Florida Statue 166.241provides that: (4) The governing body of each municipality at any time within a fiscal year or within 60 days following the end of the fiscal year may amend a budget for that year as follows: (a) Appropriations for expenditures within a fund may be decreased or increased by motion recorded in the minutes if the total appropriations ofthe fund is not changed. (b) The governing body may establish procedures by which the designated budget officer may authorize budget amendments if the total appropriations of the fund is not changed. (c) If a budget amendment is required for a purpose not specifically authorized in paragraph (a) or paragraph (b), the budget amendment must be adopted in the same manner as the original budget unless otherwise specified in the municipality's charter. The City has found that the use of body-worn cameras for the police officers will become an indispensible addition to' police equipment and it is recommended that the Federal Forfeiture Fund Computer Equipment Account 615-1910-521-5205 for the City's 2016 fiscal year budget, be increased by $75,000 to purchase the body-worn cameras for the Police Department. The City Attorney has determined that this is a valid and proper use of the Federal Forfeiture Fund. The City Manager is hereby authorized to cause an increase in the City'S fiscal year 2016 25 budget Federal Forfeiture Fund Computer Equipment Account 615-1910-521-5205, in the amount of $75,000. 26 27 Section 2. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason 28 held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of 29 the remaining portions of this ordinance. 30 31 Section 3. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts 32 of sections of ordinances in direct conflict herewith are hereby repealed. 33 34 Section 4. Effective Date. (2) The governing body of each municipality shall adopt a budget each fiscal year. The budget must be adopted by ordinance or resolution unless otherwise specified in the respective municipality's charter. The amount available from taxation and other sources, including balances brought forward from prior fiscal years, must equal the total appropriations for expenditures and reserves. At a minimum, the adopted budget must show for each fund, as required by law and sound financial practices, budgeted revenues and expenditures by organizational unit which are at least at the level of detail required for the annual financial report under s. 218. 32( 1). The adopted budget must regulate expenditures of the municipality, and an officer of a municipal government may not expend or contract for expenditures in any fiscal year except pursuant to the adopted budget. (3) The tentative budget must be posted on the municipality's official website at least 2 days before the budget hearing, held pursuant to s. 200.065 or other law, to consider such budget. The final adopted budget must be posted on the municipality's official website within 30 days after adoption. If the municipality does not operate an official website, the municipality must, within a reasonable period of time as established by the county or counties in which the municipality is located, transmit the tentative budget and final budget to the manager or administrator of such county or counties who shall post the budgets on the county's website. The most important objective of the Program is law enforcement. Equitable sharing further enhances this law enforcement objective by fostering cooperation among federal, state, and local law enforcement agencies. The Attorney General shall assure that any property transferred to a State or local law enforcement agency: A. has a value that bears a reasonable relationship to the degree of direct participation of the State or local agency in the law enforcement effort resulting in the forfeiture, taking into account the total value of all property forfeited and the total law enforcement effort as a whole; and with respect to the violation of law on which the forfeiture is based; and B. will serve to encourage further cooperation between the recipient State or local agency and Federal law enforcement agencies The Forfeiture funds obtained from the Federal Government are limited in its use. Sharing must be used to increase or supplement the resources of the receiving state or local law enforcement agency or any other ultimate recipient agency.
