3 A Resolution instructing the City Attorney to draft an ordinance establishing
4 guidelines for the sale of real property owned by the City of South Miami and
5 which has a value in excess of $1,000,000.

7 WHEREAS, it is desirous of members of the City Commission to set up procedures for
8 the sale of real property owned by the City whose sale price is in excess of $1 ,000,000; and
9
10 WHEREAS, the sale of City real property valued in excess of$I,OOO,OOO would require
11 a super-majority vote (4/5); and
12
13 WHEREAS, it is in the interest of the City's electorate to have input into the sale of City
14 property valued in excess of $1 ,000,000; and
15
16 WHEREAS, it is in the interest of the City's electorate to have input into the sale of City
17 property valued in excess of$I,OOO,OOO; and
18
19 WHEREAS, it is in the interest of the City, including its electorate, to maximize return
20 on the City's investment in real property while affording ample input from the City's electorate
21 in an expeditious manner so that a prospective purchaser will not have money tied up for
22 extended amounts of time waiting the voters to approve or reject a sale by referendum.

24 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
25 COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:

27 Section 1. The City Attorney is hereby instructed to craft an ordinance establishing
28 guidelines for the sale of real property owned by the city valued (as evidenced by two current
29 appraisals from appraisers chosen by the City Commission) in excess of$I,OOO,OOO which
30 ordinance shall include the following:

32 1) Direct the City Manager to cause to be delivered to the United States Postal
33 Service, at least 10 days prior to the first meeting, cart-sorted third class post
34 cards to the City's registered voters at the addresses listed in the City's current
35 voter registration rolls, announcing the location, time and date ofthe first reading
36 and advising the voters to either attend the first reading where the date, time and
. 37 location of the second reading will be announced or to go the City's website for
38 the same information as to the second reading. The City Manager shall cause the
39 time, date and location of the second reading to be posted on the City's website
40 and to provide the URL address in the post card notice where the voter can find
41 the information as to the second reading.

43 2) Direct the City Manager to display on at least 1/6 of the area of the opening screen
44 page of the City's website at least one week prior to the first reading, a notice of
45 and reason for the Commission meeting, and the location, time and date of the
46 first and the proposed location, date and time of the second meeting to ratify the

contract for the sale of City-owned real property whose sale price is in excess of
$1,000,000 and direct the City manager to amend the announcement on the
opening screen of the City's web site when the location, date and time of the
second meeting has been set or when it is re-set regarding the aforementioned
matter.
3) Direct the City Manager to place signs regarding the aforementioned meetings on
each side of the subject property that abuts a roadway.
4) Each of the two Commission meetings to ratifY the sale of City owned property
shall be public hearings.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 4. Effective Date. 1bis resolution shall become effective immediately upon
adoption by vote of the City Commission.
