BACKGROUND: At September 15, 2105 Commission meeting a proposed Future Land. Use Map amendment was presented to modify the existing land use category for the Sylva Martin building and parking lot from Parks and Open Space to Transit Oriented Development District (T.O.D.D). The placement of Parks and Open Space on this property is incorrect and has never been updated to reflect the present land use of government use. Presently the property provides local government office space for the building department, planning department, and code enforcement as well as provides parking to visitors to City Hall and the Library. The map amendment was forwarded to the Planning Board for recommendation. At the September 29, 2015 public hearing the Planning Board recommended denial with a recommendation of approving the T.O.D.D future land use map correction if a Historic Preservation Overlay (HP-OV) be placed on just the Sylva Martin building, not the parking lot or new rear addition to the building. To implement the suggestion from the Planning Board a new ordinance is proposed, adopting the HP-OV overlay to the existing TODD-PI zoning map for the Sylva Martin Building (not including the parking lot and rear addition). All uses allowed by the underlying TODD-PI zoning districts shall be permitted. . ANALYSIS: The City of South Miami's Zoning Map provides the graphical representation for zoning districts throughout the City of South Miami. The zoning map identifies the elements of the comprehensive plan such as land uses, housing and transportation in a geographic context and sets development regulations within each zoning districts in the Land Development Code. The current zoning map designation for the Sylva Martin Building is TODD-PI. The present land use is a local government facility space permitted by right. It is the intent to designate just the building and porch not the parking lot or new rear addition to the building as a Historic Preservation Overlay thus preserving the historic structure. STAFF RECOMMENDATION: (-) Staff recommends Commission approval of the ordinance for the historical overlay and subsequent future land use map change. WHEREAS, the City Commission of the City of South Miami IS interested in preserving historical structures; and ' • WHEREAS, the Sylva Martin Building located at 6130 Sunset Drive is designated as a structure of historical significant; and WHEREAS, the current zoning map designation for the Sylva Martin Building is TODD-PI. The present land use is a local govermnent facility office space pennitted by right WHEREAS, the HP-OV shall overlay the Sylva Martin Building (not including the parking lot and rear addition) located within the existing TODD-PI zoning districts, and all uses allowed by the underlying TODD-PI zoning districts shall be permitted. WHEREAS, the Planning Board upon a public hearing at the October 13, 2015 referred the historical status of the Sylva Martin Building to the Commission to be considered for recommendation to supplement the TODD-PI zoning map to reflect a Historic Preservation Overlay (HP-OV) designation. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: . Section 1, The City of South Miami hereby supplements and adds to the Official Zoning Map for TODD-PI zoning to reflect a Historic Preservation Overlay (HP-OV) for the Sylva Martin Building, including its front porch, but not including the parking lot and rear addition. Section 2. Codification. The provisions of this ordinance shall become and be made part of the Official Zoning Map of the Land Development Code of the City of South Miami as amended. Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance or the Guidelines adopted hereunder. Section 4. Ordinances in Conflict All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 5. Effective Date.
