect the validity of the remaining portions of this 10 ordinance or the Guidelines adopted hereunder. 11 12 Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and 13 all sections and parts of sections of ordinances in direct conflict herewith are hereby 14 repealed. 15 16 Section 6.
