BE REPEALED AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,On October 26,1989,the Mayor and City
Commission of the City of South Miami,Florida,adopted Land Use
Regulations regarding the use of land and buildings in the City;
and
WHEREAS,theMayorandCity Commission desiretomake
amendments tothe regulations upontherecommendationofthe
Administration.
NOW,THEREFORE,BEIT ORDAINED BY THE MAYOR AND CITY
COMMISSION OFTHECITYOFSOUTHMIAMI,FLORIDA:
Section 1.That Section 20-3.3,PermittedUse Schedule be
and the same is hereby amended by deleting subsection (C),
Definition of Uses therefrom.
Section 2.That Section 20-3.3,Permitted Use Schedule,
Subsection (E),be and the same is hereby amended by deleting the
Standard Industrial Classifications (S.I.C.)column fromthe
Permitted UseSchedule Chart andamendingPermittedUsesinGR
(General Retail)DistrictspursuanttoExhibit"A"attached
hereto.
Section 3.That "Auto Parking Lot"be and the same is
hereby eliminated and "Auto Parking Structure"be permitted only
as a Special Use in SR (specialty retail^and PI
(public/institutional)Districts as specified in Section 20-3 3
PermittedUse Schedule,subsection (E^.'
Section 4.That "Clinic"be and the same is hereby
deleted rrora Section 20-3.3 Permitted Use Schedule,subsection
(E)oftheLandDevelopment Code.
Section 5.That "Eating Place (accessory)"be permitted
only as a Special Use in the LO 'low intensity office)and MO
(medium intensity office)Districts as specified in Section 20-
3.3,Permitted Use Schedule,subsection(E).

Section 6.That Section 20-6.1,Administrative Entities,
subsection (A),City Commission,subsection(4),Procedures,
subsection (e)beandthe same is herebyamended to read as
follows:
"When any request requiring a public hearing before the Planning
Board has been acted upon bythe Commission and denied or failed
topass,such proposed change,inthe same or similar form shall
notbe reconsidered bythe Commission fora period ofatleast
one (1)yearfollowingthedateofsuchaction (removed:when
deniedwithoutprejudice)exceptinwhichcase reconsideration is
possible after (6)months for the date established for the prior
hearing attherequestofthe majority ofthe Commission."
Section 7.That Section 20-5.6,Applications in General,
be andthesame is hereby amended byadding subsection (D)
entitled:Withdrawal of a Petition to read as follows:
"(D)Withdrawa/of a Petition
Any application for an amendment,supplement or change may be
withdrawn by request,in writing,from the applicant at any time
before adecisionoftheCommission,butif withdrawn after
advertisementforapublichearingorpostingoftheproperty,
thesameorsubstantiallysimilarapplicationgoverningthesame
property shall not be resubmitted for a period of at least one
(1)year except at the request of a majority of the Commission it
can beheardaftera period ofsix (6)months afterthedate
established fortheprior hearing.Filing fees shallnotbe
refunded upon any withdrawal."
Sectio;,8'That 20-5.7,Rezonings and Text Amendments,
subsection (D),Applications Withdrawal,be and the same is
hereby deleted and subsequent sections (E>,(F)and (G">are amended
accordingly.
Section 9.That Section 20-6.1,Administrative Entities,
subsection(B),Planning Board,(3),Powers and Duties fh)be and
the same is hereby amended by deleting the phrase "and any other
provision ofthis Code",to-wit:
(h)The Board shall review and make recommendations
on all applications for variances from the
requirements ofthisCodeforyardsetbacks,
lot size,lot coverage,building height,fences
andwalls,imperviouscoverage,off-street
parking,open space,signs ,&landscaping «***-

Recommendations fora variance shall be made
onlywhennecessarytorelieveparticular
hardships or extraordinary conditions relating
toa specific property,and when the strict
applicationofaparticularregulationwould
result in peculiar and exceptional hardship
upontheownerofsuchpropertyas
distinguished from reasons of convenience,
profit or caprice.
Section 10.That Section 20-5.9,Variance Approvals,be
and the same is hereby amended to include a subsection (G)
entitled:"PERMITTED VARIANCE RFOUFSTS",to-wit:
"(G)PERMITTED VARIANCE REQUESTS
APP]:Lcations for variances shall be restricted toonlythefollowing:
(1 ^Yard setbacks
(2)Lot size
(3)Lot coverage
(4)Building height

Section 11.All ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 12.If any section,sentence,clause or phrase of
this ordinance is held to be invalid or unconstitutional by any
court of competent jurisdiction,then said holding shall in no
way affect the validity of the remaining portions of this
ordinance.
Section 13.This ordinance shall take effect immediately
at the time of its passage.
