No. 09-90-1449BORDINAT"CF N0. 9-90-1449 S AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING SECTION 5-1 OF ARTICLE I OF CHAPTER 5,1 "ANIMALS AND FOWL" OF THE CODE OF ORDINANCES OF THE CITY OF SOUTH MIAMI, FLORIDA, BY ADDING WILD FOWL AND WILDLIFE AS PROTECTED UNDER SANCTUARY PROVISIONS; PROVIDING FOR SEVERAFILITY AND AN EFFFCTIVF DATE. WHEREAS, the City of South Miami has heretofore declared the area within its corporate limits to he a bird sanctuary; and WHEREAS, the Mayor and City Commission wish to extend this sanctuary to other animal wildlife; NOW, THEREFORE, BE IT nPDAINED BY THE MAYOR AND THE CITY COMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Article I, Section 5-1 of the Code of Ordinances is her by amended as follows: Sec. 5-1 City Declared Bird, Wild Fowl and Wildlife Sanctuary. The territory embracing the corporate limits of the City is hereby declared to be a bird, wild fowl., and wildlife sanctuary, and it shall be unlawful to any person or persons to harass, wound, trap or bill any bird (s ' ), wild fowl or wildlife within the territorial limits of the City. Section 2. The definition of wildlife shall be as follows: All wild or non-domestic birds, mammals, fur-bearing animals, reptiles and amphibians. Section 3. Removal That wildlife, as determined by the City Manager as life- threatening, can be humanely trapped by certified private sector animal control specialists for safe removal to a suitable location. Section 4. if any section, clause, sentence or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no affect the validity of the remaining portions of this ordinance. Section 5. All ordinances or parts of ordinances in conflict herewith be, anel the same are hereby repealed. Section F. This Ordinarce shall take effect immediately at the time of its passage.
