An Ordinance Adopting a Small Scale Amendment to the Future Land Use Map of
the Comprehensive Plan, amending the designation of the Building and a parking
lot on the City Hall property located at 6130 Sunset Drive from Parks and Open
Space to Transit-Oriented Development District (TODD).
BACKGROUND:
The City of South Miami's Future Land Use Map provides the graphical representation for
land use categories identified in the Comprehensive Plan. The future land use map
identifies the elements of the comprehensive plan such as land uses, housing and
transportation in a geographic context and sets the graphical reference for the underlying
zoning districts. For some unknown and unexplainable reason , the Future Land Use Map
shows open space in an area that has been developed for many years. Further the current
map designation of open space is only for a portion of the city hall parcel under our Folio
Number which is improper. if the original designation of open space was intentional, then
the city would h ave crafted a separate Folio. it is believed to not have been open space
since approximately 1956. it is our intent to correct this mistake as we send other minor
map amendments to the State for the correction and revis ion of our Comprehensive Plan.
ANALYSIS:
The proposed Future Land Use Map amendment will modify the eXisting land use
category from Parks and Open Space to Tr ansit Ori ented Development District (T.O.D.D)
which is the appropriate category currently surrounding the lo ca tion of the error. The
placement of the current ca tegory on this property is incorrect and has never been revised
to reflect the present land use of government use. Presentl y, the property provides local
government office space and parking to visitors to City Hall and the Library. The map will
be modified to reflect the surrounding land uses found in folio number 09-4036-000-0030
as this is one parcel of land.
PLANNING BOARD ACTION:
At the Septemb er 29, 2015 public hearing the Planning Board reco mm end ed denial to the
Commissioners with a vote of 4 to 2, However: the Board stated that they are in favor of
) the amendment to correct the Future Land Use Map to T.O.D.o, wi th a co nd ition of
amending the zoning map with a Historic Preservation Overlay just for the Sylva Martin
building; not the parking lot or new rear addition to the building.
STAFF RECOMMENDATION:
Staff recommends Commission approval of the ordinance to correct the Future Land Use
Map (FLUM).

WHEREAS, The City of South Miami has prepared a small-scale Future Land Use
Map amendment to change the designation of the approximately .85 acre subject property
located at a 6130 Sunset Drive from Parks and Open Space to Transit Oriented Development
District (T.O.D.o. (4+4 Story» on the Future Land Use Map;
WHEREAS, the Local Planning Agency has reviewed the proposed amendments to
the Comprehensive Plan, held an advertised public hearing, provided for public participation
in the process and rendered its reco=endation to the City Commission, and;-
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSIO~ OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. That the City of South Miami adopt the Small Scale Amendment to the Future
Land Use Map as indicated on the Map attached hereto and made a part hereof as Exhibit
"A";
Section 2, That the City of South Miami transmit the adopted Ordinance to the Department of
Economic Opportunity as a courtesy, as provided in Section 163.3181(1), Florida Statutes
(F.S.)
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance or the Guidelines
adopted hereunder.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections
and parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.
