RESOLUTION OF CITY OF SOUTH MIAMI, FLORIDA,
DENYING APPLICATION OF NORMAN L. GREEN FOR
A VARIANCE FROK SIGN SETBACK REQUIREMENTS
ON THE PREMISES KNOWN AS 5704 BIRD ROAD,
SAID PREMISES BEING MORE FULLY DESCRIBED
HEREINAFTER.
WHEREAS, NORMAN L. GREEN duly made application for a
variance of sign setback requirements so as to premit a
detached sign 8 inches from the interior property line rathe.-.
than the required 5 foot setback on the premises known as 5704
Bird Road, and
WHEREAS, the Planning Advisory Board duly held a hearing
on said application and thereafter recommends that the application
be denied, and
WHEREAS, the City Council, after the holding of a duly
advertised public hearing, finds that the existing setback
requirements fail to cause any undue hardshi p as to the prop-
erties involved, and further finds that if any hardship exists,
it is self-created ;1 and further finds that to grant such variance
-would be detrimental to the area involved;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY
OF SOUTH MIAMI, FLORIDA:
1. That the application of Norman L. Green for a variance
to the sign setback requirements so as to permit a detached sign
8 inches from the interior property line on those premises known
as 5704 Bird Road is hereby DENIED. Said premises being legally
described as, to-wit:
Lots 3 through 10 inclusive, and Lots 15 through
24 inclusive, of Block 2 WESTERFIELD MANOR, SECTIONS
1 and 2, according to the Plat thereof, as recorded
in Plat Book 18 at Page 47 of the Public Records of
Dade County, Florida.

#66 -44 The applicants position without the sign will be no worse than that
of any of the other lessees in the shopping center. Therefore, he
can not show unusal hardship. To approve this application would set
a precedent that would probably have to be followed throughout the
shopping center.
Recommend denial.
#66 -45 There.is no practical way to develop this lot and provide sufficient
parking unless the proposed parking plan or one similar to it is
approved. Recommend approval of varience upon condition that the
applicant install an 8 foot sidewalk in conformance with existing
sidewalk on the East side of Commerce Lane.

Gentlemen:
I presently am a tenant at 5802 Bird Road, South Miami, and have at
that location an exterior sign on a 15' pole. This sign was erected
by permit of your city.
I am moving my business one block east to 5704 Bird Road. This is in
the shopping center at that location and is the store furtherest
east.
The only place at which my sign could be erected and be seen from
both sides is at the easterly interior property line. I am
informed that existing leases, traffic flow, and zoning requirements
would prohibit its placing elsewhere in the parking area.
Zoning requires a 5' setback from an interior property line and
while this property line abuts on a alley the requirement is still
there.
If the sign is erected 5' in from the interior property line it
would be in the traffic corridor in the parking lot.
For the above reasons and to prevent a loss of $ 1000.00 (the
value of this sign) a variance is requested to allow erection
of this sign within 12" of the easterly interior property line.
