RESOLUTION NO.201 -1 5-1 4540 A Resolution approving a special exception,to construct a5 story Large Scale Development at6201 Sunset Drive within the Transit Oriented Development District Mixed Use-5 "TODD MU-5"zoning district WHEREAS,Oxford UniversalDesignandBuild submitted application PB-15-012 on August 11,2015 requesting approval of aspecial exception to construct a5story "large scale development"on property intheTODDMU-5zoningdistrictlocatedat 6201 Sunset Drive;and WHEREAS,ThespecialexceptionsectionintheTODD regulations (Sec.20-8.9) requiresthatanynewdevelopmentbuiltinthezoningdistrictthatexceeds 40,000 squarefeetor exceedsfour(4)storiesmustbereviewedbythePlanningBoardandCityCommissionusingthe specialexceptionapprovalprocess;and WHEREAS,Section 20-8.9 (C)requires that: (1)Allsuchusesshallcomplywithallrequirementsestablishedintheappropriate zoninguse district,unlessadditionalormorerestrictiverequirementsaresetforth beloworbytheCityCommission. (2)Allsuchusesmustbe of acompatibleandcomplementarynaturewithany existingorplannedsurroundinguses. (3)TheCityCommissionshalldeterminetheoverallcompatibility of the developmentwiththeexistingorplannedsurroundinguses. (4)If duringthereviewprocessitisdeterminedthatthedevelopment,as proposed,willpotentiallycauseadverse impact,thePlanningDepartmentshall recommendremedialmeasurestoeliminateorreduce,totheextentpossible,these impacts.Developmentprojectsthatarerecommendedforremedialmeasureswill notberequiredtosubmitanew application unlessitisdeterminedbythe Department that additional changes which would havetheeffectof increasing densities,square footage or altering theheightoruseofa Development havebeen made.Remedial measures mayinclude,butarenot limited to: i.Additionalscreeningorbuffering; ii.Additionallandscaping; iii.Building orientation; iv.Relocation of proposedopenspace,oralteration of theuse of such space; v.Pedestrian andbicyclesafetyandaccess; vi.Changestoingressandegress; vii.Addressingtrafficflowtoandfromthedevelopmenttoavoid intrusiononlocalstreetsinnearbysinglefamilyresidentialareas;or viii.Improvement ofthestreetsadjacenttotheproject,if applicable. WHEREAS,Section20-8.9(D)requiresthat: Pg.2 of Res.No.201-15-14540 (a)PriortoapprovingaLargeScaleDevelopmenttheCityCommissionmustfindthat thedevelopmentmeetstherequirementssetforthinsubsection(C)aboveandthatit: 1.Willnotadverselyaffectthehealthorsafety of personsresidingorworkinginthe vicinity of theproposeduse; 2.Willnotbe detrimental tothepublicwelfare,property or improvements inthe neighborhood;and 3.Complies with allotherapplicableCode provisions. (b)Additional Conditions.TheCity Commission may designate suchadditional requirements in connection withtheapproval of aLargeScale Development aswill,inits opinion;assure that such development will conform tothe foregoing requirements WHEREAS,the City's Planning Directorhasdeterminedthatthe developer hasmetall of the requirements setforthinthe City's Land Development Code,other than Commission approvalandthe Developer hasagreedto provide fullfrontage building withstreet design as part of pedestrian walkway system toreceiveabonus of oneadditionalfloor;and WHEREAS,theapproval of aspecialexceptionrequiresa recommendation fromthe PlanningBoardandtheapproval of theCityCommissionafterapublichearing;and WHEREAS,the Planning Board,atitsAugust 11,2015 meeting,voted6ayes,0naysto recommendedapproval of therequestforaspecialexceptiontobuilda5storystructurewith conditions. WHEREAS,theCityCommissiondesirestoaccepttherecommendation of thePlanning Board. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1:The SpecialException Application submitted bytheapplicanttoconstructa for5 story "large scale development"advances the economic development ofthe City,is compatible with land use,density,and design criteria established forthe TODD MU-5 zoning districtandisherebyapprovedsubjecttothe following termsandconditionsaswellasall applicableCityordinances,codes,rulesandregulations: (A)Planning Board conditions. (1)Reduce loadingarea driveway exitcurbcutfordeliverytrucksto15feetalong 62nd Avenue,and incorporate all driveways design to provide for better pedestrian crossing along 62nd Avenue and Sunset Drive. Site location Applicable Regulations •LDC Section 20-8.9 Special Exceptions,Large Scale Development •LDC Section 20-8.10 Bonus Allocations Analysis: Located atthe North WestcornerofSW72Street (Sunset Drive)and SW 62Avenue within the TODD MU-5 zoning district,the development plan shows a five story commercial building with a pedestrian arcade and a parking garage in the rear.The building's side exterior will look similar to the front exterior on adjacent facing streets.The frontage fagade will be along SW 72 Street (Sunset Drive). The proposed development is being built to the front property line,which is allowed.The proposed building provides a 20 foot front setback at the 5th floor as required by TODD regulations.The rear of the building provides a5 foot setback,which is allowed based on thefactthatthe parking garage is located behind the building. The maximum height ofa building in the TODD (MU-5)zoning district is four stories.If certain design elements are incorporated a developer may build up to four additional floors.The proposed development has added one additional floor based upon the bonus design provision of full frontage with street design;which is part of the pedestrian walkway system. This added feature allowsthe building tobe designed asa five story structure with a maximum floor height of14 feet per floor.The building complies with the maximum building height allowed inthe TODD (MU-5)zoning district of 100 feet. The applicant has also redesigned the loading areaby request ofthe City engineer to provide a half circular drive wayto allow for an interior delivery entranceandexitonthe groundflooralongSW 62nd Avenue. The development ofthisstructurewillbecompatibleandcomplementaryinnaturewith existing orplanned surrounding uses along SW 72 Street (Sunset Drive).Furthermore, pursuanttotheattached documentation from Miami-Dade Countyand Florida Departmentof Environmental Protection,thesubject property was successfully released from any future obligation to rehabilitate the site. Development projects that are recommended for remedial measures willhotbe required to submit anewapplicationunlessitis determined by the Department that additionalchangeswhichwouldhave the effectofincreasing densities,square footageoralteringtheheightoruseofaDevelopmenthavebeenmade.Remedial measures may include,but arenotlimitedto; L Additional screening or buffering; ii.Additional landscaping; iiL Building orientation; iv.Relocation ofproposedopenspace,oralteration of theuse of such space; iv.Pedestrianandbicyclesafetyand access; v.Changestoingressandegress; vi.Addressing trafficflowtoandfrom the development toavoidintrusionon local streets innearbysinglefamilyresidential areas;or vii>Improvement of the streets adjacent to theproject,ifapplicable. (D)Project Approval: a.RequiredConditions:Prior to approvinga Large Scale Development the City Commissionmust find thatthe development meets the requirements set forth in subsection (C)aboveand that it: 1.Will not adversely affect the healthorsafetyof persons residingorworkingin the vicinity of the proposed use; 2.Willnot be detrimental to the public welfare,property or improvements in the neighborhood;and 3.Complies with all other applicable Code provisions. b.Additional Conditions:The City Commission may designatesuchadditional requirements in connection withtheapprovalofa Large Scale Development as will, in itsopinion,assurethatsuchdevelopment will conformtotheforegoing requirements. Thegrantingofaspecialexceptionshallbeconditionedonthe Applicant signingan agreementwiththe City,in a form acceptable tothe City,which shall include all ofthe conditions required for the grantingofthespecialexception("Development Agreement"). TheDevelopmentAgreement,afterithasbeendraftedbythe City Attorney shallbe subject to approval by the City Commission.A separate agreement or covenant ("Covenant")that providesfor maintenance ofcommon elements andany other condition specifiedasa prerequisite toapprovalof the specialexception ("Maintenance Covenants") shallbe signed by the owner of the property in question.The Maintenance Covenant shall be treated asa covenant runningwithandbinding the landuponwhich the Development is situated and it shall be recorded in the land records of Miami-Dade County and,at the option of the Cityandifallowedbylaw,the Maintenance Covenantmaybe re-recorded when necessary or required tomaintain,uninterrupted,the effectiveness of the covenant running with the land.The Covenant shall provide that the owner and his/her/its grantees, heirs,successors and assigns ("Owner")shall comply with the Maintenance Covenants at the Owner's expense and without any cost to the City. (1)In the event that anyspecial exception condition includes the development ofany common areas ("CommonAreas"),the MaintenanceCovenantshallincludethe following provisions:(a)the CommonAreasshall continue in existence,as part of the structure and those Common Areasshallbe operated and maintained at the expense of the Owner of the property solongas the Development continues to exist,in whole orinpart;(b)the operation and maintenance oftheCommonAreas shall include aprovisionforlandscapingin accordance withan approved siteand development plan,approved bytheCityCommissionand the Environmental Review and Preservation Board,orasamendedfromtimeto time withapprovalofthe City Commission,the maintenance of the landscape aswellas other maintenance services and private security protection of the Common Areas;(c)the Owner shall continue,operate andmaintaintheCommonAreasinsucha manner astokeep such areas ingoodorder,clean,attractive,fully functional(subjectto interruption for maintenance,repair,restorationand renovation)and,generally,soasnotto create a nuisance to owners,occupants and users of the adjacent landand surrounding areas and to the generalpublic. (2)The Maintenance Covenantshall define the phrase "continue,operate and maintain1',asitappliestolandscaping,toinclude,butnotlimititto,the following activities: (a)Themonitoringofthelandscapeareasbya recognized landscape expert, acceptable tothe City,andthepreparationofreportsbysuch expert certifying that the landscapingisincomplianceorisnotincompliancewiththe approved Landscape Plan and all provisions included in such plan pertainingto pruning,fertilizing andgeneralmaintenance;thereportsshallbe prepared annually;and (b)The replacing of plants,trees,shrubs or the like,atthe Owner's sole expense, asdeterminedbythe landscape experttobe necessary inorderforthe landscapingto perpetually be in compliance withthe Landscape Plan. (c)In the event that the City disagrees with the opinion ofthe landscape expert hiredbythe Owner,the City shall have the right to hire its own landscape expertwhose decision shall be final.If the City's expertagrees with theexpert hiredbythe Owner,the City shall paythecostofitsownexpert,otherwise, the Owner shall paythecostofthe City's expert. (3)The Development Agreement and the Maintenance Covenantshall contain the following provision: (a)IntheeventtheOwnerbreachesitsagreement("a Default")and fails tocurethe default withinthirty(30)days (l,the Cure Period")after receiving writtennoticeofthe defaultor fails touse all due diligence in commencing thecureandin proceeding to effectuatethecure.If the Owner is unable to timely cure the default after receiving written notice,the Owner may request an extension oftimefrom the City Commission whichshallbegranted("ExtendedCure Period")upon presentation ofsubstantial competent evidenceestablishingtheOwner'sgoodfaithandduediligence,justifiable reasons for the delay and the amount of time needed tocure the default,in the event that the Ownerfailstocure the default withintheCurePeriod,orwithintheExtended CurePeriod,whicheveris greater,afineshallbe assessed against the owner in the amount ofonehundred fifty dollars ($150.00),orsuchamountasmaybesetforthin the City FeeSchedule,foreachdaythe owner remains indefault thereafter. (b)Inthe event thatafineisassessedagainsttheOwner,orthe City incursanyexpense towards curingthedefault,the City shallhavetherighttofilealien,oracontinuing specialassessment lien,asmaybe applicable,againstthepropertyand file a lien foreclose actionforthe full amountofmoneyincurredbythe City forsaidexpenseas wellasforanyfine that hasbeenassessed.The City's lienshallbeperfectedupon beingrecordedinthelandrecordsin Miami-Dade County,Florida andshallbeofequal rankanddignityasthelienof City's advaloremtaxesandsuperiorinrankand dignity toall other liens,encumbrances,titlesandclaimsin,to,oragainst the landin question, unless inconflictwith state statutes orMiami-Dade County code. (c)TheCityshallhavetherighttoproceedagainsttheOwnertocollecttheabove- described costsandexpenseswithoutresortingtoalien and/or lien foreclosure.The City's remedies shallincludeall those availableintaworinequity,includinginjunctive relief.Theexerciseofoneavailableremedyshallnotbedeemedawaiverofanyother available remedy.
