2 OF THE CODE OF ORDINANCES, CITY OF SOUTH _

VISIONS HEREOF; AND DECLARING INTENT HEREUNDER.

OF SOUTH MIAMI, FLORIDA:
Section 1. That, pursuant to the authority of Sec. 16.12
of Article II of the Charter of the City of South Miami, Article
III of Chapter 2 of the Code of'p Ordinances, City of South Miami,
Florida, be and the same hereby is amended by adding thereto a
new section reading as follows, to -wit:
"Sec. 2 -26.1. Boxing Commission; membership; duties.
a. Definitions. Wherever used here h, the following
words shall be construed and defined as follows:
Exhib %_j:k s shall include any professional show,
televised "show, encounter, fight or match, with
or without gloves, commonly considered boxing or
wrestling "match, the same bei"n"g voluntary be-
:i tween two or more persons for money, prizes of
any character, points, or-fame, or any other
thing of value, whether admission fees are charg-
ed or not, directly or indirectly.
Person shall include a natural person,`'a corpor-
i ation created under the laws of this or any other
F state, a partnership, association or a joint stock
_company.
Promoter shall include any 'person or persons,
association or corporation engaged in advertising,
encouraging, promoting or bringing about an ex-
hibition in the City of South Miami.
b. There is hereby created a'comm "scion to be known as
a Boxing Commission of the City `of South-Miami, whose duty it
shall be to administer and provide for,the enforcement of the
provisions of this section. The Commission shall consist of three
members who shall serve without compensation and be residents of
the City of South Miami appointed by the Mayor with the consent
and approval of the City Council. Any two members shall consti-
tute a quorum. The Commission shall report to the City Council
as may be requested or required by the City Council, but not less
frequently than once a year.

c, The Boxing Commission shall regulate and supervise
and have jurisdiction over all pugilistic, boxing, wrestling or
similar exhibitions in the City of South Miami and no person or
persons shall advertise, encourage, promote or engage in any such

mission as hereinafter provided.

tion is not against the public welfare, and that the contestants
are properly matched avid are in sound physical condition "at the
time of 'the contest, then a permit may be issued by the Commission
to such applicant to 'promote and carry out such exhibition. But
every such 'permit issued t'o'such applicant shall be subject to any
and all rules and regulations made by said Commission. No permit
shall be issued except as herein provided.
The Comm ission may issue a permit for the holding of
such exhibitions upon such terms and conditions as may pre -
scribed by it, and may in its discretion, change or modify such
conditions `from ` time to time, and may in its discretion, with-
draw or cancel any permit already issued upon 'proper cause. The
Commission shall have the power and authority, also, to suspend
any contestant, fine him or cause his purse to be forfeited for
violation of any of the 'provisions hereof or the rules of the
Commission; all such fines and forfeitures shall be turned over
by the Commission after ninety days to the City Manager of South
Miami and credited to an account related to youth welfare.

or a property bond with two good and sufficient sureties, owning
real property in the City of South Miami, in an amount to be fixed
and determined by the Commission and in a form approved by the

City Attorney at the time of granting said permit, said bond to
be conditioned upon such terms and conditions as may be fixed

hibition intended to be staged or promoted by -said applicant or
the return''by said applicant of all moneys received by said .

` g. That there be, and hereby is', established th`e follow-
ing schedule of fees to be paid to the City of South Miami, per
Exhibition, to -wit:

Section 2. That any per "son, persons, firm, partnership °or
corporation violat'irig any of the provisions of this ordinance
shall, upon conviction, be punished by ^'a fine not to exceed
$500.00, or by imprisonment not to exceed six months, or by both
such fine and imprisonment in the discretion of `the Municipal
Judge. Each day that a violation is permitted to exist shall
constitute a sepa "rate offense.
Section 3. It is the intent that this ordinance be perman-
ent in nature and shall be included in the Code of Ordinances of
the City of South Miami, Florida.
