AN ORDINANCE OFTHE CITY OFSOUTH MIAMI,FLORIDA,REZONING
THE PROPERTY AT 6790 S.W.57 AVENUE AND AT 5757 S.W.68 STREET
SOUTH MIAMI,FLORIDA LEGALLY DESCRIBED HEREIN,FROM LO (LOW
DENSITY OFFICE)TO GR (GENERAL RETAIL)AND AMENDING THE
OFFICIAL ZONING MAPOFTHECITYOF SOUTH MIAMITO REFLECT
SAID CHANGED ZONING DESIGNATION.
WHEREAS,the City of South Miami,Florida heretofore adopted
a Land Development Code on October 26,1989;and
WHEREAS,by Ordinance 7-90-1948,the City of South Miami on
May 1,1990 thereafter adopted a Comprehensive Land Use Plan;and
WHEREAS,the adopted Comprehensive Land Use Plan designates
the property at 6790 S.W.57th Avenue,South Miami,Florida,legally
described as follows:
TheE 150'oftheS 150"ofTract1,less theS 10'andthe
E 15'thereof for Right-of-Way of the Revised Plat of Fernwood
Subdivision as recorded in Plat Book 35at Page 72of the
Public Records of Dade County,Florida
and the.property at 5757 S.W.68 Street,South Miami,Florida4
legally described as follows:
The W 75'oftheE 325'of the S 125'of the Tract 1of the
Revised Plat of Fernwood Subdivision as recorded in Plat Book
35at Page 72of the Public Records of Dade County,Florida as
"GR"(General Retail);and
WHEREAS,the present Land Development Code and Official Zoning
Map adopted thereunder,reflects the aforesaid property as still being
designated "LO"(Low Density Office);and
WHEREAS,the Mayor and City Commission wish to change the Land
Development Code and Official Zoning Map thereunder to conform with
the aforesaid Comprehensive Land Use Plan of Adoption;
NOW,THEREFORE,BEIT ORDAINED BYTHEMAYORANDTHECITY
COMMISSIONOFTHECITYOFSOUTH MIAMI,FLORIDA:
Section 1.Section 20-3.1 (C)"Official Zoning Map"be,and hereby is
amended to reflect the aforesaid property as "GR"in lieu of its present
designation of "LO".
Section 2.Thatthe Administration be,and hereby is,directed to
make all such changes necessary so that the Official Zoning Map reflects
the same.
Section 3.Ifany section,clause,sentence or phrase of this
Ordinanceisheldtobeinvalidor unconstitutional byanycourtofcompetent
jurisdiction,then said holding shall in noway affect the validity of the
remaining portions of this Ordinance.
Section 4.All Ordinances or parts of Ordinances in conflict
herewith be,and the same are,hereby repealed.
Section 5.This Ordinance shall take effect immediately at the
timeof its passage.
