WHEREAS,GROUPER SOMI,LLC submitted Application No.PB-15-014 requesting
approval ofa special use to establish two general restaurants located at 5840 SW 71s Street
within the (HD-OV)zoning district;and
WHEREAS,the applicant proposes toleasethe existing vacant space that willfronton
SW 71st Street;and
WHEREAS,restaurants are permitted asa special use within the Specialty Retail "SR",
Hometown District Overlay "HD-OV"zoning district andis subject to meeting general
conditions specified inLDC Section 20-5.8and subject to meeting special use requirements set
forth in LDC Section 20-3.4(B)(4)(b);and
WHEREAS,at the September 8,2015 public hearing the Planning Board recommended
approvalwithavote of 4to1forthespecialuse.
WHEREAS,there has been an affirmative finding asto each of the following criterion as
required by 20-3.4(B)(4)(b)

Background:
Located inthe Specialty Retail "SR",Hometown District Overlay "HD-OV,"theapplicant
isproposingtoopentwo (2)newgeneral restaurant useswithinthe existing building
(Commercial Space-101 and Commercial Space -102).Each commercialspaceshallhave
aseparate business licenseand parking requirements.Thisreport identifies the
requirements neededfor Commercial Space 101.
Pursuant tothe regulations listed inthe Permitted Uses,Section 20-7.12(A)ofthe Land
Development Code (LDC),a special use permit is required for the operation ofa general
restaurant.Currently the building is operating asadrycleaner,the building will be
subdivided into two (2)general restaurant uses that will operate independent ofeachother
and will front SW 71sl Street.
Site Location
Analysis:
Asshownin Figure 1,the existing one-story building willbe divided into two (2)
restaurant spaces.

Pursuant to the Special Use Conditions,Section 20-3.4 of the LDC,a special use may be
approved and permitted by the city commission at a public hearing,after a
recommendation by the planning board and that such use complies with the general
requirements,special requiremente,and any other conditions that the city commission
may consider appropriate and necessary.
When reviewing the project,the following items are noted:
•The site is currently being operated bya dry cleaner and has a total square footage
of 5,357 square feet.Commercial Space -101 will occupy 2,601 square feet ofthe
building.Commercial Space -102 will occupy 2,756 square feet which is a separate
application and resolution.
•The proposedlocationisnear similar restaurant usestothenorth,(Akashi and Rice:
House of Kabob)as well as tothe south,(Old Lisbon,Station 5,and Temple).
As shown on the attached site plan,the applicant is proposing a complete renovation of
the site that includes the installation of a new refuse enclosure,new outdoor patio area,
and new landscape areas.The applicant is also proposing to utilize outdoor seating areas
for patrons to both ofthe restaurants.Pursuant to Section 20-3.3(E)(2)ofthe LDC:
Sidewalk cafe or Outdoor seating/dining areas and uses of the public right-
of-way and/or any private property abutting a public right-of-way may be
approved,denied,or approved with conditions,modifications,safeguards,
or stipulations appropriately and reasonably related to the intent,purposes,
standards,and requirements of the related regulations by the City Manager
The requested special use does not conflict with the Comprehensive Plan and complies
with the LDC requirements set forth in Section 20-5.8inthattheuse:
a)Will not adversely affect the health or safety of persons residing or working in the
vicinity oftheproposed use,
b)Will notbe detrimental tothe public welfare or property or improvements in the
neighborhood;and,
c)Complies with allother applicable Code provisions.
Planning Board Action:
At the September 8,2015 Planning Board meeting and following a public hearing,the
Board voted 4-1 to recommend approval ofthe special use application PB-15-014.
Staff Recommendation:
Staff recommends approval forthe Special Use application tooperatea general restaurant
at 5840 SW 71st Street.

existing retail useonthe Property.This Special Exception Application isa companion to
the Applicant's Special Use Application that is required to permit the operation ofthe
restaurants.
The Applicant's proposeddevelopmentis illustrated ontheattachedplans,does
notincreasethesquare footage ofthe existing building,offers compatible and
complimentary uses that will operate harmoniously with theother retail uses that
operateinthe vicinity,and will not overburden roadways orother City services.The
outdoorseating for the Applicant's proposeddevelopmentwouldnotbeinthe public-
right-of-way.
Duetoexisting building use,layout,andlotcoverage,itwouldbe difficult to fully
complywiththe on-site parking requirementofthe LDC of one parking space per100
feetofrestaurant space devoted to patron useandone parking space per300square
feetofrestaurant space devoted to non-patron use.
The Applicant will providesix parking spaces ontheProperty.Thelocationof
theProperty will permitpatronsto use theCity-owned surface parking lot,locatedtwo
lotstothe east of the Property,the Sunset Place parking garagelocated across SW
58th Avenue,and the South MiamiMetrorail Station which is less than 100 feet from the
Property.
The proposed development follows the spirit oftheCity'sHometown District
Overlayregulationsand Comprehensive Planrequirementsin the following manner:
(1)EnhancingtheCity'scommunity identity and sense ofplaceby incorporating
designfeaturessuchas paving and plantings thatrecognizethe importance of pedestrian
comfort and the pedestrian environment;
(2)Utilizing "genuine"materials presentedina straightforward and functional
mannerthatgivethedevelopment integrity ofdesigncompatiblewiththedesign criteria
established for the Hometown Districtandwiththeoverall image of the City;and
(3)Invigorating theeconomicand social vitality ofSouth Miami.
(4)Therestaurant use will replacealessdesirable retail use,adrycleaners.
(5)Theexistingdrycleanersgeneratesa parking demandof18 spaces onthe
Property in accordance with today's LDC that should beconsideredwhen weighing the impact
oftheproposedrestaurants.Section20-7.8 (C)(5)ofthe LDC requirestheCitytoconsiderthis
impactindeterminingthethresholdof required parking spaces whenthereisachangeofuse.
(6)Perhapsmostimportantly,theproposed development oftwo(2)restaurantson
the Property advancesthe policy ofthe City intheintentofthe HD-OV District whichtreats
parking asan element ofpublic infrastructure tobesharedby customers tothelocal business
community,andwhich encourages this consideration of shared parking,particularly in close
proximityto Metrorait.(Section 20-7.2(A),LDC).
