An Ordinance relating to the City's 2016 fiscal year budget;amending the budget to take
into account an increase in the Federal Forfeiture Fund Appropriated Amount.
WHEREAS,Florida Statue 166.241 provides that:
(4)The governingbodyofeach municipality atanytimewithina fiscal year or within60days
following the end of the fiscal year may amend a budget for that year as follows:
(a)Appropriations for expenditures withinafundmaybe decreased or increased by motion
recorded in the minutes if the total appropriations of the fund is not changed.
(b)The governing bodymayestablish procedures bywhich the designated budget officermay
authorize budget amendments if the total appropriations of the fund is not changed.
(c)Ifa budget amendment is required for a purpose not specifically authorized in paragraph (a)
or paragraph (b),the budget amendment must be adopted in the same manner as the original
budget unless otherwise specifiedin the municipality's charter.
WHEREAS,the Cityhasfound that the useof body-worn cameras for the policeofficerswill become
anindispensibleaddition to police equipment,and;
WHEREAS,itis recommended that the FederalForfeitureFund Computer EquipmentAccount 615-
1910-521-5205 fortheCity's 2016 fiscal yearbudgetbeincreasedby$75,000 to purchasethebody-worncameras
for the Police Department.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section I.TheCity Manager isherebyauthorizedtocauseanincreaseintheCity's fiscal year 2016
budgetFederal Forfeiture Fund Computer EquipmentAccount 615-1910-521-5205,in the amount of$75,000.
Section 2.Severability.Ifanysection,clause,sentence,or phraseofthisordinanceisforanyreason
held invalid or unconstitutional byacourtofcompetent jurisdiction,this holding shall not affect the validity of
the remaining portions ofthis ordinance.
Section 3.Ordinances in Conflict.All ordinances orpartsof ordinances and all sectionsandparts
ofsectionsofordinancesindirectconflictherewithareherebyrepealed.
Section 4.Effective Date.This ordinance shall become effective upon enactment.

Florida Statue 166.241provides that:

The City hasfound that theuseofbody-worn cameras for the policeofficerswillbecomean
indispensible addition to police equipment anditis recommended that the FederalForfeiture
Fund ComputerEquipment Account 615-1910-521-5205 for the City's2016 fiscal year budget,
beincreasedby $75,000 topurchase the body-worn camerasfor the Police Department.
The City Attorneyhas determined that thisisavalidand proper useof the FederalForfeiture
Fund.

MUNICIPALITIES MUNICIPALITIES
166.241 Fiscal years,budgets,and budget amendments.-
(1)Eachmunicipalityshall establish afiscalyearbeginningOctober1ofeachyearand ending
September 30of the following year.
(2)The governing bodyof each municipality shall adopt a budget each fiscalyear.The budget mustbe
adopted by ordinance orresolutionunless othervyrise specifiedin the respective municipality's charter.The
amount available from taxation and other sources,including balances brought forward from prior fiscal
years,mustequalthe total appropriationsforexpendituresandreserves.Ata minimum,the adopted
budgetmust show foreachfund,as required bylawand sound financial practices,budgetedrevenuesand
expenditures by organizational unit which are at least at the level of detail required for the annual
financial report under s,218.32(1\.The adopted budgetmust regulate expenditures of the municipality,
and an officer ofamunicipal government may not expendor contract for expenditures inany fiscal year
except pursuant to the adopted budget
(3)The tentative budget must be posted on the municipality's official website at least 2 days before
the budget hearing,held pursuant to s.200.065or other law,to consider such budget.The final adopted
budget must be posted on the municipality's official website within 30days after adoption.If the
municipality doesnotoperatean official website,the municipality must,within a reasonable periodof
time as established by the county or counties inwhich the municipality is located,transmit the tentative
budget andfinal budget to the manager or administrator ofsuch county or counties whoshall post the
budgets on the county's website.
(4)Thegoverningbodyof each municipality at anytimewithinafiscalyearorwithin60days following
the end of the fiscal year may amend a budget for that year as follows:
(a)Appropriations for expenditures withinafundmaybe decreased or increased bymotion recorded in
the minutes if the total appropriations of the fundisnot changed.
(b)The governing body may establish procedures by which the designated budgetofficermayauthorize
budget amendments if the total appropriations ofthe fund isnot changed.
(c)If a budget amendment is required forapurposenotspecifically authorized inparagraph(a)or
paragraph (b),the budget amendment mustbeadoptedin the samemanneras the originalbudgetunless
otherwise specified in the municipality's charter.
(5)If the governingbodyofamunicipalityamends the budget pursuant to paragraph (4)(c),the
adopted amendment mustbepostedon the officialwebsiteof the municipalitywithin5days after
adoption.If the municipalitydoesnot operate anofficialwebsite,themunicipalitymust,withina
reasonable periodof time as established by the countyor counties inwhich the municipalityislocated,
transmit the adopted amendment to the manager or administrator ofsuchcountyor counties whoshallpost
the adopted amendment on the county's website.

BACKGROUND
TheDepartmentofjusticeAssetForfeitureProgram(theProgram)isanationwidelaw
enforcement initiative that removes thetoolsof crime fromcriminalorganizations,deprives
wrongdoers of the proceedsof their crimes,recovers property thatmaybeused to
compensate victims,anddeterscrime.ThemostimportantobjectiveoftheProgramislaw
enforcement Equitable sharing further enhances this law enforcement objective byfostering
cooperationamong federal,state,and local lawenforcement agencies.TheAttorneyGeneral
shall assure that any property transferred toaState or local law enforcement agency:
A.hasavalue that bears a reasonablerelationship to the degree of direct participationof
theState or local agency inthe law enforcementeffortresultingintheforfeiture,taking
intoaccountthetotalvalueof all property forfeited andthetotallawenforcement
effortasawhole;andwithrespecttothe violation oflawonwhich the forfeitureis
based;and
B.will servetoencourage further cooperationbetweentherecipientState or local agency
andFederallaw enforcement agencies
TheForfeiturefundsobtainedfrom the Federal Governmentarelimitedinitsuse.Sharing must
be used to increase or supplement the resources ofthe receiving stateor local law enforcement
agency or any other ultimate recipient agency.Sharedresourcesshallnotbeused to replace or
supplanttheappropriatedresourcesofthe recipient but may include these permissible uses:
Law enforcement
investigation
Law enforcement training
Law enforcement and
detention facilities
Lawenforcementequipment
Law enforcement travel and
transportation
Law enforcement awards and
memorials
Drugand gang educationand
awareness programs
